The meeting was called to order by Chairman Murphy at 7:36 P.M.
Members Present: Comnissioners Swanson, Stevens, Renter, Simacek,
Conzemius, Voe!Pmr and bbrphy.
Members Absent: Co~'~issioners Folch and Anderson
Motion by CoLzL,;ssioner Stevens, seconded by C~f~fd~ssioner
Reuter to approve the minutes of the September 24, 1984
meeting. Voice vote carried unanimously.
APPROVAL OF MIBRYI~S
At this tin~, the Planning Co~ission Chairman moved the
scheduled iten concerning annexation request to the first
ite~n addressed by the Planning Commission. The City
Planner addressed the Planming Conmission commerning the
petition from Mr. Dalbotte~ concerning annexation ~ithin
the City and the township's orderly annexation agreement
area. The City Planner discussed that he had met with the
City Engineer and the possibility of extending services to
this lot within one year, as the orderly annexation agree-
ment states would not be practical. The problem arises
in that to extend sanitary se~er over to Lot 16021, it
would have to run in the 20 foot easement ~ich exists
along the present City limit line. This would not be a
practical extension due to the fact that it would have to
run through the c~netery and several grave sites obstruct
the path of the intended sewer line. A more practical
approach would be to extend the sewer down Highway 61
along the drainage easement. Therefore, it is staff
recommendation that this armexation of this single
lot be denied until services could be extended within
the one year time frame as stated in the orderly annex-
ation agreament.

Conzemius to reco~¥~nd to the City Council approval of
the petition for annexation if the annexation can be
legally adopted without the area being serviced with
utilities within the one year time frame. Ayes, 6;
Nayes, 1.
The applicant is requesting prelimirmry plat approval of
a replat so he may eliminate interior lot lines to provide
a comnon property for the proposed four-~lex condominiun
units.

The applicant intends to convert his single family home
to a two-family structure and therefore is requesting a
variance from the required front lot width requirement of
75 feet. The applicant's front lot width is 72.8 feet.

The City Co%~cil has requested that the Planning C~m',~ssion SURPLUS PROPERTY -

A of the City of Hastings concerning its declaration of CITY OF HASTLNGS
surplus property.
Motion by Con~t,;ssioner Simacek, seconded by Cum~lssioner
Murphy to recum~nd to the City Council that the area
be declared surplus property. Ayes, 7; Nayes, None.
The City Planner addressed the Planning Conmission on
the issue of the area being rezoned to C-1. The Planner
addressed the C~m~ission on concerns that if the _property
vms zoned to C-1 could the zoning allow for overnight
boarding of animals. The Planner noted that he brad
talked to the City Attomey's office and it vms the
City Attorney's inteKpretation that a C-1 zone would
not allow for the overnight boarding of animals.
REZONING REQUEST -

Motion blz the Plarming Cm~i~ission Chairman to have the
subc~m&ttee review the City Zoning Ordinance and make
a recum~ndation as to if the Planning Conmission
should amend the present zoning ordinance to allow for
overnight boarding in some zoning district other than
agricultural.
Discussion ensued on the petition request of Hastings
Construction Company for an R-3 zone.
Motion by Conmissioner Simacek, seconded by Conmissioner
Swanson to rec~nend to the City Council that the
recently amexed area be rezoned to R-3 with the
stipulation that they apply for a P.R.D. Permit.
Ayes, 6; Nayes, None; Abstain, 1.

Discussion ensued on the Council's rec~m~mdation that
mobile home park standmrds be increased.

Motion by Conmission Simacek, seconded by Conrmissioner
Stevens to table the reco~mmndation until the City
Planner can obtain information from surrounding cities
regazding mobile home park standards. Ayes, 7; Nayes, None.
The City Planner read the staff rec~ndation concerning
the applicant's request for a variance. The staff's
recc~ndation was to dany the request to vary the terms
of regulations for signs, due to the fact that the
applicant cannot danonstrate that circunstances exist which
are peculiar to the structure, or that literal interpret-
ation of the City Code would deny the applicant of rights
enjoyed by other properties in the same district.

Motion by Conmissioner Stevens, seconded by C~,.~ission
Reuter to deny the variance request upon staff's
reco~ndation. Ayes, 6; Nayes, None: Abstain, 1.
Mr. Loren Wicat addressed the Planning Conrmission
regarding his application to vary the terms of the
zoning ordinance with relation to required side yard
setbacks. Mr. Wical wishes to construct a detached
two car garage that would be built to within 18 inches
of the side property line.

Motion by Coranissioner Conzemius, seconded by Conmissioner
Reuter to deny the request for a v~riance due to the
fact that the applicant cannot demonstrate an undue
hardship, plus, the applicant could build the
garage with conformity to setback requirements on his
property. Ayes, 7; Nayes, None.
The Planning Conmission Chairnmn gave notice that he
would be resigning from the Planning Co~m~ission effective
December 1, 1984. Mr. Brooks Swanson also notified the
Planp_ing Con~ission that he would also be resigning,
effective December 1, 1984. The Chairman recc~n~nded
that the Planner place an ad in the local paper to
acquire applications to fill the vacancies.
OTHER BUSINESS
The Planning Comuission discussed changing the next
Planning Cc~,ission from November 12th to November
13th due to Veteran's Day falling on the 12th. It is
recoranended that unless the Planning C~&ssion's
Agenda has a pressing item that the first meeting of
the month be cancelled. It was further rec~nded
then that the only meeting in November of the City
Planning Co~m~ssion would be the fourth Monday of
the month.
