MONDAY, FEBRUARY 28, ]983

7:30 P.M. REGULAR MEETING
The early meeting to interview applicants for the Planning
Commission vacancy was opened at 6:30 P.M. by Chairman
Murphy.
Members Present: Commissioners Murphy, Swanson, Stevens, Bu!tman,
Simacek, Anderson, and Wendler.
Gary P. Stevens, Edith Kaiser, and Tim Wermager were
interviewed by the Commission.
Moved by Commissioner Wendler, seconded by Commissioner
Swanson to interview Barbara Martin prior to the next Planning
Commission Meeting at 7:15, to defer decision on a recommenda-
tion to fill the vacancy until that time, and to ask the
Planner to check with the City Attorney to verify whether
voting by ballot would violate the open meeting law. 7 Ayes,
0 Nayes.
The regular meeting was called to order at 7:30 P.M. by
Chairman Murphy.
Members Present: Commissioners Murphy, Swanson, Stevens, Bultman,
Simacek, Conzemius, Anderson, and Wendler.
Members Absent: Commissioner Reuter.
Moved by Commissioner Wendler, seconded by Commissioner
Bultman to approve the Minutes of the February 14, 1983
Planning Commission Meeting.
Chairman Murphy asked Former Chairman Wendler to accept
a plaque on behalf of the Planning Commission for his years
of service as Chairman of the Planning Commission. Commis-
sioner Anderson echoed those comments, and indicated that
it was about time someone received recognition for volunteer
service for the community. Former Chairman Wendler thanked
the Commission for the recognition.
Chairman Murphy opened the Public Hearing at 7:33 P.M.
The Planner indicated that a Notice of Public Hearing was
on file, but that an Affidavit of Publication has not yet
been received from the newspaper, and that a Certificate
of Mailing was not in the file. He asked the Commission's
permission to reschedule the Public Hearing if notices had
not been distributed as required. The Commission agreed.

The Planner than went on to summarize the Staff Report,
pointing out concerns regarding the storm sewer system, the
natural gas line easement, and that this development contain
the same conditions as approved for the Riverwood First
Development. Greg Jablonske, representing the developers
indicated that the developers would be willing to work with
the Staff on resolving the drainage.
Moved by Commissioner Swanson, seconded by Commissioner
Simacek to recommend approval of the rezoning, and if the
Public Hearing notices were properly distributed, the pre-
liminary plat and PRD, subject to the revision of the storm
sewer plan to address the Staff concern, the thorough review of
all gas company requirements by the City Attorney, that
the lot size and setback requirements of the R-2 Single
Family District apply to the development, with the excep-
tion that a 20 foot front setback for garage 5 foot side
yard setback and 20 foot rear setback be allowed, that
the developers be permitted to construct public improve-
ments according to the subdivision ordinance, that all
improvements, including the walkways be constructed with
other improvements, that Village Trail and Riverwood
Drive be considered as future state aid collectors
streets meeting state aid design standards, and that
the developers provide restrictive covenants requiring
at a minimum the landscaping shown on the typcal site
plan drawing reviewed by the Planning Commission, as well
as other structural standards. 8 Ayes, 0 Nayes.
Mr. Sieben proposes to construct 12 townhome units,
and would need a special use permit, a variance from the
area requirements for a PRD, and one setback variance.
Moved by Commissioner Simacek, seconded by Commis-
sioner Wendler to schedule a Public Hearing for this
matter for the March 14, 1983 Planning Commission Meeting.

Moved by Commissioner Wend!er, seconded by Commis-
sioner Stevens to schedule a Public Hearing for the March
]4, 1983 Planning Commission Meeting. 8 Ayes, 0 Nayes.
The Planner indicated that he was waiting for some
more information, and development regarding the sewer plant
expansion before completing a set of proposed amendments
to the Comprehensive Plan.
Moved by Commissioner Simacek, seconded by Commis-
sioner Wendler to table the matter until the sewer plant
expansion information is available. 8 Ayes, 0 Nayes.
Moved by Commissioner Simacek, seconded by Commis-
sioner Wendler to adjourn at 8:14 P.M. 8 Ayes, 0 Nayes.
