HomeMy WebLinkAbout01/12/87HASTINGS PLANNING COMMISSION Monday, January 12, 1987 The regular meeting of the Hastings Planning Commission was cai led to order at 7:30 p.m. Members Present: Commissioners Stevens, Dredge, Kaiser, Conzemius, Voetker, D±tty Anderson, and Chairman Simacek. Members Absent: Commissioner Folch Staff Present: Planning Director Harmening. Commissioner Kaiser moved, seconded by Commissioner Dredge, to approve the December 22, 1986 Planning Commission minutes. Upon vote taken, Ayes, 8; Nayes, O. MINUTES Planning Director Harmening informed the Planning Commission that the applicant is requesting a rezoning from agricultural to R-1 PRD, preliminary plat approval, and a variance to the city's subdivision design criteria (length of cul-de-sacs) such that 62 residential units may be located on 20.935 acres of land. The plat is proposed to be called Dakota View Ist Addition. Harmening noted that although the developer proposes that all lots within the development be of a size which meets R-1 single family criteria, the Developer is requesting that the proposal be viewed under a planned residential development concept such that 16 of the homes may have zero lot lines and common walls. Therefore, the proposed development consists of 46 detached single family homes and 16 single family homes with zero lot lines and common walls. Harmening passed out pictures of the types of ~inhomes proposed for the development. Harmening also reviewed other matters with the Planning Commission which included development densities, Comprehensive Plan criteria, park land dedication requirements, municipal improvements, sidewalks and walkways, grading, interceptor sewer charges, and the proposed street and lot layouts. Harmening noted that the item of most concern to staff pertained to the length of the cul-de-sacs and the proposed double fronted tots along 15th Street. Harmening discussed these matters in length and provided alternate street layouts which would resolve the concerns pertaining to the length of the cul-de-sacs and double fronted lots. Harmening indicated that with the exception of the concern for the cul-de-sace lengths, the double fronted lots, and miscellaneous matters pertaining to walkways within the development, it would appear that staff finds no major objections to the proposal and would generally recommend approval subject to certain conditions which Harmening outlined. PUBLIC HEARING- PRELIMINARY ~_AT- REZONING, DAKOTA VIEW 1ST ADDN. HASTINGS CONST. Chairman Simacek opened the public hearing at 7:40 p.m. Persons in attendance to discuss this matter included: Brooks Swanson and Cory Gustafson, representing the Developer, were in attendance and generally discussed the proposed development. Swanson & Gustafson also reviewed the comments made by Harmening with regard to the street layouts and presented their viewpoints and concerns regarding the proposed alternates. Swanson and Gustafson indicated that by making Pringle Court a through street from Tierney ~rive to 15th Street the intended quite residential environment would not exist. In addition, Swanson & ~ustafson indicated that by allowing the Pringle Court cul-de-sac to be developed as proposed no lots would be required to front directly onto 15th Street which was In their opinion favorable due to the fact that 15th Street was a collector street. Swanson also indicated that a walkway to the Ponding Basin was acceptable to the Developer but the Developer was not amenable to constructing walkways from the cul-de-sacs to 15th Street. There being no further comments from the audience the Chairman closed the Public Hearing at 7:50 p.m. The Planning Commission discussed in length with city staff and the Developer the concerns pertaining to the cul-de-sac lenghts. Generally speaking the Planning Commission found that with the exception of the concerns for the cul-de-sac length the Planning Commission found no major objection to the proposal. After considerable discussion a motion was made by C~mmissioner Stevens, seconded by Commissioner Kaiser, to recommend denial of the Preliminary Plat/Rezoning and variance request due to the staffs concerns for the excessive lengths of the Pringle Court cul-de-sac and due to the fact that the applicant had not demonstrated that the criteria for the granting of the variance had been met. However, due to the somewhat unique circumstances of the variance request due to the proximity of the Pringle Court cul-de-sac to 15th Street, the Planning Commission would submit that if staff, and in particular the Fire Department Staff, and the Developer could agree on measures which would reduce or eliminate the staff concerns for the cul-de-sac length, that the Planning Commission would not have further objections to the proposed preliminary plat, rezoning and variance request. Possible measures to reduce or eliminate staff concerns could include the extension of a water main and fire hydrant from the Pringle Court cul-de-sac to 15th Street and the installation of a small access drive from 15th Street to Pringle Court. Furthermore, if an acceptable resolution to the cul-de-sac concerns can be achieved the Planning Commission would further recommend adoption of the conditions for approval as suggested by the City Planner. The Planning Commission also desires to go on record of informing the ~eveloper that to insure proper accessibility into the plat, Erickson Drive should be improved to at least an acceptable gravel condition. Upon vote taken, Ayes, 7; Nayes, Commissioner Voelker. Commissioner Folch was in attendance at the meeting at this time. Planning Director Harmening refreshed the Planning Commissions memory regarding the committee of the Planning Commission which studied parking requirements for office and retail uses. In this case the committee recommended that the Planning Commission consider amending the zoning ordinance to require parking at a ratio of 1 space per t75 square feet of gross floor area for office buildings and 1 space per 200 square feet of gross floor area for retail buildings. PUBLIC HEARING PARKING REQUIRE- MENTS FOR OFFICE AND RETAIL USES The Chairman opened the public hearing at 8:30 p.m. Persons in attendance to discuss this matter included: Brooks Swanson. Swanson indicated that he was generally in favor of the proposed amendment and was particularly pleased with the fact that the calculation of parking was being changed from a net floor area calculation to a gross floor area method. There being no further cemments from the audience the Chairman closed the public hearing at 8:35 p.m. After considerable discussion by the Planning Cemmission a ~tion was made by Commissioner Ditty, seconded by Commissioner Conzemius, to adopt the recommendatlon made by the committee and submit the proposal to the City Council. Upon vote taken, Ayes, Commissioners Ditty, Stevens, Conzemius, and Simacek; Nayes, Commissioner Dredge, Fotch, Kaiser, Anderson, and Voelker. The motion was not approved. After further discussion a motion was made by Commissioner Dredge, seconded by Commissioner Kaiser, to table the matter for further study. Upon vote taken, Ayes, Commissioners Dredge, Folch, Kaiser, Anderson, Voelker, and Chairman Simacek; Nayes, Commissioner Ditty, Stevens and Conzemius. The motion to table was declared approved. Harmening noted that Doffing was requesting a home occupation permit to allow him to allow a business and tax consulting service in his home at 118 Farm Street. Harmening generally reviewed with the Planning Commission the contents of Doffings application. Doffing indicated that he did have an assistant who worked from her home in Hampton. After discussion a motion was made by Commissioner Ditty, seconded by Commissioner Conzemius, to recommend approval of the home occupation permit subject to Doffing complying with all standards pertaining to home occupations. Specifically, Doffing is to comply with the home occupation standard which allows only persons residing on the premises to be engaged in the home occupation. Upon vote taken, Ayes, 9; Nayes, O. Harmening indicated that Foster was requesting a home occupation permit to allow her to operate a beauty shop in her home at 603 W. 5th Street. Harmening reviewed with the Planning Commission the contents of Fosters application. Harmening also noted that the general lack of available off street parking did present concerns to staff. Furthermore, upon personally viewing the property it appeared that the most easily accessible entrance to the home which would accomodate the beauty shop customers faced Maple Street which was served by a sidewalk extending from the entrance to the home to Maple Street. After discussion a motion was made by Commissioner Folch, seconded by Commissioner Ditty, to recommend approval of the home occupation permit subject to Foster complying with HOME OCCUPATION F~41T-BUSINESS & TAX CONSULTANT- OAVE DOFFING, 115 FARM STREET HOME OCCUPATION PERMIT-BEAUTY SHOP-RACHAEL FOSTER,603 W. 51]4 STREET all standards pertaining to home occupations. Specifically, Foster must ensure that no on street parking takes place as a result of the home occupation activity. If Foster cannot comply with the parking standards or any other home occupation standard the city reserves the right to suspend or revoke Fosters home occupation permit. Also, as per the Hastings Fire Department, an on site inspection of the premises must take place per Health Department requirements. Furthermore, Foster must enlarge the driveway to accomodate an additional car as soon as weather permits in the Spring of 1987. Upon vote taken, Ayes, 9; Nayes, O. Planning Director Harmening reviewed the 7th draft of the proposed Manufactured Home Park Ordinance. Harmening discussed with the Planning Commission possible language to be ~nserted in the ordinance which would deal with non conformities created by the proposed ordinance. In this case the Planning Cemmission discussed specifically the language which should be used to handle the Willis Olson mobile home park situation. After discussion a motion was made by Commissioner Stevens, seconded by Commissioner Conzemius, to table this matter such that the Planning Commission could think about alternatives and at the same time allow Harmening to discuss the matter with Willis Olson. Upon vote taken, Ayes, 9; Nayes, O. Planning Director Harmening discussed with the Planning Ccmmission potential zoning and land use designations for the annexation area between Trunk Highway 316 & 61. The Planning Commission directed Harmening to determine how much commercial land was available in Hastings and report back to the Planning Commission. No further action was taken. Planning Director Harmening informed the Planning Commission that the City Councilman had requested the the Planning Commission discuss a possible ordinance to control garage sales. The Planning Ccmmission requested that Harmening obtain information from the League of Minnesota Cities to determine how other cities were controlling this type of problem. No further action was taken. Harmening updated the Planning Commission on recent actions taken by the City Council. There being no further business a motion was made by Commissioner Folch, seconded by Commissioner Kaiser to adjourn the meeting at 9:45 p.m. Upon vote taken, Ayes, 9; Nayes,O.
