to order at 7:30 P.M. by Chairman Wendler.
Commissioners Wendler, Stevens, Von Feldt,
Reuter, Bultman, Simacek, Kunkel, and Murphy.
Commissioner Freiermuth.
Moved by Commissioner Murphy, seconded by
Commissioner Bultman to approve the Minutes
of the December 14, 1981 Planning Commission
Meeting with the correction of a typographical
error in the first paragraph on the Ordinance
Amendme~Request, to read that "the Commi-
ttee had-~isn~rssed the matter, " 8 Ayes
0 Nayes. ''' '
APPROVAL OF MINUTES
Chairman Wendler opened the Public Hearing
at 7:31 P.M. The Planner informed the Comm-
ission that a copy of the Notice of Public
Hearing, Affidavit of Publication and
Certificate of Mailing was on file. There-
fore, the Public Hearing was properly
called.

The Planner went on to explain a memo from
the Building Inspector outlining what build-
ing improvements would be necessary to bring
the buildings into compliance with the Build-
ing Code. The Planner also reiterated that
his recommendation was to deny the request,
based on the reasons listed in his memo.
Chairman Wendler read the existing ordinance
and informed that the request was to
amend the ordinance to allow an expanded
list of uses.
Councilman Dave Legler informed the Comm-
ission that he had met with neighbors in
the area, and that they recommended allow-
ing the request of the two entities, but
that the neighbors would appose any zoning
change that would allow other similar dev-
elopment. He stated that he felt the present
special use limitations for this type of
structure were too restrictive. Barbara
Martin, a member of the audience asked the
Commission how they could consider approving
such a request when the Building Inspector
had seemed to indicated that the buildings

were functionally obsolete. Chairman Wendler
informed the audience that regardless of the
Planning Commission's action, the build-
ings would still have to comply with the
Building Code, and be improved to do so.
Councilman Klimek stated that he agreed
with Mr. Legler that the individuals should
be allowed to use these two buildings.
Councilman Legler reiterated that the
neighbors did not want to see additional
buildings built for similar use. Comm-
issioner members Von Feldt, Kunkel, Bultman,
and Stevens discussed various building
code implications. Many felt that the
magnitude of improvements needed to bring
the buildings in to compliance with the
Building Code would exceed any savings
the individuals would realize by locating
an nonurban setting. After all people
present has an opportunity to be heard
on the matter, Chairman Wendler closed the
Public Hearing at 8:04 P.M.
Commissioner Murphy had indicated that
no committee report was available, that he
was still in a quandary about what to
recommend on the request, and asked what
other committee members felt. Various
members gave their opinions.
Moved by Commissioner Kunket, seconded by
Commissioner Simacek to recommend that the
Council add an additional special use to
the Agricultural Zoning District (Section
10.10 Subdivision 3H) to read as follows:
Agricultrual service operations, heavy
equipment contractors, tree service
contractors, or other seasonal occupations
or uses with the following conditions:
i. No manufacturing, fabricating, pro-
duction, or processing of materials
goods or products may be carried on.
2. No more than 4 onsite employee's
would be allowed.
3. No outside storage would be permitted.
Adequate screening from adjacent uses
shall be provided.
5. No structure larger than 10,000 square
feet shall be allowed.

6. There shall be at least five acres
for each structure.

The Planner informed the Commission that
Mr. Miller was proposing to convert the
former Kerr McGee Gas Station property into
a Doughnut shop with drive thru facilities.
He explained characteristics of the site.
Moved by Commissioner Stevens, seconded by
Commissioner Von Feldt to approve the site
plan, provided the stipulations in the
Planners memo of December 22, 1981 were
complied with. 8 Ayes, 0 Nayes.
The Planner informed the Commission that
the proposal would involve access on an
unimproved street, which was not permitted
by the zoning ordinance. Two other var-
iances would be required. The Planner
recommended an alternative proposal, where
only one variance would be necessary.
Mr. David Langenfeld informed the Commission
that he would be willing to move the garages
to a location that would conform to the
setback requirements, and that he would
agree to enter into an agreement to petition
for, and pay for street improvements to
Cannon Street as a condition of the approval
of the site plan and variances.
Moved by Commissioner Simacek, seconded by
Commissioner Kunkel to approve the site plan,
and recommend approval to the Council of
variances from the 25 foot street setback
for the open parking stalls and a variance for
the requirement that all buildable lots have
frontage on an improved public street, pro-
vided that Mr. Langenfel~ enter into an
agreement to participate in a petition for and
payment of street improvements on Cannon
Street, that the garage structure be re-
located on the site plan to conform to set-
back requirements, and that the grading plan
be altered to conform to the previously
approved plan. 7 Ayes, 0 Nayes, Bultman obstain.
Commissioner Murphy suggested, and the
Commission all agreed that a recommendation
be made to the City Council that a study

south of the Vermillion River and west
of Highway 61, to the Vermillion Street
traffic lanes.
Commissioner Reuter gave a committee
report recommending that the memo pre-
sented by the Planner be adopted by the
City Council and forwarded to the Metro-
politan Council.
Moved by Commissioner Reuter, seconded by
Commissioner Murphy to recommend the City
Council adopt the Planners recommendation
for Comment on the Metropolitan Council
Surface Water Management Program. 8
