MONDAY, NOVEMBER 8, 1982
7:30 P.M.
The Meeting was called to order by Chairman Wendler at 7:30 P.M.
Members Present:
Commissioners Wendler, Swanson, Reuter, Bultman,
Simacek, Conzemius, Anderson, Murphy, & Stevens,
who arrived at 7:36 P.M.
Members Absent: None.
Moved by Commissioner Murphy, seconded by Commissioner
Conzemius to approve the Minutes of the October 25, 1982
Planning Cormnission Meeting. 8 Ayes, 0 Nayes.
APPROVAL OF MINUTES
Chairman Wendler opened the Public Hearing at 7:31 P.M.
The Planner summarized the proposal. The Planner then
indicated that on file were a copy of the Notice of
Public Hearing, Affidavit of Publication, and Certificate
of Mailing. Thus, the Public Hearing was properly called.

Chairman Wendler indicated that he had just received a petition,
signed by 15 individuals, indicating opposition to vacating
the alley to provide additional lot size for the proposal.
Mr. Tom Swanson indicated that everyone he had talked to
would like to keep the alley. He also indicated that not
too many people in the area seemed to be in favor of the
twin home either. The alley is unimproved, but used for
garbage pick-up. After all people present had an oppor-
tunity to be heard on the matter, Chairman Wendler closed
the Public Hearing at 7:36 P.M.
Moved by Commissioner Simacek, seconded by Commissioner
Anderson to recommend denial of the lot size variance.
7 Ayes, Stevens, Reuter abstained.
Moved by Commissioner Murphy, seconded by Commissioner
Conzemius to deny the special use permit request, as the
lot size requirement was not met. 8 Ayes, Reuter abstained.
Moved by Commissioner Simacek, seconded by Commissioner
Murphy to approve the final plat, subject to the City's
copy containing the lot and plat areas, and the payment
of intercepter sewer fees. 9 Ayes, 0 Nayes.

Moved by Cormnissioner Murphy, seconded by Commissioner
Bultman to recommend approval of the final plat for
Ca~nnon Estates, subject to the City's copy containing
total lot and plat areas, and the payment of the park
dedication fee. 8 Ayes, $imacek Naye.

The Planner indicated that the proposal fell far short
of the number of required off-street parking stalls.
Mr. Rother indicated that much of the area of the building
would just be used for dead storage, and consequently
not generate parking demand. He also indicated that
he might be able to provide additional parking nearby.
A gentleman in the audience suggested exploring other
parking alternatives.
Moved by Connnissioner Murphy, seconded by Cormmissioner
Bultman to table the request to give Mr. Rother more
time to come up with additional parking. 8 Ayes, Swanson
Abstain.
Mr. Schmitz proposed to eliminate one home occupation
in exchange for the locksmith business. The Planner
indicated that he had been contacted by two neighbors
expressing displeasure with the way Mr. Schmitz main-
tained the property.
Moved by Commissioner Murphy, seconded by Commissioner
Conzemius to table the request and refer it to a Commi-
ttee. 9 Ayes, 0 Nayes.
Chairman Wendler appointed Commissioner Murphy to chair
a Committee of his choice to investigate the matter.
Cormmissioner Murphy asked Cormmissioners Stevens and
Conzemius to serve on the Committee.
Moved by Commissioner Simacek, seconded by Commissioner
Murphy to recommend approval of the final plat subject
to the total plat and lot areas being contained on the
City's copy, and the payment of the interceptor sewer
fees. 9 Ayes, 0 Nayes.
Moved by Connnissioner Simacek, seconded by Commissioner
Reuter to adjourn at 8:31 P.M. 9 Ayes, 0 Nayes.
