Members Present: Commissioners Murphy, Swanson, Stevens, Anderson, Wendler, and Conzemius who arrived at 7:35 P.M. Members Absent: Commissioners Reuter, Martin, and Simacek. Moved by Commissioner Wendler, seconded by Commis- sioner Anderson to approve the Minutes of the June 27, 1983 Meeting. 5 Ayes, 0 Nayes. Moved by Commissioner Wendler, seconded by Commis- sioner Stevens to recommend approval of the Home Occupa- tion Permit, since it appears to meet all zoning require- ments. 5 Ayes, Conzemius Abstaining. The Planner indicated that the Final Pat had four fewer lots than the approved Preliminary Plat, and that the developers were requesting a variance from the re- quired 20 foot walkway width to allow 12 feet. The Planner indicated that the Staff recommendation was to require at least 15 feet for a walkway width. Moved by Commissioner Swanson, seconded by Commis- sioner Wendler to recommend approval of the Final Plat, since it appears to generally conform to the Preliminary Plat, conditioned upon the payment of the required inter- ceptor sewer fees, and approval of a variance for a 15 foot walkway width as apposed to the requested of 12 foot walk- way width, as 15 feet appeared to be acceptable under these circumstances. 6 Ayes, 0 Nayes. Mr. William's described his proposed development and answered questions posed by Commission members. Mr. Jeff Connell, the Dakota County Planning Director, explained the County's intention to build a jail at the Court House site, and also explain that part of the County's requirements would include a Communications Tower. A Communications Consultant for the County, a Mr. Dubois also explained the communica- tions needs for the County, as well as the private company asking to erect a tower to serve both the County and their own needs, on the site. The Planning Commis- sion asked questions relating to the potential for the APPROVAL OF MINUTES HOME OCCUPATION PERMIT- CARPENTERS OFFICE - 1343 WEST 16TH STREET - GARY HANSON FINAL PLAT - RIVERWOOD 2ND ADDITION - SOUTH SIDE OF COUNTY ROAD #47 NEAR THE VERMILLION RIVER - SIEWERT CONSTRICTION DEVELOPMENT PROPOSAL - WHISPERING MEADOW TOWN- HOUSES - PLEASANT DRIVE AND WHISPERING LANE - MIKE WILLIAMS ZONING ORDINANCE AMEND- MENT - ADDING COUNTY JAIL AS A PERMITTED USE IN THE PUBLIC INSTITUTION ZONING DISTRICT July 11, 1983 Page 2 tower to fall, and the need to keep it away from property lines for safety purposes in the event that it would fall, disruption of television and radio reception, the possibility of different lo- cations on the Government Center property to mini- mize visual impacts on nearby properties as well as the Government Center Buildings, and the costs to the County in locating the tower at a different site. Moved by Commissioner Swanson, seconded by Commissioner Wendler to recommend that the Council approve an ordinance amendment allowing the jail as a permitted use in the Public Institution Zoning District, as this appeared to be consistant with the intent of the original rezoning. 6 Ayes, 0 Nayes. Moved by Commissioner Wendler, seconded by Commissioner Stevens to recommend that the Council amend the Public Institution Zoning District to in- clude Communications Towers as a permitted accessory use in the Public Institution Zone, with a setback from all property lines to be one half (½) the height of the structure, on the condition that the owners of the tower be responsible for clearing up any T.V. or radio reception interference. City Staff is also to verify whether the setback recommendation is consistant with industry standards. 5 Ayes, Conzemius Naye. The Planner informed the Commission of a water- shed presentation to be made before the next Council meeting. Mr. Richard Dobrick, a neighbor near the proposed Pleasant Valley Development presented a letter to the Planning Commission containing quotes from the Compre- hensive Plan that Mr. Dobrick urged the Commission to consider when reviewing any subsequent actions on the proposed development.
