Monday, April 8, 1985
The meeting was called to order by Chairman Simacek at 7:30 pom.
Members Present: Commissioner Ditty~ Reuter, Folch, Kaiser
Conzemius, Anderson, Volker, and Chairman Simacek.
Members Absent: Stevens
Motion by Commissioner Anderson, seconded by Commissioner Kaiser
to approve the minutes of March 25, 1985 as submitted.
Ayes, 8; Nayes, None.
Planner Loucks noted that the applicant is requesting a Home
Occupation permit to operate a decorative balloon bouquet
business in her home.
It is anticipated that approximately 10 cars per week will be
visiting the home with an average length of stay of approximately
15 minutes. It was noted that the site provides enough room for
4 off street parking spaces and that the proposed home occupation
will occupy approximately 10% of the floor area of the home.
Following a brief review of the project with Mrs. Seleski a
motion was made by Commissioner Reuter, seconded by Commissioner
Kaiser to recommend approval of the home occupation subject to
the following conditions: 1. No signs will be allowed to identify
the business being carried on in the home. 2. No employees are
allowed other than those that are family members; 3. That the
permit will be reviewed on an annual basis. 4. That all helium
cylinders used to fill balloons shall be affixed to a wall or
post to prevent accidental tipping or valve breakage.

Commissioner Stevens arrived at 7:40.
Planner Loucks noted that the applicant is requesting a six foot
sideyard variance in order to accomodate a duplex to be located
at the intersection of 10th & Ramsey Street. He noted that the
variance is required because the applicant is attempting to
conform to zoning ordinance requirements to provide 25 feet of
front yard setback on both 10th & Ramsey Street. If the ordinance
was literally interpreted it appears that the building could be
closer than 25 feet to 10th Street, however, it is their desire
to meet the 25 foot setback inorder to create a larger front yard
for the units and further more to create a safer site line at
the intersection.

Mr. Terrio and other residents of the neighborhood commented that
they felt there were to many duplexes presently located in their
neighborhood and therefore felt that the Planning Commission should
evaluate the zoning question of allowing duplexes in the R2 district.
Chairman Simacek noted that the commission had studied the concept
of allowing duplexes in the R2 zone, held numerous public hearings,
and public information meetings in order to arrive at the present
formula for allowing duplexes in the R2 zone. He further noted that
there was no negative comments received when this issue was being
studied two or three years ago. However, he felt that the commission
is receptive to the concerns being expressed by the residents this
evening.
Following a brief discussion with Mr. Balitz a motion was made by
Commissioner Folch seconded by Commissioner Conzemius to recommend
approval of the six foot sideyard variance because the applicant
is providing better site lines at the intersection of 10th & Ramsey
Street and secondly the closest structure located
adjacent to the sideyard where the variance is being proposed is
some 29 feet away. Ayes, 9; Nayes, 0.
Planner Loucks noted that the applicant is requesting site plan
approval for 271 single manufactured home sites and 70 double
manufactured home sites for a total of 341 units. The property
is 68.2 acres in size and will he developed at a density of
approximately 5 homes per gross acre.
It was noted that upon staff review that the following matters must
be resolved or reconciled prior to the issuance of any building
permits; 1. Approximately 20 fire hydrants within the development
should be placed in such a manner that the furthest residential
structure will be no greater than 250 feet from any hydrant.
2. That the cul-de-sac designated on the north portion of the
proposal be shortened to a distance of 500 feet in order to satisfy
minimum requirements of the subdivision regulation. 3. That an
agreement be entered into with the City regarding the proper
installation and maintenance of the water system in order to insure
that any breaks in the lines within the development will not render
the entire development dry for fire fighting purposes. 4. That a
complete landscape plan be submitted for approval.
Residents of the neighborhood namely Mr. Jensen, Schmitt, Stugat,
Wertz and Ms. Balister made the following general comments;
That traffic is going increase on 160th Street, that an EAW should
be required because the one that was previously prepared only anticipated
that 243 manufactured home units were going to be placed on the site ,
that the site is located to close to the D.N.R. hunting preserve,
that the plan does not provide for adequate storm shelter as required by
State law, that the density is to great, that a buffer zone should be
provided between the manufactured home park and existing homes along
Malcolm Avenue , that a noise abatement study should be conducted, and
that a secondary access should be provided to Highway 316.

The Planning Commission reviewed the various concerns expressed by the
residents including the potential need for construction of a ~erm or
more dense planting of coniferious trees along the west side of the
site , potential drainage problems along the west side of the site ,
and transportation and circulation issues.
Following further discussion a motion was made by Commissioner
Kaiser seconded by Commissioner Conzemius to recommend approval of the
site plan subject to the conditions that the developer will work out
specific details with the staff as outlined in the City Planners Staff
Report. Ayes, Commissioners Stevens, Kaiser,Simacek and Conzemius;
Nayes, Commissioner Ditty, Reuter, Folch, Anderson, Volker. Motion
failed.
Motion by Commissioner Kaiser, seconded by Commissioner Anderson to
table the application to April 22nd, 1985 to allow the staff an
opportunity to meet with the Malcolm Avenue residents and developer
to work out specific issues related to the development proposal.

Motion by Commissioner Kaiser, seconded by Commissioner Anderson to
table the variance request until April 22nd, 1985. Ayes, 9; Nayes,0.
Planner Loucks noted that the applicant is requesting a rezoning from
R2 residential to C1 commercial. The intent of the application is
to construct a 4,000 square foot office building on lots 1,2 and 3
of Addisons Addition, It was noted that the comprehensive plan
designates the property in question for single family residential
use, does not generally comply with the requirements of the
comprehensive plan in terms of location of cormmercial districts,
represents the start of a strip commercial development along State
Trunk Highway 55, the property has limited access to State Trunk
Highway 55 when upgrading occurs in 1987 and that such zoning could
have a negative impact on existing residential development which
is located adjacent to the proposed site
John Langenfeld, representing CWL Construction then made a brief
presentation as to why the property should be rezoned to C1 inorder
to accomodate an office building.
Members of the audience made various presentations indicating
their concerns and then submitted a notarized petition containing 27
names indicating their disapproval of the proposed project.
On hearing all the information presented a motion was made by Commissioner
Reuter, seconded by Commissioner Volker to recommend the application be
denied because of the following: I. It does not comply with the general
requirements of the comprehensive plan in terms of location of commercial
districts, 2. It represents the start of a strip commercial development
occuring along State Trunk Highway 55 which is deemed to be inconsistent
with sound planning principals. 3. The property in question will have
limited access when Trunk Highway 55 upgrading occurs in 1987, 4. Such
zoning could have a negative impact on existing residential development
that is located adjacent to the proposed site. Ayes, 9; Nayes, O.
Motion by Commissioner Ditty, seconded by Commissioner Folch to adjourn°
Motion carried unanimously. Meeting adjourned at 9:45 pom.
