Members Absent: None. Motion by Conrmissioner Reuter, seconded by Coranissioner Simacek to approve the mim~tes of April 9, 1984. Ayes, 9; Nayes,0. APPROVAL OF NII~XES Mr. Loucks noted that the aPPlicant has requested that hearing be continued to May 14, 1984. Motion by Coranissioner Stevens, seconded by Comnissioner Reuter to continue the hearing on May 14, 1984. Ayes, 9; Nayes, 0. GORNEP~TONE BIBLE C~RRtCH - 800 BLOCK OF E. 10TH STR~iMr - REZONING FRON I-1%0 R-3 Mr. Loucks briefly reviewed the plat and indicated that the applicant had c~lied with all the conditions set forth by the Planning Conmission and City Council when the preliminary plat ~s considered. Mr. Dobrick indicated that he had reviewed the plat and revised P.R.D. contract, and found both documents to be acceptable. Motion by Co~i~,~ssioner Simacek, seconded by Coranissioner Reuter to reco~,~nd approval of the Pleasant Valley final plat. Ayes, 9; Nayes, 0. }ir. LoucI~ noted that the partners of River Ridge Apartments have requested t~hat 0~¢ Street be vacated in order to eliminate through traffic within their complex. STI~.~.'±' VACATION - OAK STR~'r FROM FOREST STPOF}If TO C.S.A.H. #47 JAMES O' CONNOR James O'Connor indicated that it was their desire to upgrade their property and place garages and landscap- ing in the areas to be vacated. Councilman Werner discussed travel _patterns in the area, traffic counts, access, and accident information. Numerous residents from the neig~oorhood spoke in opposition to the proposal, and presented a petition with sixty (60) signatures that they were opposed to the vacation of Oak Street. Motion by Co~L~issioner Simacek, seconded by C~missioner Reuter to recommend to the City Council that the street vacation be denied because there did not appear to be adeqomte need or reason to close Oak Street from Forest Street to C.S.A.H. #47. Ayes, 9; Nayes, 0. Motion by Chairman M~rphy, seconded by Conmissioner Folc~h to recoLm~nd denial of the street vacation because it would cause increased traffic in the Oak, Forest, Pine, and ~ple Street neighborhood. Ayes, 8; Nayes, 0; Abstain: CoL~issioner Simacek. Mr. O'Connor indicated that due to neighborhood oppos- ition, he requests that his application be dropped and not placed before the City Council for consider- ation. ~. Erickson indicated that the Church is intending to remodel 6,400 s~re feet of their existing structure, add a 10,000 square foot addition, and provide additional parking facilities. He further indicated that their expansion planswill require utilization of the alley in Block 65. Mr. Loucksnoted that (1) the alley traffic count was 20 A.D.T., (2) there are m~ City utilitieswithin the alley, and (3) if the alley werevacated, the Church would be responsible for all relocation costs of gas, electric, and telephone utilities. Motion by C~[ssioner Simacek, seconded by C~m,;ssioner Anderson to reco~mmnd that the City Council set a public hearing to consider vacation of the alley. Ayes, 9; Nayes, 0. Mr. Loucksnoted that the newly adopted duplexregu- lations sbz~ald be amended because of the difference in standards between new construction end conversions. A primary administrative problem with ordinance is that under the existing provisions, a developer could con- struct a new single family home, and then convert it to a duplex, and thus circunvent the intent of the ordinance. Motion by Comnissioner Sinmce~% seconded by Conmissiener Folch to reco~nd to the City Council that Section 10,02 of the Y~ning Ordirmnce be amended to read as follows: The term"conversion"means the converting ofanyone- family dwelling, built prior to the adoption of Ord- inance No. 146, to a two or three-family dwelling.
