MONDAY JULY 29, 1985
The meeting was called to order by Chairman Simacek at 7:30 p.m.
Members Present: Commissioners Stevens, Reuter, Folch, Kaiser, Voelker
and Chairman Simacek
Members Absent: Co~nnissioners Ditty, Conzemius and Anderson
Moved by Commissioner Folch and seconded by Commissioner Reuter
to approve the minutes of July 8, 1985 subject to the amendment
that Commissioner Reuter rather than Commissioner Folch seconded
the adjournment of the meeting. Ayes, 6; Nayes, None.
Planner Loucks noted that the applicant is requesting a variance
to install a sign 32' above the highest building located on their
property. The zoning ordinance requires a free standing pylon sign
be no greater than 6' higher than the roof line of the highest
building on the site. Therefore the applicant is requesting a
26' height variance because their property is so located that a
sign that meets the ordinance requirements could not be seen from
Highway 61.
Following areview of all the facts relating to the matter a motion
was made by Commissioner Stevens and seconded by Commissioner
Kaiser to recommend approval of a 26' height variamce subject to
the condition that the pylon signs are located in the area as
demonstrated on the sketch attached to the Planners staff report.

Planner Loucks noted that the applicant is requesting a rezoning
of Lot 9 of Olson's Addition in order to accommodate a cemetary
use. Cemetaries are permitted uses in the agricultural zone.
Following a review of the matter a motion was made by Commissioner
Voelker and seconded by Commissioner Kaiser to recommend approval
of the rezoning request from R2 to the agricultural zone.

Planner Loucks noted that the property in question is zoned R2
and the applicant is requesting a division in order to accomodate
placement of a duplex on lot 1, block 1 of Cannon Estates Second
Addition. It was noted that the proposed division meets all the
requirements of the subdivision regulations.
Planner Loucks also noted that the applicant had submitted a
revised site plan demonstra~ng that the duplex could be properly
placed on the site and would not require any variances.
Following review and discussion of the site plan matter the motion
was made by Commissioner Stevens and seconded by Cormnissioner Folch
to approve the revised site plan as submitted. Ayes, 6; Nayes, None.
Motion was made by Commissioner Folch and seconded by Commissioner
Reuter to recommend approval of the preliminary plat. Ayes, 6; Nayes, 0.

¥1anner Loucks noted that the applicant is requesting a 3~ sideyard
variance to accomodate an addition to an existing garage and anothe~
addition that would accomodate a 3 season porch.
The zoning regulation requires 7 feet on the sideyard where there
is an attached garage. Detached garages may be located within 4
feet of the side lot line provided such garages are located within
the required minimum rear yard setback.
It was further noted by Planner Loucks that the previous variance
request have been granted for detached residential garages but the
overall policy of the city has been to require property owners to
maintain a minimum of a 7 foot setback for habitable space as is
being proposed with the 3 season porch.
Following review and discussion by the Planning Commission regarding
sideyard setback requirements a motion was made by Commissioner
Stevens and seconded by Commissioner Kaiser to table consideration of
this matter in order to allow the opportunity to consider changes in
sideyard setback requirements and review previous presedences that
may have been set in regard to sideyard variances. Ayes, 6; Nayes, 0.
Planner Loucks noted that the applicant is requesting a 4 foot
sideyard variance in order to allow completion of a deck that
would be located 3 feet from their side property line. It was
further noted the Planner is not totally convinced based upon an
on site inspection that the deck is actually located 3 feet from
the side property line and it is recommended that the applicant should
provide some evidence as to where the actual property line
is located.
Following a brief discussion with the applicant and requesting that
further information be provided a motion was made by Commissioner
Folch and seconded by Commissioner Kaiser that the application be
tabled until such time as more detailed information is available.

Planner Loucks noted that on February 25, 1985 the Planning Commission
approved Siebens Second Addition Preliminary Plat and a rezoning
to PRD R3 subject to the conditions that lots 1 & 2 of block 1 and
lots 7 & 9 of block 2 be designated as duplex lots and lot I of
block 3 be designated as a four-plex lot with the remaining parcels
to be designated as single family lots.
On July 8, 1985 the Planning Commission reviewed the final plat
proposal and observed that the number of lots in block 1 and block
2 had increased and due to the fact that Mr. Sieben was not present
at the meeting made a motion to table the application.
Planner Loucks noted that the staff had once again reviewed the
final plat and found it to be consistent with that which was submitted
at the time of preliminary plat approval.

Following a brief discussion and review of the final plat a motion
was made by C0mmisi0ner F01ch and seconded by Commissioner Reuter
to recommend approval of the final plat subject to the condition that
lots 2 & 3, block i and lots 7 & 8 and 11 & 12 of block 2 be designated
as duplex lots and that lots 1 & 2 of block 3 are designated to
accomodate four plexes and that the remaining parcels (13) shall be
utilized for single family purposes. Ayes, 6; Nayes, 0.
Planner Loucks noted that the Planning Commission and City Council
previously approved a rezoning from agriculture to R3 and a
preliminary plat for a 177 unit development to be located in the
vicinity of 160th Street and Cory Lane.
At the present time the applicant is requesting a division of two
parcels that are approximately 1.2 acres in size each. The parcels
being requested for division are intended to accomodate two 16 unit
multi-family dwellings which are to be part of phase I of the
previously approved project. Following a review of the facts a
motion was made by Commissioner Folch and seconded by Commissioner
Kaiser to recommend approval of the Hastings Construction Final Plat.

Planner Loucks noted that the applicant is requesting a 3 foot side-
yard variance in order to accomodate construction of a carport which
would be attached to an existing garage located on the site. It
is the intent of the applicant to build a carport up to the limits
of the property line.
Following a review of the matter a motion was made by Commissioner
Stevens and seconded by Commissioner Kaiser to recommend denial of
the variance because of the lack of sufficient merit and to further
recommend that the applicant maintain a 30 inch setback which is the
minimum requirement in the R2 district. Ayes, 6; Nayes, 0o
Planner Loucks noted that the Planning Commission and the City Council
had previously reviewed and approved a rezoning to RI and a
preliminary plat approval for the subject property.
It was noted that it is the desire of the applicant at this time to
divide off lot 1, block 1 that was previously described in the
preliminary plat in order to allow them the opportunity to convey
4 acres of land to a church.
Commissioner Voelker questioned the advisability of approving the
final plat because in her opinion there are transportation problems
in the area of 4th Street and Pleasant Avenue.
Following further discussion a motion was made by Commissioner Stevens
and seconded by Commissioner Folch to approve the final plat as submitted.

Planner Loucks noted the Planning staff has reviewed the density
requirements in the R3 district and recommended that they be
revised from 3,1OO square feet per unit to 5,000 square feet
per unit, thus allowing the maximum density of 8.7 units per acre.
The R 4 district should be raised from 2,500 square feet per unit
to 3,000 square feet per unit thus allowing a maximum allowable
density of 14.5 units per acre. It was further noted that the
parking requirements for an office use are 1 space per each 1OO
square feet of floor area and that this is a very restrictive
policy because the amount of lot coverage required and the ratio
of people to parking spaces that are actually utilized in an
office use zoning district classification. Therefore it was recommended
that the ordinance requirement be modified to include 1 space for
each 150 square feet of floor area.
A brief discussion followed and it was the general concensus of the
commission that the R3 & R4 zoning district should be modified to
reflect the intent of the comprehensive plan relative to spreading
of densit~ but that there was a concern regarding modifying the
parking requirements in the office building use category.

Motion was made by Commissioner Stevens and seconded by Commissioner
Kaiser to recommend that the R3 zoning district requirements be
amended from 3,100 square feet per unit to 5,000 square feet per unit.

Motion was made by Commissioner Stevens and seconded by Commissioner
Kaiser to recommend that the R4 zoning district be modified from
2,500 square feet per unit to 3,000 square feet per unit. Ayes, 6; Nayes 0.
Motion was made by Commissioner Folch and seconded by Commissioner
Stevens to table the matter for further study regarding parking
requirements in the office building district. Ayes, 6; Nayes, O.
Chairman Simacek then appointed Commissioners Folch, Kaiser and
Voelker to study the matter relative to parking requirements in
commercial zone and report to the commission at the next meeting.
Planner Loucks noted that Paul Swanstrom had informed him earlier
in the day they had come to a compromise in regard to his property
division at 603 W. 3rd Street and it appeared that the next door
neighbor was going to purchase half the lot and that the remaining
portion of the property would be attached to the parcel where the
triplex conversion is proposed to be located.
