MONDAY, AUGUST 23, 1982
7:30 P.M.
The Meeting was called to order at 7:30 P.M. by Chairman Wendler.
Members Present: Commissioners Wendler, Stevens, Reuter, Bultman,
Simacek, Conzemius, Anderson and Murphy.
Members Absent: Commissioner Swanson.
Moved by Commissioner Reuter, seconded by Commissioner
Murphy to approve the Minutes of the August 9, 1982 Meeting.
8 Ayes, 0 Nayes.
Chairman Wendler opened the Public Hearing at 7:33 P.M.
The Planner indicated that on file were a Notice of Public
Hearing, Affidavit of Publication, and Certificate of
Mailing. Thus, the Public Hearing was properly called. He
then summarized the request.
Mr. Ed Stegman, 1111Lyn Way indicated that he was opposed
to the proposal because he had no confidence that there
would only be one car at a time parked at the Cavalier's
residence. He indicated that this would be especially true
if Mrs. Cavalier expanded her hours to operating on the
weekends and more than two or three days a week. Mrs.
Cavalier stated that during the day one of their vehicles
would not be parked at the home, and that since the busi-
ness would be by appointment only, there would be at the
most two cars parked at the home at once. She also indicated
she would not be operating during the weekend, and only one
evening per week. After all people present had an oppor-
tunity to be heard on the matter, Chairman Wendler closed
the Public Hearing at 7:42 P.M.
Moved by Commissioner Murphy, seconded by Commissioner
Bultman to recormmend approval of the home occupation
permit. 7 Ayes, Reuter abstained.
Commissioner Simacek indicated that he hoped this oper-
ation would be checked for adverse impact on the neighbor-
hood prior to next year% permit renewal.
Chairman Wendler opened the Public Hearing at 7:45 P.M.
The Planner indicated that on file was a Notice of Public
Hearing, Affidavit of Publication, and Certificate of Mailing.
The Public Hearing was properly called.

Mr. Reuter, responding to some Staff con~nents, indicated
that precise detail on drainage around the structures
was difficult to show. Mr. Winton Hartman, a resident in
the area, indicated that the residents of the nearby
townhouse development were looking for assurances that
this development would not cause water run-off like
they had experienced two or three years ago. He indi-
cated that with additional development in the area, the
residents were concerned that water run-off would increase,
and that the residents did not feel the storm sewers were
adequate to handle the increase. After all people pre-
sent had an opportunity to be heard on the matter, Chair-
man Wendler closed the Public HeariDg at 8:20 P.M.
Moved by Commissioner Simacek, seconded by Commissioner
Murphy recormmend approval of the proposed Preliminary Plat
and PRD subject to the July 23, 1982 Staff report. 8 Ayes,
0 Nayes.
Moved by Commissioner Simacek, seconded by Commissioner Murphy to
schedule a Public Hearing for the September 13, 1982 Planning
Commission Meeting. 8 Ayes, 0 Nayes.
The setback had been found to be in error only after con-
struction was virtually complete. 20 feet is required, nine
feet is provided.
Moved by Commissioner Simacek, seconded by Commissioner Murphy
to recommend approval of the variances due to the extenuating
circumstances. 8 Ayes, 0 Nayes.
The Committee had met prior to the Meeting to discuss the
proposed amendment.
Moved by Commissioner Stevens, seconded by Commissioner Simacek
to direct the Planner to come up with specific wording for
the amendments to require permanent foundations, restrict sheet
metal siding, add new definitions for manufactured homes, a
width standard which would not preclude future additions,
expand the criteria for bringing proposed structures to the
review of the Board of Design Control, and reviewing the
regulations regarding the review of house movings. 8 Ayes,
0 Nayes.
Moved by Commissioner Reuter, seconded by Commissioner Simacek
to adjourn at 8:50 P.M. 8 Ayes, 0 Nayes.
