HomeMy WebLinkAbout12/10/84 MINUTES OF HASTINGS PLANNING COMMISSION MEETING MONDAY, DECEMBER 10, 1984 The meeting was called to order by Chairman Murphy at 7:30 p.m. Members Present: Commissioners Reuter, Folch, Simacek, Conzemius, Anderson, Voelker and Murphy. Members Absent: Commissioner Stevens - Commissioner Swanson, at this point had resigned. Chairman Murphy pointed out at this time that he had resigned effective Dec- ember 1, 1984, but could serve as the Chairman until the appropriate number of members were appointed. Due to the fact that Commissioner Stevens, who will serve as Chairman until a permanent Chairman is appointed in the beginning of January of 1985, could not be present, Commissioner Murphy volunteered to chair the meeting. Motion by Commissioner Reuter, seconded by Commissioner Simacek to approve the minutes of the October 22, 1984 meeting. Voice vote carried unanimously. Motion by Comm- issioner Anderson, seconded by Commissioner Voelker to approve the minutes of the November 26, 1984 meeting with one change. The change noted would be that the motion to recommend to the City Council to deny amending the City's zoning ordinance to allow for the overnight boarding of animals in a commercial district, was made by Commissioner Anderson, not Commissioner Stevens. Voice vote carried unanimously. APPROVAL OF MINUTES The Chairman opened the meeting to a public hearing to con- sider the zoning request at this time. The Chairman then asked the City Planner to outline the petition as presented to the Planning Commission. The City Planner presented a video tape which showed the area which has requested the rezoning. The Planner also outlined a proposed concept plan for the intended use on the petitioned parcel. PUBLIC HEARING - REZONING REQUEST - 160TH STREET - HASTINGS CONSTRUCTION COMPANY At this time, several citizens of Marshan Township addressed the Planning Commission on the rezoning issue. The general consensus of the citizens of Marshan Township was that the proposed usage in the R-3 zoning district was of a density level that was too high to be compatible with their single family homes. Mr. Cory Gustafson, the developer, addressed the issue and noted that he felt that the Hastings Con- struction Company was being treated as a second rate developer. He further noted that the citizens of Marshan had wrongful intentions that the development would be second rate and of shoddy workmanship. Motion by Commissioner Simacek, seconded by Commissioner Folch to recommend to the City Council that the request for a rezoning to an R-3 be denied due to the fact that it is "spot zoning." Ayes, 5; Nayes, O; Abstain, 2. The City Planner next presented the information concerning a minor subdivision request from Mrs. Oscar Radke. Due to the fact that the City's zoning ordinance does not allow for two principal structures on one lot, a minor subdivision was required to change the direction of the lot lines to provide for enough area for two conforming lots. When this was done, it was found that the small structure which was to be rehab- ilitated and have sewer and water lines extended to it, was found to encroach on the City's Franklin Street right-of-way by eight feet. Now the question to the City Planning Commission and City Council is whether or not the minor subdivision should be approved and if so, then a vacation of Franklin Street would be necessary. The alternative would be to explore the cost to move the small structure to the adjacent lot which has existing sewer and water lines. It is City staff recommendation to obtain cost estimates on the cost of moving and compare them to cost estimates of extending sewer and water lines from Franklin Street to the existing structure. Motion by Commissioner Simacek, seconded by Commissioner Reuter to recommend approval of the minor subdivision if the City Council determines the cost of relocating the house to the adjacent lot is prohibitive, and vacates the portion of Franklin Street that would be necessary to have the existing parcel remain. Ayes, 6; Nayes, O; Abstain, 1. It was discussed this time the number of applications that the City has received to replace the two vacancies on the Planning Commission. At this time, only two applications have been received. MINOR SUBDIVISION REQUEST - 901 EAST 2ND STREET - MRS. OSCAR RADKE PLANNING COMMISSIONERS APPLICATIONS Motion by Commissioner Reuter, to recommend to the City Council the two people who have applied to the City Planning Commission. Motion d~ed for lack of second. The Planning Commission determined at this time to continue to accept applications for the Planning Commission vacancies until January. Commissioner Murphy at this time, wished everyone a Merry Christmas and Happy New Year. Motion by Commissioner Simacek, seconded by Commissioner Conzemius to adjourn. Voice vote carried unanimously. The meeting adjourned at 8:41 p.m. OTHER BUSINESS ADJOURNMENT
