MONDAY, MARCH 8, 1982
7:30 P.M.
Mayor Stoffel gave the Oath of Office to new
members, Commissioners Swanson, Conzemius,
and Anderson.

MEMBERS
The Meeting was called to order at 7:30 P.M. by Chairman Wendler.
Members Present: Commissioners Wendler, Swanson, Stevens, Reuter,
Simacek, Conzemius, Anderson and Murphy.
Members Absent: Commissioner Bultman.
Moved by Commissioner Murphy, seconded by
Commissioner Stevens to approve the Minutes
of the February 22, 1982 Meeting. 8 Ayes,
0 Nayes.
APPROVAL OF MINUTES
The Planner noted that on file were a Certifi-
cate of Mailing, Notice of Public Hearing, and
that an Affidavit of Public Hearing was expect-
ed in the mail. Thus, the Public Hearing was
propertly called. The Planner explained the
matter to the new members.
PUBLIC HEARING - SPECIAL
USE PERMIT AND VARIANCES -

TRICT - 1760 PINE STREET -
PAUL MURPHY
Chairman Wendler opened the Public Hearing at
7:42 P.M. Mr. Murphy, the developer, presented
a scale model of the proposed building to the
Planning Commission for their review. Comm-
issioner Stevens asked if the new lots for
the individual units were required to meet all
zoning requirements, since a variance was
being granted to the zero side yard setback
for the co,non wall property line. The
Planner responded that the lot size was con-
sidered for the structure, not the two units.
After all people present had an opportunity to
be heard on the matter, Chairman Wendler closed
the Public Hearing at 7:51 P.M.
Moved by Commissioner Simacek, seconded by
Commissioner Murphy to recommend approval of
the special use permit and zero side yard set-
back for the common wall for a twin home con-
ditioned upon Mr. Murphy submitting a minor
subdivision for the Council's approval prior
to occupancy of the structure, that the City
receive copies of the common wall and main-
tenance agreements, and that an easement be
established for the private utilities for one
unit which cross the other units' property.

Mr. Sieben's proposal also met the minimum
zoning requirements, except for the side yard
setbacks for the common wall.
Moved by Commissioner Murphy, seconded by
Commissioner Reuter to set a Public Hearing
for the March 22, 1982 Planning Commission
Meeting. 8 Ayes, 0 Nayes.
Mr. Partington's occupation would be sharpen-
ing saws in the basement of his house. The
proposal met all zoning requirements, and no
sign was included.
Moved by Commissioner Reuter, seconded by
Commissioner Simacek to recommend approval
of the Home Occupation Permit request for
saw sharpening at 805 West 18th Street.
8 Ayes, 0 Nayes.
Chairman Wendler opened nominations for
the Chairman of the Planning Commission at
8:08 P.M. Commissioner Stevens nominated
Commissioner Wendler. Commissioner Reuter
nominated Commissioner Murphy.
Moved by .Commissioner Simacek, seconded by
Commissioner Stevens to close nominations
for the Chairmanship. 8 Ayes, 0 Nayes.
A secret ballot was cast, with Commissioner
Wendler receiving five (5) votes, Commissioner
Murphy receiving three (3) votes. Comm-
issioner Wendler remains as Chairman for
1982.
Chairman Wendler opened nominations for the vice
chair at 8:11 P.M. Commissioner Stevens
nominated Commissioner Murphy.
Moved by Commissioner Simacek, seconded by
Commissioner Reuter to cast a unanimous
ballot for Commissioner Murphy as vice chair.
8 Ayes, 0 Nayes.
Moved by Commissioner Murphy, seconded by
Commissioner Reuter to adjourn at 8:13 P.M.
