Hastings Planning Commission
Monday, June 11, 1984
The meeting was called to order by Chairman Murphy at 7:31 p.m.
Members Present: Commissioners Stevens, Reuter, Simacek, Conzemius,
Anderson, Voelker, Folch and Murphy.
Members Absent: Commissioner Swanson.
Motion by Commissioner Anderson, seconded by Commis-
sioner Stevens to approve the minutes of May 14, 1984.
Voice vote carried unanimouslyl
APPROVAL OF MINUTES
Chairman Murphy opened the continued rezoning hear-
ing and turned it over to the City Planner. Mr. Gerlock
outlined the applicants request and future proposal, and
asked for the applicant to state to the Planning Commis-
sion its reasons for the request.

Cornerstone Bible Churchs' Pastor, James Bzoskie,
then addressed the Planning Commission. Rev. Bzoskie
explained that the church did not originally know the
property was zoned Industrial when they first became
interested. However, this was brought to their inten-
tion at an early stage. Rev. Bzoskie then introduced
Mr. Loren Lowe, an architect contracted to design pre-
liminary plans for the church's worship facility.
Mr. Lowe reviewed the proposed plans for the wor-
ship facility. He noted that the building would be an
attractive, energy efficient, earth-berm type of con-
struction. He felt the type of construction used would
be a good neighbor to adjacent properties.
Mr. Dave Tanner, attorney representing Cornerstone
Bible Church, addressed the Commission regarding the re-
quest. Mr. Tanner presented a letter from "Smead Mfg."
stating that they as one of the three adjacent property
owners had no objections to the rezoning. Mr. Tanner
then said he would like a chance to respond to additional
comments that may be made regarding the request.
Mr. Franz Altpeter, President of "Profile Extrusions
Co."~ next addressed the Planning Commission. Mr. Altpeter
told the Commission how "Profile" had expanded from 16,000
square feet in 1972, to a present square footage of 110,000.
Mr. Altpeter mentioned the reason his company had purchased
the property next to the applicants property is for future
expansion. Mr. Altpeter also mentioned that his company
operated 24 hours a day, seven days a week during most of
the summer months.

Mr. Gerlock went over the Staffs review. Mr.
Gerlock expanded on four major items that the rezoning
request presented: 1) Inconsistency with Compre-
hensive Plan, 2) Downzoning issue, 3) Spot zoning
issue, and 4) Additional requirements to adjacent
industrial land. Mr. Gerlock also noted that the re-
quest for a rezoning to R-3 could allow for many
different uses other than churches, and the impact of a
closely located industrial use could lead to future
problems. Mr. Gerlock then stated it was Staff re-
commendation to deny the proposed zoning request.
Mr. Tanner addressed the Commission in response
to City Staffs recommendation. He felt that some
type of ingenuity should be used to overcome the pro-
blems. He said that there is plenty of vacant indus-
trial land within the City at present. Mr. Tanner
noted that in his opinion, "spot zoning" is not
that bad and would not be setting a precident. Mr.
Tanner stated the applicant would place a covenent
on the property restricting future residential uses.
Commission Conzemius noted that this was the
same property that had requested a residential zone
earlier and was denied. Also, a request to rezone so
an existing home could put on an addition was denied,
which led to the home owner moving his home.
Commissioner Stevens noted that if this area
might be changing from an industrial use to more
residential uses, then we should look at amending our
Comprehensive Plan, but until we do so, we should
follow our present Comprehensive Plan.
Commissioner Simacek noted that he feels there
could be a large negative impact if the rezoning is
granted and industry expands adjacently in the future.
Mr. Tanner lastly noted that the rezoning is
economically appropriate, and other sites of similar
size are too expensive.
Motion by Commissioner Conzemius, seconded by
Commissioner Reuter to recormnend denial of rezoning re-
quest. Ayes, 8; Nayes, 0.
Commissioner Stevens reviewed the subcommittees re-
port on Haven Homes request for the extension of Prairie
Street.

HAVEN HOMES REQUEST
Motion by Commissioner Stevens, seconded by Commis-
sioner Folch to recommend to the City Council that the pro-
perty East of Mr. Reddemen's property and South of Lots 1 and 2
of the Zweber Addition be declared as surplus property. It is
further recommended that Prairie Street be extended to
give this property and Haven Homes property to the East a
public access. Ayes, 8; Nayes, 0.

Mr. Gerlock presented information relating to the
requested variance from the required setback regula-
tions. It was noted that our present zoning ordinance
defines "Structures" as anything constructed or erected
with a fixed location on the ground. Therefore, a deck
is a structure by definition and is required to meet
setback regulations. The variance request of Robert R.
Lee of 2100 Pine Street is unique in the following aspect.
The lot in question is a corner lot and a "reverse frontage
lot." Due to the reverse frontage situation, the "rear
yard" is actually a sideyard which has a 10 foot setback
requirement. The deck would be constructed to within a
8 foot setback, requiring a 2 foot variance. It is de-
termined the variance would not confer on the applicant any
special priviledge.
Motion by Commissioner Simacek, seconded by Commissioner
Stevens to reconm~end approval of the requested variance.

Commissioner Stevens made a notation that he would
like to have written verification from City Staff that
they have reviewed items needing their concerns. Mr.
Gerlock noted that he is working on a standard review
sheet. Commissioner Stevens also mentioned he had ob-
tained a copy of a summary of various committees zoning
ordinances compiled by the Metro Council and he would
leave it with the Planner. Mr. Gerlock told the Commis-
sion the City Council has requested that the Planning
Commission review the section of the City's Subdivision
Regulations concerning cash in lieu of land for park
dedication and make a recommendation. Chairman Murphy
appointed a subcommittee to study the matter. Chairman
Murphy also appointed a subcommittee to study the
Councils recon~endation to vacate the entire alley in
Block 65, Original Town of Hastings.
Motion by Commissioner Conzemius, seconded by Commis-
sioner Simacek to adjourn. Ayes 8; Nayes 0. Meeting
adjourned at 9:01 p.m.
