HomeMy WebLinkAbout04/12/82MINUTES OF HASTINGS PLANNING COMMISSION MONDAY, APRIL 12, 1982 7:30 P.M. The Meeting was called to order at 7;30 P.M. by Acting Chairman Murphy. Members Present: Commissioners Murphy, Stevens, Reuter, Bultman, Simacek, Conzemius, and Anderson. Members Absent: Commissioners Swanson and Wendler. Moved by Commissioner Stevens, seconded by Commissioner Conzemius to approve the Minutes of the March 22, 1982 Meeting. 7 Ayes, 0 Nayes. APPROVAL OF MINUTES The Planner explained that a Notice of Public Hearing and Affidavit of Public Hearing were on file. The Public Hearing was property called. The Planner summarized the request and ob- jections voiced at the last meeting. Acting Chairman Murphy opened the Public Hearing at 7:34 P.M. Mr. Tony Blatnik informed the Commission that Ann Peterson and Mrs. Reissner had asked him to convey their opposition to the proposal. He also emphasized the letter from Ms. Peterson opposing the proposal that the Planner had read to the audience. Mr. Blatnik asked for an explanation and a read- ing of the variance requirements in the City Code. The Planner read the ordinance require- ments to the audience. Mrs. Darlene Blatnik asked Mr. Sieben if he could prove a hardship. Mr. Sieben responded that he felt he could. Be went on to discuss the sewer line situation, poor subdivision practices in the past, and compared similarities with large single family homes. The conversation between Mr. Sieben and a number of the residents ensued regarding parking, traffic, the rights of individual property owners, and neighborhood compatibility. CONTINUATION OF PUBLIC HEARING - SPECIAL USE PERMIT AND VARIANCES TWIN HOME IN AN R-2 DIS- TRICT - WEST SIDE OF RIVER STREET BETWEEN 5TH & 6TH STREETS - AL SIEBEN Commissioner Murphy informed the Commission he had talked with various officials and re- ceived the impression that the proposal should have no more impact upon traffic than a single family dwelling. Mr. Sieben indicated that he would consider delaying the proposal until September, when the traffic situation should be better, due to the opening of Pleasant Drive North. Various neighbors indicated they would like to see a decision at this time. Mrs. O'Halloran and April 12, 1982 -2- Mr. Blatnik stated that they would still be against the proposal even if the traffic decreases. Mr. Sieben informed the Commission he would formally withdraw the proposal until September. Moved by Commissioner Bultman, seconded by Commissioner Reuter to recognize Mr. Sieben's withdrawal of the proposal, and place the issue back on the agenda for the first meeting in September, with the Staff to notify all property owners on the mailing list required for the Pu%lic Hearing. 6 Ayes, Simacek Naye. The Planner informed the Commission that the proposal could be interpreted to meet the code requirements if the Commission felt the storage of materials in the garage was incidental to the office use. He also in- formed them that there should be no outside storage, as currently exists. Mr. Langenfeld informed the Commission that he needed to keep a bin outside for people that came to the premises to drop off their materials. Moved by Commissioner Simacek, seconded by Commissioner Anderson to recommend approval of the Home Occupation Permit with the con- dition that a cover be placed upon the outside bin, that the bin be moved inside each night, that the sign be improved in appearance, and that it conform to the sign ordinance. 6 Ayes, Reuter Naye. Mr. Marzen's proposal appeared to meet all requirements. Moved by ~mmissioner Reuter, seconded by Commissioner Stevens to recommend approval, since all requirements appeared to have been met. 7 Ayes, 0 Nayes. The Planner explained that the proposal met all zoning requirements. Councilman Bond was in the audience and asked how this could be approved without a new plat. The Planner stated that a new plat wasn't necessary, since no existing lot lines were proposed to be moved. Moved by Commissioner Simacek, seconded by Commissioner Bultman to approve the site plan for the proposed 4-Plex at 23rd & Cannon Streets with the condition that standard driveway openings be provided and that the shrubbery be of sufficient size to effectively screen the parking area. 7 Ayes, 0 Nayes. ,HOME OCCUPATION PERMIT- OFFICE FOR RECYCLING COLLECTION BUSINESS - 301 WEST 5TH STREET - STAN LANGENFELD HOME OCCUPATION PERMIT - SAW SHARPENING - 905 RAMSEY STREET - JEROME MARZEN SITE PLAN REVIEW - 4- PLEX - 23RD & CANNON STREETS - FRANK M. LANGENFELD & SONS April 12, 1982 -$- This site plan was a revised plan from the one previously approved. Moved by Commissioner Stevens, seconded by commissioner Reuter to approve the site plan with the condition that the shrubbery be of su- fficient size to effectively screen the area, that a standard driveway opening be provided, and that information be provided to show how the grading would conform to adjacent properties. 7 Ayes, 0 Nayes. The Planner transmitted a request by the Council for the Commission to review the zoning status of some property presently zoned industrial. The Council would like the Commission to consider the feasability of residential zoning for the area. Acting Chairman Murphy appointed a committee consisting of Commissioners Murphy, Stevens, and Conzemius to review the matter and report back to the Commission. A committee meeting is to be held at 7:00 P.M. prior to the next meeting. Moved by Commissioner Stevens, seconded by Commissioner Simacek to schedule a Public Hearing for the April 26, 1982 Meeting for the Amendment to the Comprehensive Plan recognizing seasonal and mineral extraction used under limited circumstances in the rural open space areas of the City. 7 Ayes. 0 Nayes.
