HomeMy WebLinkAbout09/24/84 MINUTES OF HASTINGS PIJ~NNING CO~fl~ISSION MEETING MONDAY, SEPT~BER 24, 1984 The meeting was called to order by Chairman Murphy at 7:35 p.m. Members present: Commissioners Swanson, Stevens, Reuter, Folch, Conzeimius, Anderson, Voelker and Murphy. Members absent: None. Simacek, Motion by Commissioner Folch, seconded ~y Commissioner Anderson to approve the minutes of the September 10, 1984 meeting. Voice vote carried unanimously. APPROVAL OF MINUTES The applicant intends to sell picture frames and prints at his home at 1016 Tyler Street. Motion by Cotmmissioner Swanson, seconded by Commissioner Reuter to recon~end to the City Council to approve the home occupation permit application of Thomas E. Nolan. Ayes, 8: Nayes, none. HOME OCCUPATION PERMIT - 1016 TYLER STREET - THOMAS E. NOLAN The applicant intends to operate a chimney sweep business out of his home at 1947 Maple Street. Due to the fact that no traffic flow will be generated from this home occupation, the following recommendation was made. HOME OCCUPATION. PERMIT - 1947 MAPLE STREET GERALD ANDERSON Motion by Commissioner Conzemius, seconded by Commissioner Simacek to recommend to the City Council approval of the home occupation permit of Gerald Anderson. Ayes, 8; Nayes, none. Chairman Murphy, prior to opening the public hearing, outlined the City Planning Commission public hearing rules. They are as follows; 1) Prior to addressing the Commission, a sign up sheet must be signed giving the person's name and address wishing to address the Planning Commission, 2) Response time is limited to three minutes, 3) Repetitiion shall be avoided and will be curtailed, 4) Written comments will be read into the minutes. PUBLIC HEARING - REZONING REQUEST - 160TH STREET - HASTINGS CONSTRUCTION COMPANY Chairman Murphy opened the meeting to a public hearing and turned it over to the City Planner to outline the present zoning request. The City Planner reviewed the rezoning petition by Hastings Construction Company and outlined the preliminary development plan with the rezontng request. Public testimony was given at this time. The following people addressed the Planning Co~m~ission on the related rezoning request: D. Carlson - "wants committee to be reasonable, develop- ment should interface with existing homes, not trying to curtail the development, development should fit in with the existing structures." R. Schmitt - "development should fit pattern of exist- ing development, agrees to the P.R.D. and development agreement concept." R. Staus - "wants surrounding single family homes adjacent to existing single family homes." J. Christenson - "Hastings is lacking in R-3 zoning, Industrial Park is presently being developed, the City needs affordable housing." J. Judge - "electrical contractor who is supportive of the development." F. Ziskovsky - " a realtor who is supportive of the devlopment, Hastings is in need of affordable housing, presently there are 145 homes for sale in Hastings with only 8 homes under $50,000." A. Jensen - "question the density levels, development will lower value of existing homes, will create park- ing problems, and wants a fence if development proceeds." C. Gustafson - "reminder to the co~nittee that this is a preliminary site plan only." E. Gustafson - "zoning would not be the end of the approvals the developer needs to get the necessary permits for the developer." Wick - pp ses the high density development, concern about the number units per acre." D. Kehn - "concern with lowering of property values, loss of privacy, loss of use, feels they will be spied on." D. Anderson - "Planning Committee should develop something positive, wants available playground space for each unit, does not support the idea of parks, feels loss of value on existing homes, and feels these are low income homes." D. Sawyer - "feels this would create a traffic problem." K. Sawyer - "feels the development would create too high of a density level. D. Dunkel - "complained on not receiving a hearing notice on the first hearing, feels this would create a traffic problem, wants single family dwellings." L. Kelly - "feels this would create a traffic problem." T. Kelly - "question whether or not an E.I.S. would have to be done." D. Foster - "feels traffic on #316 travels at too high rate of speed, feels the present highway is a dangerous road, feels the road needs upgrading, feels the development has too many homes and wants single family homes or left to be a farm." J. Skoog - "feels the R-3 zoning is of blanket approval." L. Reinardy - '~ants R-2 zone." R. Balster - "feels this would create a traffic problem." D. Mattson - "feels this would create a traffic problem, is this low income housing?, question the cost of the units." R. Mattson - "feels this would create a traffic problem, opposed to the number of children the development would create, is opposed to the whole idea." J. Bi,nell - "concerned with number of traffic created, wants single family homes." R. Bi,nell - '~ants single family homes." D. Swanson - "opposed to R-3 zone, question on the buffer area, wants it zoned R-i." S. Peine - "feels the concept that the people of Marshan cannot vote on this issue is not coincidental, feels the City should attract better industry that would have better paying jobs so that people could afford single family homes, question erosion problems, questioned how the quality of life would be lowered with the development." J. Limmer - "feels this would create a loss of privacy, against the whole concept, wants single family homes." L. Werth - "agrees with what's been said, hope committee has not made up minds prior to coming to the meeting." P. Farrow - "feels it is not the Job oi the ?1arming Commission to create Jobs or dollars, feels it is the Job of the Planning Committee to pltn the community, wants the committee to do an environmental assessment work sheet, traffic studies, park dedications, housing devlopment, cost of utilities, and plans, prior to the rezoning, feels there is plenty of H-3 land available in Hastings, feels this development is not needed right away. Public hearing closed at 8:42 p.m. Further discussion ensued from the City Planning Commission. Motion by Comnissioner Simacek, seconded by Commissioner Reuter to require that the developer present a more detailed plan that would be more compatible with the existing adjacent structures prior to making a recommend- ation on the rezonin~. Awes. 81Nayes, none. Note: Chairman Murphy changed the order of the Agenda on two items relating to home occupation permit applications. Chairman Murphy opened the meeting up to a public hearing regarding a preliminary plat of David Tanner. The Planning Commission reviewed copies presented relating to the seven lots on the preliminary plat. Motion by Commissioner Simacek, seconded by Cou~nissioner Polch to recommend to the City Council to approve the prelinary plat. Ayes 8; Nayes, None. The Planning Commission Chairman opened the meeting to a public hearing regarding the rezoning request of Mr. John Viren at 1104 West Highway 55. The following people addressed the Planning Commission in regard to the rezoning request: Bette Houle - Not opposed to commercial zoning, is opposed to overnight boarding of animals. Orville Nelson - Is not opposed to co~nercial rezoning of the property, is opposed to overnight boarding or kennels at the location. Jerry Denn - Not opposed to commercial zoning, is opposed to dog kennels. The Chairman appointed Commissioner Anderson as Chairman of a sub-committee to research the concept of rezoning the remainder portion of the block, including the lot located at 1104 W. Highway 55 and further have the committee investigate whether or not overnight boarding is allowable in a C-1 district. The other two members to serve on that committee PUBLIC HEARING - PRELIMINARY PLAT - LOUIS LANE - DAVID TANNER PUBLIC HEARING - REZONING REQUEST - JOHN VIREN - HIGHWAY ~55 are Commissioners Swanson and Commissioner Voelker. Chairman Murphy addressed the Cormnission on what he feels is a traffic problem and safety hazard at the intersection of 160th Street and Highway #316, and the intersection of Malcolm South Street and Highway #316. Motion by Chairman Murphy to recommend to the City Council to have Mn/Dot review the potential traffic problem and a potential solution of a three-way stop sign at both intersections. Motion failed for lack of second. At 9:47 p.m. Commissioner Anderson left the meeting. Motion by Commissioner Murphy to recommend to the City Council to ask Mn/Dot to do a study of Highway #316 with concerns related to speed limit at the intersection of 160th Street and Highway #316, seconded by Commissioner Reuter. Ayes, 7; Nayes, Mr. Larry Brown of 502 West 15th S'treet next addressed the Planning Commission in regard to his site plan approval application that was presented at the September 10, 1984 meeting. Mr. Brown addressed the Planning Commission and made various statements concerning his confusion that he is come against receiving site plan approval for the addition to his home. In his discussion, it was noted that he does not intend, nor want to build a church facilit~simply an addition to his house that would be large enough to allow for bible study. It was further noted that this would be only serving this purpose for a temporary period. Mr. Sader addressed the Commission on similar bible studies that they have allowed in homes to start the parish out in other cities around the United States. The church facilities attorney addressed the Planning Commission and noted that it was in violation of their constitu- tional rights to not be able to allow the applicant to have the addition to be used as a bible study area. George Grupa, of 1413 Walnut Street addressed the Commission in regard to the issue and objected to the addition to the house due to the fact of noise created by the amount of people using the facility. No action was taken due to the applicant withdrawing his request. Mr. Ken Grund, of 371 E. Kellog Boulevard, St. Paul, Minnesota, next addressed the Planning Commission on a potential application for a mobile home park permit. The area in concern OTHER BUSINESS is the area that has been zoned R-5 (mobile home park) that was previously owned by Willis 01son. At present, Mr. Ken Grund has an offer to purchase based on the applicant being able to receive a mobile home park permit. Mr. Grund presented a preliminary layout of the mobile home park he hopes to develop. Mr. Grund hopes to develop the park in three phases with construction to begin in the spring of 1985, and the petition for sewer and water utilities in the spring of 1985. Motion by Counnissioner Simacek, seconded by Commissioner ADJOURNMENT Conzemius to adjourn. Ayes 7; Nayes, none. The meeting adjourned at 10:28 p.m.
