MONDAY, MAY 23, 1983
7:30 P.M.
Chairman Murphy called the meeting to order at 7:30 P.M.
Members Present:
Commissioners Murphy, Swanson, Stevens,
Reuter, Martin, Simacek, Conzemius, and
Wendler.
Members Absent: Commissioner Anderson.
Cormmissioner Reuter commented that the Motion on
the partial street vacation did not include the vote
tally, which was nine ayes, and 0 nayes. The Planner
also indicated the vote most likely did not include the
statement that the Planning Commission would set the
Public Hearing for the June 6, 1983 Council Meeting.
Moved by Cormmissioner Wendler, seconded by Commis-
sioner Stevens to approve the Minutes of the May 9, 1983
Planning Commission Meeting, as corrected. 8 Ayes, 0
Nayes.
Chairman Murphy opened the Public Hearing at 7:33
P.M. The Planner noted that on file were a copy of the
Notice of Public Hearing, Affidavit of Publication, and
Certificate of Mailing. Thus, the Public Hearing was
properly called.
Mr. Tony Blatnik stated that the wrong address was
included on the Public Hearing Notice. He also indicated
that River Street has a great deal of traffic, and that
the duplex would add to the traffic safety factor. Ann
Peterson asked what the difference was between the last
time this was presented to the Commission and the present.
She indicated that she understood that the proposal met
all zoning requirements, but that the lot was too small
for the proposed use, that the proposal would have traffic
problems, and that the Commission should consider neighbors
concerns. Councilman Nesbitt indicated that there is con-
fusion by people as to what zoning district they are in.
Commissioner Swanson indicated that the issue of a side-
walk on River Street, and the width of the street are
issue that should be looked at, regardless of the outcome
of this matter, but that the Planning Commission was
obligated to review the request on how it compared with
their rules. Commissioner Wendler indicated that a single
family dwelling would have essentially the same amount of
traffic as the proposed two family dwelling.

After all people present had an opportunity to
be heard on the matter, Chairman Murphy closed the
Public Hearing at 8:04 P.M.
Moved by Comnissioner Wendler, seconded by Commis-
sioner Reuter to recommend approval of the proposed
special use permit, since the proposal meets all zoning
requirements. 7 Ayes, Simacek Naye.
Chairman Murphy opened the Public Hearing at 8:17
P.M. The Planner indicated that on file were copies of
the Notice of Public Hearing, Affidavit of Publication,
and Certificate of Mailing. Thus, the Public Hearing was
properly called. The Planner went on to recommend that
the Commission take comments on the Preliminary Plat,
but table action on the Plat until additional information
was provided to City Staff. He did indicate that the
Commission could act on the rezoning request.
Joe Kane, Don Denn, and Jack Malban asked how it
came to be that multiple family dwellings could be
allowed in this area, since their homes were single
family. The Planner explained the Comprehensive
Planning Process.
Mr. Malban informed the Planning Commission that
he was opposed to the Comprehensive Plan, and the pro-
posed development, and that they should change the Com-
prehensive Plan to say that only single family dwellings
should be allowed in the area. Most members of the aud-
ience agreed. Mr. David Fasbender indicated that he felt
the proposal would harm the Hoffman's use of thier property
as a horse ranch. Mrs. Donald Denn indicated that she
felt the Planning Commission should not allow the rezoning.
Mr. Kane stated that the Planning Commission and Council
should listen to the desires of the neighbors. After all
people present had an opportunity to be heard on the matter,
Chairman Murphy closed the Public Hearing at 9:33 P.M.
Moved by Commissioner Swanson, seconded by Commis-
sioner Wendler to recommend that the Council rezone the
proposed property from agricultural and public institu-
tion to R-3 for the purposes of the Pleasant Valley PRD,
since the proposal was consistent with the Comprehensive
Plan. 5 Ayes, Reuter and Martin Naye, Murphy Abstaining.
Moved by Commissioner Wendler, seconded by Commis-
sioner Conzemius to table action on the Preliminary Plat
until the next Planning Commission meeting, to wait for
additional information from the developer on the site
plans. 7 Ayes, Murphy Abstaining.
The Planner presented the Planning Commission with
a copy of the letter from the Minnesota Department of
Transportation regarding the plat. He also informed
the Planning Commission that a Public Hearing must be

Moved by Commissioner Swanson, seconded by Commis-
sioner Wendler to s~hedule a Public Hearing for the
June 13, 1983 Planning Commission Meeting. 8 Ayes,
0 Nayes.
Moved by Commissioner Wendler, seconded by Commis-
sioner Simacek to adjourn at 9:56 P.M. 8 Ayes, 0 Nayes.
