HomeMy WebLinkAbout08/26/85MINUTES OF THE HASTINGS PLANNING ~SSION MONDAY, AUGUST 26, 1985 The meeting was called to order by Chairman Simacek at 7:30 p.m. Members Present: Commissioners Stevens, Reuter, Folch, Kaiser, Conze~mius Anderson, Voelker and Chairman Simacek Members Absent: Co~missioner Ditty Moved by Cor~missioner Anderson, seconded by Cc~nissioner Reuter to approve the minutes of August 12, 1985. Ayes, 8; Nayes, 0. Planner Loucks noted that the applicant is requesting a home occupation permit to package computer software. His understanding of the product that the applicant has developed a computer program and that a booklet and computer disk will be packaged on a mail order basis to be sent to various purchasers. It was noted that it is anticipated that there will be no visitors to the home for business purposes. Following a brief discussion a motion was made by Commissioner Conzemius, seconded by Con~issioner Anderson to approve a home occupation permit to expire on December 1, 1985 because the application complied with the following criteria: 1) Not more than 25% of the gross floor area including the basement of the residence can be used for this purpose. 2) Only articles made or originating on the premises shall be sold on the premises unless such articles are incidental to a permitted cc~nercial service; 3) No article for sale shall be displayed so as to be visible from any street. 4) No mechanical or electrical equipment is used if the operation of such equipment interfers with the residential environment of the neighborhood. Planner Loucks noted that the con, mission had been discussing various methods to exercise greater control over developers in regard to the impl~nentation of their site plan improvements. The conmission reviewed a draft ordinance and recommended approval of the following: TERRY A. FRANTZ HOME OCCUPATION PERMIT-522 W. 5th SITE AND BUILDING PLAN APPROVAL PROCEDURE- RECON~MENDED ORDINANCE REVISION Section 10.24 Site Building Revi Pr edure. Every person, k f0re cc~nen¢ing construction or major alternations of a structure, except one and two family dwellings and buildings accessory thereto, shall su~nit to the Zoning Administrator the following documents and information. Subdivision 1. Survey drawing by a registered Engineer or Land Surveyor showing pertinent existing conditions, that is accurately dimensioned. Subdivision 2. A cor~lete set of preliminary drawings prepared by an architect, landscape architect, engineer, planner or land surveyor showing the following: Subdivision a. - An accurately scaled and dimensioned site plan indicating parking layout including access provisions, designation and locations of principle and accessory buildings, landscaping, including trees and shrubbery with an indication of species, planting size and location. Subdivision b. - Fences, walls or other screening, including height and type of material. Subdivision c. - lighting provisions, type and location. Subdivision d. - curbs Subdivision e. - Building elevations, floor plans, sections and outline information, including materials proposed. Subdivision f. - Existing and proposed land elevations, drainage provisions, and drainage provisions as may be required, Subdivision g. - Location & elevation of water & sewer connections. Subdivision h. - Location of existing and proposed fire hydrants and a fire protection system plan. Subdivision i. - Complete plans for storage of waste & garbage. Subdivision 3. The Zoning Administrator shall review said site and building plans for the purpose of determining their compliance with this ordinance and other applicable city ordinances. The Zoning Administrator shall forward the information to the Planning Conntission for review and recon~nendation. The City Council shall review said site plans and make a final determination for approval or denial. Subdivision 4 - Based upon an approved site plan the City Engineer shall make a determination as to the amount of cost for site improvements (ie. earthwork, sewer and water extensions, storm sewer, paving, curbing, lighting, landscaping,etc.) The developer (ie applicant) will provide to the City a performance bond or cash escrow in the amount of 125% of the estimated site improvement cost. No building permit shall be issued until such time as the performance bond or cash escrow is deposited with the city. Planner Locuks noted that the City Council had tabled a second reading of the proposed revisions to the R3 and R4 zoning districts in order to give the planning comnission an opportunity to review potential of creating an R5 higher density residential zone. He noted that this matter has been reviewed by staff and suggested that an R5 district be established in accordance with the following guidelines: ORDINANCE AMEND- MENT R5 ZONING DISTRICT Intent - to establish a high density multi-family residential develop- ment and building and structures that are 4 or more stories in height. The square footage lot area requirements will be 2,000 square feet thus the density in the R5 district would be approximately 21.8 units per acre. Following discussion with members of the Planning Co~/ssion a motion was made by Co~nissioner Stevens and seconded by Commissioner Folch to recca~nend adoption of an R5 zoning district. Ayes, 6: Nayes, Co~nissioner Voelker and Co~nissioner Reuter. Commissioners Folch and Conzemius reported that they had met with mgmbers of the committee frc~ the school district and City Council and staff to discuss the district desire to rezone a portion of their land located on Pleasant and Highway 55 to co~nercial use and further discuss the matter of the City securing an easement for watermain across their property. They essentially concluded that negotiations are underway and that they will meet again with school district officials on Septenlber the 5th. C06IMITTEE REPORT BY CO6~4ISSIONERS FOLCH AND CONZt~4IUS Mr. Edward H. Johnson of 1701 Spring Street requested that the Planning Commission review his application for a 6'6" front yard setback variance which would allow him to build an extra room on his house. Planner Loucks noted that the item was not on the Agenda because there was insufficient time to provide notice to adjacent property owners and that the matter will be placed on the Planning ~ssion agenda on September 10, 1985.
