HomeMy WebLinkAbout11/26/84 MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, NOVEMBER 26, 1984 The meeting was called to order by Chairman Murphy at 7:30 p.m. Members Present: All members present. Due to the inadvertent distribution of the September 24, 1984 minutes instead of the October 22, 1984 minutes, the approval of the last minutes will be carried over until the next Planning Commission meeting. The City Planner reviewed the present mobile home park stand- ards and the standards recommended by the City Council. The Planner also reviewed requirements that are used by several surrounding cities. The Planner reviewed the memo to the Planning Commission concerning the requirements and proposed changes. In the memo, it is the Planner's thoughts that using a flat minimum lot size requirement is not necessarily the best alternative. It is staff's recommendation, due to the changing mobile home industry, that a combination of a flat minimum lot size requirement and a number of units per gross acre be combined to control the density of a mobile home park. This would give the development more flexibility but would tend to encourage sizes above the bare minimum requirement, due to the fact that with the number of units per gross acre requirement, going to the smaller size, would not allow for any more units per acre. Motion by Commissioner Stevens, seconded by Commissioner Simacek to recommend to the City Council the City staff's recommendation for amendment to the mobile home park regulations with the additions that (1) the patio requirement be eliminated, and ~w6 off-street parking spaces be required, and (2) that maximum lot coverage be limited to 25 percent by the principle structure. Ayes, 9; Nayes, O. The City Planner reviewed the application which asked the City Planning Commission to review the present zoning ordinance concerning the overnight boarding of animals. The question specifically, was should the City allow for the overnight boarding of animals in some other zoning district other than the agricultural zone, and more specifically, should it be allowed in a commercial zone. Commissioner Anderson, who served as Chairman of the sub-committee reviewing this request, recommended to the Planning Commission, to recommend to the City Council APPROVAL OF MINUTES MOBILE HOME PARK STANDARDS ZONING ORDINANCE AMENDMENT - KENNELS that even though they see a need for a kennel in the City, that the ordinance not be amended to allow for the over- night boarding of animals in a commercially zoned district. Motion by Commissioner Anderson, seconded by Commissioner Voelker to recommend to the City Council that even though they are aware there is a need for the kenneling of animals in the City of Hastings, it is their recommendation that the City's present zoning ordinance not be amended to allow for the kenneling of animals in a commercial zoning district. Ayes, 8; Nayes, abstain 1; Nayes, O. The Planner reviewed the applicants petition to convert his single family home to a two-family residence. It was pointed out that while the conversion is a permitted use in an R-2 zone, the existing front lot width of 72.8 feet is 2.2 feet short of meeting the 75 foot front lot width requirement. Therefore, it is necessary that a variance would be required to allow for the difference. It is staff's recommendation until the applicant has demonstrated that special conditions and circumstances exist and that granting the variance would not confer upon the applicant any special privileges denied by the zoning ordinance, that the variance be denied. VARIANCE REQUEST - 330 EAST 18TH STREET - DON KELLER Discussion ensued on the possibility of the setting of a precedent of this issue due to the fact this is the first time that a front width variance request has been petitioned for since the amendment of the 66 foot rule to the 75 foot rule. It was noted by the Planner that the intention of the 75 foot rule was to stop the loop- hole that the ordinance allowed to developers who would build a new structure which required only a 66 foot rule and then converted it to a two-family structure immediately, which also only required a 66 foot width. The applicant addressed the Planning Commission and noted that if the Commission viewed the structure, that the adjacent dwelling is a two-family structure, and that the neighborhood would be compatible for an additional two- family residence. The applicant further noted that he felt the highest and best use of the property would be for a two-family residence. The Planning Commission noted that it was not the usage of the property that was requesting a variance but rather the required front lot width requirement. Motion by Commissioner Folch, seconded by Commission Reuter to recommend to the City Council that the variance request be denied. Ayes, 7; Nayes, l, abstain, 1. Staff reported to the Planning Commission that the applicant had originally split and sold the property on April 1, 1982. The property has not been recorded with the Dakota County Recorder at this time, due to the fact that it needs MINOR SUBDIVISION REQUEST - 106 WEST 6TH STREET - MELVIN HUMBERT approval from the City of Hastings. It was pointed out by the City Planner that split would require a declaration of minor subdivision and a certificate of survey, which now have been submitted. Motion by Commissioner Simacek, seconded by Commissioner Murphy to recommend to the City Council that the minor subdivision request be approved. Ayes, 9; Nayes, O. The petitioner presented a request to rezone approximately five acres of his property located adjacent to 160th Street. Motion by Commissioner Simacek, seconded by Commissioner Conzemius to set a public hearing for December 10, 1984 for the rezoning and preliminary plat request. Ayes, 9; Nayes, O. The City Planner presented the final plat request of Pleasant Valley 2nd Addition. It was noted that the front yard set- backs on Lot 5 through 8 were off approximately 2½ inches and the structure on Lots 9 through 12 is off approximately 6 inches. It was further noted that the developer did not intentionally encroach on the setback requirements and it was an error in measurement. It was noted secondly, that the interior easements need to be removed. The applicant addressed the Commission on this issue and stated that a formal letter requesting vacation of the interior easements would be presented to the City Council in the near future. Motion by Commissioner Simacek, seconded by Commissioner Conzemius to recommend to the City Council approval of the final plat. Ayes, 8; Nayes, 1. The City Planner told the Planning Commission that a check- list procedure had now been developed and would be followed by the City staff in all further review of items brought to the Planning Commission. Commissioner Stevens addressed the Planning Commission on the Met Council Housing Guide Plan. Commissioner Stevens further handed out summaries of the Metropolitan Council Development Housing Guide. Commissioner Anderson noted to the Planning Commission and media present that he would remain on the Planning Commission to fulfill his term and if so appointed by the City Council would further remain on the Planning Commission. This met with approval of the Planning Commission. REZONING AND PRELIMINARY PLAT REQUEST - 160TH STREET - HASTINGS CONSTRUCTION COMPANY FINAL PLAT - PLEASANT VALLEY 2ND ADDITION - JACK CHRISTENSON OTHER BUSINESS Commissioner Simacek addressed the Planning Commission on the resignation of Chairman Murphy and congratulated him on the 6½ years of dedication and fine work that he gave the City of Hastings through the Planning Commission. There were further congratulations to Commissioner Swanson at this time, on his resignation, and many thanks to him for his contribution. Motion by Commissioner Swanson, seconded by Commissioner Simacek to adjourn. Ayes, 9; Nayes, O. ADJOURNMENT Meeting adjourned at 8:55 p.m.
