COMMISSION MEETING
1982
The Meeting was called to order at 7:30 P.M. by Chairman
Wendler.
Members present: Commissioners Wendler, Swanson, Stevens,
Simacek, Conzemuis, Anderson and Murphy.
Members absent: Commissioner Bultman.
Reuter,
Moved by Commissioner Murphy, seconded by
Commissioner Anderson to approve the Minutes of
the May 24, 1982 Meeting. 8 Ayes, 0 Nayes.
Chairman Wendler opened the Public Hearing at
7:32 P.M. The Planner noted that on file were
a Notice of Public Hearing, Certificate of Mail-
ing, and Affidavit of Publication. Therefor,
the Public Hearing was properly called. The
Planner then summarized the request.
Some members of the audience asked about the
exact location of some of the proposed housing
types. The Planner pointed them out. Commissioner
Simacek suggested tabling the rezoning request
until the Comprehensive Plan Amendments were

Commissioner Reuter to recommend to the City
Council that the developers proposal be considered
single family dwellings, and not mobile homes,
and that the property requested be rezoned to an
R-3 zoning classification which will allow the
developers to apply for a PRD, with the condition
that the Council not take any final action on
the Third Reading of the rezoning until the
Environmental Assessment Worksheet and Compre-
hensive Plan Amendments relating to this property
are resolved. 8 Ayes, 0 Nayes.

The Planner explained that the Metropolitan
Council did not feel the Comprehensive Plan
specifically enough addressed the anticipated
land use for the three (3) areas annexed in
recent years.
Moved by Commissioner Murphy, seconded by
Commissioner Simacek to schedule a Public
Hearing for an amendment to the Comprehensive
Plan which would designate the three (3)
recently annexed parcels of land for medium
density residential development, for the
June 28, 1982 Planning Commission Meeting.
8 Ayes, 0 Nayes.
Commissioner Murphy gave the Committee Report
which recommended denial based upon the feeling
that the change would be detrimental to the
character of the area. Commissioner Murphy
made that into a motion. Motion died for
lack of a second.
Mr. Reuter told the Commission that he was
requesting a change for three (3) reasons:
That the Twin Homes were not selling
because their monthly payments were so
high that they were not competitive
with existing housing.
That the neighborhood is already very
much mixed use in nature, and not con-
ducive to single family homes.
That the proposal would not increase
the number of housing units or the
amount of traffic.
Commissioner Swanson indicated that he had
changed his mind from the Committee Report,
and that Mr. Reuter has some valid points.
He suggested that something be done with the
park dedication to provide better recreational
facilities in the area.
Moved by Commissioner Swanson, seconded by
Commissioner Stevens to recommend to the Council
that they accept the requested revision to
Mr. Reuter's PRD on the conditions that the
cash for park dedication be used to develop
playground equipment in the City park land on
the West side of Cannon Street, that Mr. Reuter
be allowed to begin construction on the 4-Plex
at 22nd & Cannon prior to the improvement of
those streets, that the Council order in the
improvements to 22nd & Cannon Streets, at
least to the extent indicated in Mr. Reuter's

petition, and that a development contract be
executed allowing the units presently under
construction to be occupied when the building
and sites are completed and that construction
be allowed to begin on the new units as long
as the preliminary plat drawing is revised,
and final plat and park dedication be recorded
prior to occupancy to any of the new units.
4 Ayes, Simacek, Conzemius, Anderson and
Murphy Naye. Tied vote.
Commissioners Simacek and Conzemius indicated
they voted against the proposal because of
the situation of the umimproved streets.
The sideyard setbacks would allow a common
property line through the existing building.
Moved by Commissioner Simacek, seconded by
Commissioner Murphy to recommend the City
Council approve the zero sideyard setbacks
on the condition that an accurate minor sub-
division be executed. 6 Ayes, Reuter Naye,
Stevens Abstained.
Mr. Minder was proposing to relocate from his
existing home. Moved by Commissioner Murphy,
seconded by Commissioner Simacek to recommend
the Council approve Mr. Minder's home occupa-
tion permit request. 8 Ayes, 0 Nayes.
Commissioner Stevens brought up the subject of
the status of zoning controls in response to
recent legislation which would allow mobile
homes in single family lots. The Planner de-
scribed the current status of the issue.
Moved by Commissioner Simacek, seconded by
Commissioner Stevens to adjourn at 9:13 P.M.
8 Ayes, 0 Nayes.
