HomeMy WebLinkAbout04/25/83MINUTES OF HASTINGS PLANNING COMMISSION MONDAY, APRIL 25, 1983 6:00 P.M. EARLY MEETING 7:30 P.M. REGULAR MEETING The Early Meeting was opened at approximately 6:10 P.M. Mr. Guy Peterson and Ms. Ana Stern from the Metropolitan Council Housing Staff were on hand to give a presentation on affordable housing issues. The presentation lasted approximately an hour. Members of the City Council were also in attendance. Chairman Murphy called the regular meeting to order at 7:34 P.M. Members ~resent: Commissioners Murphy, Swanson, Stevens, Reuter, Martin, Conzemius, Anderson, and Wendler. Members Absent: Commissioner Simacek. Mayor Stoffel presented Patti Collins Bultman with a Certificate of Recognition for her years served on the Planning Commission. CERTIFICATE OF RECOGNI- TION TO PATTI COLLINS BULTMAN Moved by Commissioner Wendler, seconded by Commissioner Reuter to approve the Minutes of the April 11, 1983 Meeting. 8 Ayes, 0 Nayes. APPROVAL OF MINUTES Chairman Murphy opened the Public Hearing at 7:36 P.M. The Planner noted that on file were the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. The Public Hearing was properly called. PUBLIC HEARING - SPECIAL USE PERMIT - TWO FAMILY CONVERSION - 941W. 15TH STREET - GORDON DAGGETT Mr. Daggett told the Planning Commission that he plans on living at the home for at least 15 years, and that he would like to rent out the basement when his children were gone. He also indicated that there was other rental property in the area. Mr. Stocker from 937 W. 15th Street told the Planning Commission he was concerned what would happen when Mr. Daggett moved out. Mayor Stoffel stated that if there were other rental units in the area, that they were illegal. Councilman Nesbitt asked how legal nonconforming uses were established. Mr. Daggett indicated that some of the single family homes in the area have four to five cars. Councilman Werner informed the Commission that some of the people in the area felt the house was originally designed and intended to have a rental unit. Discussion then centered on whether Mr. Daggett had intended to rent out the lower level when the house was built. After all people present had an opportunity to be heard on the matter, Chairman Murphy closed the Public Hearing at 7:50 P.M. Commissioner Stevens indicated that even though the use was permitted in the R-1 District, a precedent had been established in denying two family dwellings in the R-! District. Commissioner Conzemius stated that he felt there should be no difference between the R-1 District and the R-2 Dis- trict, that if two family dwellings were allowed in the R-2 District there is no reason why they shouldn't be allowed in the R-1 District, especially when they meet~all the existing site requirements. Moved by Commissioner Conzemius, seconded by Commissioner Reuter to recommend approval of the special use permit since it meets all zoning requirements. 4 Ayes, Stevens, Reuter, Wendler, and Murphy Naye. The proposal meets all zoning requirements no on- site visits are expected, and no signs will be erected. Moved by Commissioner Wendler, seconded by Commis- sioner Martin to recommend approval of the Home Occupa- tion Permit, as it meets all zoning requirements. 8 Ayes, 0 Nayes. The Planner indicated that the Minnesota Depart- ment of Transportation had been contacted for cormments regarding access. He also informed the Planning Commis- sion about other aspects of the proposed plat. Mayor Stoffel told the Planning Commission that if they didn't require a service lane on this plat that they would be setting a bad precedent. Moved by Commissioner Wendler, seconded by Commis- sioner Stevens to table the matter until comments were received from the Minnesota Department of Transportation. 8 Ayes, 0 Nayes. The Planner informed the Commission that he had just recently discovered that the property was not connected to City sewer, and that the adjacent property owner Mr. Jerry Denn had also requested that his property be rezoned to a C-1 classification. There was extensive discussion about the access and sewer questions. Moved by Commissioner Wendler, seconded by Commis- sioner Martin to recommend rezoning from R-3 to C-1 for all three properties being discussed. After discussion the motion and second were withdrawn. There was further discussion about the need for a service road. Moved by Commissioner Swanson, seconded by Commis- sioner Anderson to recommend approval of the rezoning from R-3 to C-1 for only the property requested by Dr. Viren on the condition that the owner dedicate on demand land for the service road, and that the building be connected to public sewer system if feasible. 7 Ayes, Reuter Naye. Moved by Commissioner Swanson, seconded by Commis- sioner Wendler to recommend approval of amending the list of permitted uses in the C-1 zoning district to include veterinary clinic as a permitted use. 8 Ayes, 0 Nayes. JOHN VIREN ORDINANCE AMENDMENT - VETERINARy CLINIC A PERMITTED USE IN THE C-1 DISTRICT PUD AND SPECIAL USE PEt~M I T COM~ITTIE S Commissioner Wendler informed the Cormmission that he had reviewed the ordinances of five other cities and could not find any that specifically required recreational facilities to be developed privately for multiple family developments. The Planner commented .on changes that would be necessary if the Commission considered recommending that policy for the~ ~ty of Hastings. Commissioner Conzemius indicated that he would like to establish a Comm~ittee meeting at 6:00 P.M. before the next Planning Commission meeting to go over more on the special use permit issue. Moved by Commissioner Wendler, seconded by Commis- sioner to Conzemius to adjourn at 9:45 P.M. 8 Ayes, 0 Nayes. ADJOURNMENT
