HASTINGS PLANNING COMMISSION MEETING
MONDAY, JANUARY 28, 1985
The meeting was called to order by Chairman Stevens at 7:30 p.m.
Members Present: Commissioners Reuter, Folch, Simacek, Conzemius,
Anderson, Voelker and Stevens.
Members Absent: None.
At this time, the Mayor swore in the two new Planning
Commission members, Thomas Ditty and Edith Kaiser.
COMMISSIONER
APPOINTMENT
Motion by Commissioner Simacek, seconded by Commissioner
Reuter to approve the minutes of the January 14, 1985
meeting. Voice vote carried unanimously.
APPROVAL OF MINUTES
The Chairman opened the public hearing at 7:32 p.m.; being
that there were no comments from the audience, the public
hearing was closed at 7:33 p.m. The City Planner
addressed the Industrial Park No. 3 plat at this time.
The Planner discussed that the staff had reviewed the
plat and found no inconsistencies with the City Code
dealing with subdivision plats. However, the Planner did
indicate that Commerce Drive would need to be vacated.

Motion by Commissioner Folch, seconded by Commissioner
Anderson to recommend to the City Council, approval of
the F±naZ plat of Hastings Industrial Park No. 3.

At this time the Chairman opened the public hearing at
7:36 p.m. Mr. Wint Hartman addressed the Planning
Commission and pointed out what he felt were several
problems that the development would incur on adjacent
land owners due to the potential drainage problems. Mr.
Liska also addressed the Planning Commission on what
he felt were problems of high density and drainage.
Commissioner Voelker questioned if the area could be
serviced by sanitary sewer. Commissioner Conzemius
questioned the park dedication and asked for the staff
to review this issue and make a recommendation on
whether or not the dedication will need to be met. It
was recommended that the City Engineer do a cross
section and show how much water is drawn through
this area and be presented to the City Planning
Commission at the next meeting.

Motion by Commissioner Simacek, seconded by Commissioner
Reuter to table the preliminary plat until the Engineer-
ing Department has completed the runoff study. Ayes, 9;
Nayes, O.
The public hearing closed at 8:14 p.m.
The City Planner reviewed the proposed preliminary plat
and rezoning of A1 Sieben for his property located along
LeRoy Avenue. The staff recommended to the City Planning
Commission to set a public hearing for the rezoning and
preliminary plat at the next regular scheduled Planning
Commission meeting.

Motion by Commissioner Simacek, seconded by Commissioner
Conzemius to set a public hearing for the next regular
scheduled Planning Commission meeting. Ayes, 9; Nayes, O.
The Planner reviewed the request of Mr. Jablsonske in
which he is asking for a variance to convert an existing
duplex to a tri-plex use. The usage of a tri-plex in
the R-2 zoning district is a permitted use, however, the
lot size requirement and minimum lot frontage are not
being met by the existing property. The requirement is
a 75 foot frontage with a minimum square footage of
12,400 square feet. The existing lot has a 66 foot
of frontage and a total of 9,900 square feet.

Motion by Commissioner Conzemius, seconded by Commissioner
Reuter to table the variance request until the ruling on
a similar court case the City is involved in. Ayes, 6;
Nayes, 3.
The Planner reviewed the variance request in which the
applicant is intending to convert a single family home
to a duplex. The intended usage is a permitted use
within the R-2 district. However, the minimum lot size
andaminimum frontage width are not met with the existing
lot. The requirement is a minimum of 75 feet of frontage
and a minimum total square footage of 9,700 square feet.
The existing lot has a 50 foot frontage and 7,500 total
square feet.

Motion by Commissioner Simacek, seconded by Commissioner
Voelker to recommend to the City Council that the
variance request be denied. Ayes, 9; Nayes, O.
The City Planner reviewed the home occupation application
in which the applicant is intending to operate a computer
service, word processing and bookkeeping service out of
his home. Staff has reviewed the application and has
determined that the use will meet with City Code con-
cerning home occupations. It was further noted by staff
that the City's home occupation ordinance should be

reviewed, and that certain City home occupations should
be permitted at staff level and not be run through the
City Planning Commission or Council. The present
ordinance is requiring a large amount of staff time,
Planning Commission time, and City Council time. It
was noted that most cities are streamlining their
home occupation permits due to the changing economy
and a large development in the area. Certain com-
patible uses for home occupations could be permitted at
staff level and reviewed on an annual basis. If there
are problems, they could be halted at any time. It was
noted further, that with the present system, with the
amount of time for the permit process, the home
occupation fee of $10 does not come anywhere close to
covering the actual cost to the City.
Motion by Commissioner Simacek, seconded by Commissioner
Conzemius to recommend approval of the home occupation
permit to the City Council. Ayes, 9; Nayes~ O.
The City Planner reviewed the request that is being
presented by Ms. Nancy Radke in which the applicant is
asking for a variance from the front yard setback require-
ment. It was noted that this is an existing structure
in which the City had no way of knowing it was encroaching
upon the City's required front setback until a recent
survey was done to reverse the lot lines creating a suit-
able lot. Due the circumstances, and a proof of undue
hardship~ the staff recommended to the Planning
Commission approval of the variance request.
Motion by Commissioner Simacek, seconded by Commissioner
Reuter to recommend to the City Council approval of
variance request due to the fact the request does meet
the outline requirements of undue hardship and special
circumstances which exist with the structure and lot
involved. Ayes, 9; Nayes, O.
Mike Williams, developer of the Whispering Meadows sub-
division addressed the Commission and noted that he
would be more than willing to work with City staff to
come to a workable solution to the possible drainage
problem.
Mr. Wint Hartman addressed the Commission, and also noted
his agreeableness to work with the Commission on solving
the problem.
Commissioner Voelker presented information concerning a
Senior Citizen dinner that is being held in St. Croix
Falls and asked if there was anyone who would be
interested in attending.
