At an early meeting, beginning at 6:50 p.m., Commissioners Murphy, Swanson, Reuter, Martin, Simacek, and Anderson interviewed Don Lindemann, Joan Voelker, Peter Folch, and Cory Gustafson for the two vacancies on the Commission. The regular meeting was called to order at 7:30 p.m. by Chairman Murphy. Members Present: Commissioners Murphy, Swanson, Stevens (who arrived at 9:15 p.m.), Reuter, Martin, Simacek, Conzemius, Anderson and Wendler. Members Absent: None. Moved by Commissioner Wendler, seconded by Commissioner APPROVAL OF MINUTES Reute~ to approve the minutes of the January 9, 1984 Plann- ing Commission meeting with the correction that on the vote on the sire plan revie~ for commercial building with gas pumps on the North Frontage Road, the vote should read Ayes,?; Nayes, 0, Swanson abstaining. Ayes, 8; Nayes, 0. Chairman Murphy opened the public hearing at 7:32 p.m. The Planner stated that on file were a copy of the Notice of Public Hearing, Affidavit of Publication, and Certif- icate of Mail~ng. Therefore, the Public Hearing was prop- erly called. The Planner gave the staff report. Mrs. Sue Sandkamp expressed concern that this operation may adversely affect her plans for development nearby. After all people present had an opportunity to be heard on the matter, Chair- man Murphy closed the public hearing at 7:58 p.m. PUBLIC HEARING - SPECIAL USE PERMIT FOR GRAVEL MINING OPERATION - EAST 10TH STREET AND GLENDALE ROAD - DAVIES EXCAVATION Moved by Commissioner Wendler, seconded by Commissioner Simacek to recommend approval of the special use permit based on the information submitted by the developer, and condi- tioned upon the following: 1) Houses to be constructed after the mining operation is completed shall have the minimum lowest floor elevation of at least 694 feet above mean sea level. 2) The final elevation in the northwest corner of the property should be raised approximately 3 feet to provide for greater protection from flood waters backing up into the property. 3) Seeding and other erosion control measures be taken to prevent erosion of the black dirt proposed to be temporarily stockpiled and used as a temporary buffer along the south and east perimeters of the property. Ayes, 7; Nayes, 0. Martin abstaining. Moved by Commissioner Simacek, seconded by Comm- issioner Martin to recommend approval of lot size var- iances and lot width variances for Mr. Olson's proposed two duplexes facing 12th Street, on the grounds that it is a unique circumstance, and that the proposal would remove a dilapidated structure. This approval does not include setback variances which will be needed for the structures shown on Mr. Olson's drawing. The site plan would have to be altered to meet the setback requirements. Ayes, 7; Nayes, Wendler. Moved by Commissioner Wendler, seconded by Commiss- ioner Simacek to recommend approval of Mr. Klimek's home occupation since it meets all zoning requirements. Ayes, 8; Nayes, 0. The subdivision ordinance requires that a final plat be filed within one year of preliminary plat approval. Since the preliminary plat for Highland Hills 2nd Add- ition was approved in 1981, Mr. Siewert was asking for a variance from this provision of the subdivision ordin- ance, and a variance to allow a two-foot street offset from the existing 21st Street and final plat approval. Many Planning Commission members objected to the idea of offsetting 21st Street. The alternative would be that four lots along 22nd Court would meet zoning requirements, but would have shallow depth (112 feet). Moved by Commissioner Swanson, seconded by Corm~- issioner Conzemius to recommend approval of the final plat, and approval of both variances, since some lots would otherwise be very shallow in depth, conditioned upon the payment interceptor sewer fees, and the plat review fee. Ayes, 2; Nayes, 6. Motion fails. Moved by Commissioner Swanson, seconded by Comm- ission Wendler to approve the variance of the one-year deadline for final plat submittal, since no zoning ordinance or subdivision ordinance changes have been made which would affect the plat, approval of the final plat, denial of the street offset variance, on the grounds that the street offset would make it more difficult for people to locate their property lines, and conditioned upon the plat being adjusted to re- flect no street offsets, and conditioned upon the payment of the interceptor sewer and plat review fees. Ayes, 8; Nayes, 0. Moved by Commissioner Martin, seconded by Comm- issioner Anderson to approve a variance from the lot size and off street parking requirements for Mr. James P. Furney at 319 Tyler Street since there had been a similar existing business in the neighborhood which had not caused problems. Ayes, 8; Nayes, 0. Wendler abstaining. HOME OCCUPATION PERMIT WOOD CARVING BUSINESS 924 WEST 14TH STREET ANDREW KLIMEK FINAL PLAT AND VARIANCES HIGHLAND HILLS 2ND ADDITION LOT SIZE AND PARKING VARIANCES - TRAPPING SUPPLY SHOP - 319 TYLER STREET T I T Chairman Murphy opened the Public Hearing at 8:00 p.m. The Planner indicated that the Notice of Public Hearing, Affidavit of Publication, and Certificate of Mailing were in the file. Therefore, the Public Hearing was properly called. PUBLIC HEARING - PRELIMINARY PLAT - PLEASANT VALLEY - C.R. 42 AND PLEASANT DRIVE Mr. Richard Dobrick, a nearby neighbor, explained some of the negotiations that had taken place between the developer and the neighbors, and pointed out a few con- cerns the neighbors had. After all people present had an opportunity to be heard on the matter, Chairman Murphy closed the Public Hearing at 8:12 p.m. Moved by Commissioner Simacek, seconded by Comm- issioner Wendler to recommend approval of the prelimin- ary plat, subject to the following conditions: 1) Be- fore the Council finally approve the plat, documentation shall be on file indicating the property owners to the south will be dedicating necessary road right-of-way for "Street E". 2) Before the plat is finally approved, street names consistent with street naming policies must be provided. 3) That the draft devel- opment contract be updated and signed before the plat is finally approved. 4) That City staff have the auth- ority to approve minor changes to building design and site plan design for the fourplexes, but will bring back any changes they feel is inconsistent with the intent of this approval. Ayes, 8, Nayes, 0. Commissioner Anderson nominated Joan Voelker for one of the vacant Planning Commission seats. Comm- issioner Martin nominated Peter Folch for one of the vacancies. Commissioner Swanson nominated Cory Gustafson for one of the vacancies. PLANNING COmmISSION VACANCIES Moved by Commissioner Anderson, seconded by Commissioner Martin to vote for the three nominees, with the top vote getter to get the two-year vacant term, and the next high vote getter to be appointed to the term with one year remaining. Ayes, 8; Nayes, 0. Joan Voelker received 7 votes, Peter Folch received 3 votes, and Cory Gustafson received 2 votes. The Planning Commission recommends Joan Voelker to be appointed to a new two-year term, and Peter Folch to be appointed to complete Commissioner Martin's term with one year remaining. The Planning Commission does not need to act on minor MINOR SUBDIVISION FOR subdivisions. Commissioner Reuter indicated that he did not feel variances should be granted from the setback requirements. Commissioner Wendler indicated that he felt strongly against granting variances from standards so recently approved, and suggested that reasonable use could be made of the property without granting VARIANCES AND DUPLEXES 12TH AND OAK STREETS - DON OLSON Moved by Con~nissioner Anderson, seconded by Comm- issioner Martin to table election of officers until the next meeting when the new members could vote.
