REGULAR MEETING The early meeting to interview Barbara Martin for the Planning Commission vacancy was opened at 7:15 P.M. by Chairman Murphy. Members Present: Commissioners Murphy, Swanson, Stevens, Reuter, Anderson, and Wendler. The Commission interviewed Barbara Martin for the Planning Cormnission vacancy. INTERVIEW OF PLANNING COMMISSION APPLICANT The regular meeting was called to order at 7:30 P.M. by Chairman Murphy. Members Present: Commissioners Murphy, Swanson, Stevens, Reuter, Conzemius, Anderson, and Wendler. Members Absent: Commissioners Bultman and Simacek. Moved by Con~nissioner Swanson, seconded by Commis- sioner Wendler to approve the Minutes of the February 28, 1983 Planning Commission Meeting. 7 Ayes, 0 Nayes. APPROVAL OF MINUTES Chairman Murphy opened the Public Hearing at 7:32 P.M. The Planner indicated that on file was a copy of the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. The Planner informed the Commission that this Public Hearing had been rescheduled from the last meeting because it was discovered that the required mailing list had not been sent out for the last meeting. After all people present had an opportunity to be heard on the matter, Chairman Murphy closed the Public Hearing at 7:35 P.M. PUBLIC HEARING - PRELIMINARY PLAT AND PRD PERMIT - RIVERWOOD 2ND ADDITION - SOUTH SIDE OF COUNTY ROAD #47 NEAR THE VER- MILLION RIVER - STAR REALTY Moved by Commissioner Swanson, seconded by Commis- sioner Stevens to recommend approval of the Preliminary Plat and PRD Permit subject to the revision of the storm sewer plant to address staff concerns identifed in the February 28, 1983 Staff Report, and a thorough review of all gas company requirements by the City Attorney, that the lot size and setback requirements of the R-2 single family district apply to the development, with the excep- tion that a 20 foot front setback for garage, five foot side yard and 20 foot rear setback be allowed, that the developers be permitted to construct public improvements according to the subdivision ordinance, that all improve- ments, including the walkways be constructed with other public improvements, that Village Trail and Riverwood -2- Drive be considered as future state aid collector streets meeting state aid design standards, that the developers provide restrictive covenants requiring at a minimum the landscaping shown on the typical site plan drawing re- viewed by the Planning Commission, as well as other struc- tural standards, and that these conditions be set forth in a development contract between the City and the de- velopers. 7 Ayes, 0 Nayes. Chairman Murphy opened the Public Hearing at 7:36 P.M. The Planner informed the Commission that on file were copies of the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing. Thus, the Public Hearing was properly called. The Planner went on to summarize the Staff Report, and indicate that at least one citizen had expressed concern about assuring the drainage would not affect the property to the North, that the drainage plan be required to be adhered to, and that the property at the corner of 4th & Ash Street be better maintained. Commissioners Wendler and Conzemius asked questions about where the drainage was proposed to go in and around the development. Commissioner Wendler also asked if there were any houses on 4th Street with walkout base- ments. Mr. Sieben, the developer, indicated that there was storm sewer in the former Farm Street r~ght-of-way, that drainage followed along the rear property lines, and that there were no walkout basements on the~South side of 4th Street. Commissioners Stevens and Wendler indicated that the rules governing the distance between buildings, and the required recreation facilities be clarified in the future. After all people present had an opportunity to be heard on the matter, Chairman Murphy closed the Public Hearing at 7:48 P.M. Moved by Commissioner Swanson, seconded by Commis- sioner Wendler to recommend approval of the special use permit, the PRD permit, the five acre PRD size variance, and the front parking lot setback variance, based upon and conditioned upon the information contained in the February 25th, and March llth Staff Reports. It is the intent that the condition referring to additional drain- age detail be provided before the Council makes their final decision on this matter. 7 Ayes, 0 Nayes. Commissioner Stevens suggested that the Commission review the developed open space, the building distance, and the five acre minimum aspects of the PRD regulations. Commissioner Murphy appointed a Committee Chaired by Commissioner Wendler, and including Commissioners Stevens and Reuter to look into the matter and report back at the next meeting. PUBLIC HEARING - SPECIAL USE PERMIT AND VARIANCES - BIRCHWOOD TOWNHOMES PRD - 5TH & ASH STREETS - AL SIEBEN -3- Moved by Cormnissioner Wendler, seconded by Corcanis- sioner Reuter to reschedule the Lorenz and Nelson two family dwelling conversion special use permit requests to the March 28, 1983 Planning Commission Meeting. 7 Ayes, 0 Nayes. Moved by Commissioner Reuter, seconded by Commis- sioner Stevens to make a recommendation by writing the Commission choice on a ballot, with the voting members name included on the ballot, and the applicant with the most votes would win the recommendation. 6 Ayes, 0 Nayes Conmemius abstaining. On the first ballot a tie between Barbara Martin and Edith Kaiser resulted. A second ballot was taken, with Barbara Martin receiving the majority of votes. A copy of the ballots is on file. The Planning Commission's recommendation is to approve Barbara Martin for the Planning Commission vacancy. The Planner indicated that due the length of time that had passed since this was last acted on, a new recommendation should be passed. Moved by Commissioner Wendler, seconded by Commis- sioner Stevens to recommend the rezoning from A to R-5 (Mobile Home Park Zoning District) for the proposed Sonden Mobile Home Park property, as this proposal was consistent with the Hastings Comprehensive Plan. This is ~ubject to the development receiving a mobile home park permit, and going through the development review process. 7 Ayes, 0 Nayes. Moved by Commissioner Reuter, seconded by Commis- sioner Conzemius to adjourn at 8:34 P.M. 7 Ayes, 0 Nayes.
