Members Present: Commissioner Ditty, Dredge, Kaiser, Conzemius, Anderson, Voelker, and Chairman Simacek. Members Absent: Commissioner Stevens and Folch. Staff Present: Planning Director Harmening A motion was made by Commissioner Kaiser, seconded by Commissioner Anderson, to approve the May 11, 187 Planning Commission minutes. Upon vote taken, Ayes, 7; Nayes, O. MINUTES The Chairman opened the public hearing at 7:34 p.m. Planning Director Harmening briefly reviewed the proposal made by Siewert Construction. In this case Siewert Construction and four property owners are requesting approval of a preliminary/final plat which would replat Lots 5,6,7 & 8, Block 4 of Highland Hills Second Addition. The purpose of the replatting is to add a strip of property approximately 36 feet wide to the rear of the lots in question. This replatting would result in "squaring off" of the existing plat. Harmening noted that the applicants were also requesting that the city vacate utility and drainage easements which were originally conveyed within the Highland Hills 2nd Addition Plat. With the proposed new platting the existing rear drainage and utility easements would be located almost in the middle of the new lots. Harmening noted that the Council would be conducting a public hearing on the utility and drainage easement question at its next meeting on June 15, 1987. Harmening also noted that he had not yet had a chance to review a drawing of the final plat but had only received a preliminary plat drawing. Comments received from the audience included: PUBL lC HEAR lNG- PRELIMINARY/FINAL PLAT- HIGHLAND HILLS 4TH ~r)DN S I EWERT CONSTRUCT ION Sheldon Fox, First Baptist Church - Mr. Fox indicated that he represented the 9aptist Church and that the property in question was being purchased from the Baptist Church. Mr. Fox indicated general approval of the proposed platting action. There being ne further comments from the audience the Chairman closed the public hearing at 7:40 p.m. After discussion a motion was made by Commissioner Ditty, seconded by Commissioner Kaiser, to recommend approval of the preliminary/final plat and utility easement vacation conditioned upon the city receiving a copy of the proposed final plat prior to the next City Council meeting. The proposed final plat should not substantially deviate from the preliminary plat which was reviewed by the Planning Commission. Upon vote taken, Ayes, 7; Nayes, O. Harmening informed Todd Siewert, representing Siewert Construction, that the city would need to receive a copy of the proposed final plat by Wednesday, June 10, 1987 to insure that the proposed platting action would be placed on the Council agenda of June 15, 1987. Planning girecfor Harmenin informed the Planning Commission that pursuan± to the Development Agreement for ~illiams First Addition Lots I & 2, ~lock 2 have been identified for the development of two duplex structures. HarmenJng noted that the city has been requested to chdnge this status to 811ow t~0 single family homes to be construeted rather than the duplexes. HODIFY DEVELOP~,ENT PLAN FOR LOTS 1 & 2, BLOCK 2-DUPLEX LOTS TO SINGLE FAMILY LOTS- HIKE WILLIA~ Harmening discussed the general overall development plan for the entire Williams Ist Addition project and discussed matters pertaining to the use of duplexes as buffers. Harmening expressed some concerns regarding the placement of single family homes directly adjacent to multi family development which would be the case under the current proposal. Suggestions Harmening made to alleviate these concerns included: A. The installation of berming, tree plantings and other screening devices on the multi family lot adjacent to the single family homes. Harmening noted that this item should be taken into consideration at the time of site plan approval for the multi family project. B. Build the proposed home on Lot 2, Block 2 such that it faces south towards Crestview Drive rather than west towards the multi family development. Harmening also noted that concerns regarding the impact of the multi family development on the single family homes should be alleviated due to the fact that any person buying a lot within Williams Ist Addition would be made aware of the fact that a multi family development would possibly be built due to the recording of the Development Agreement against all of the lots in the plat. Mr. & Mrs. Ray Solac were in attendance and expressed general approval of the proposed development change. After discussion a motion was made by Commissioner Conzemius, seconded by Commissioner Voelker, to recommend approval of the change in the development plan subject to the consideration of the following suggestions and that the Development Agreement be amended to take into consideration the proposed change in usage. The suggestions included: A. Installation of berming, tree plantings and other screening devices on the multi family lot adjacent to the single family homes. Build the proposed home on Lot 2, Bt ock 1 such that it faces south towards Crestview grive rather than west towards the multi family development. Upon vote taken, Ayes, 7; Nayes, O. Harmening informed the Planning Commission that the City Council recently expressed concerns pertaining to the issuance of home occupation permits as related to the effect on the commercial and residential districts in the city. A concern which was expressed pertained to a feeling that rather than providing an incubator system which would feed and supplement our commercial areas the opposite may be occurring. Harmening noted that the Council requested that the Planning Commission take another look at the city's home occupation situation from several perspectives which included: HOME OCCUPATIONS - ESTABLISHMENTS OF STUr)y COMMI TTEE A. The philosophy of home occupations in general. B. Standards with respect to limiting the number of overall home occupations or the number of certain types of home occupations or a standard which would only allow certain types of home occupations within the city. Chairman Simacek appointed a committee of Commissioner Kaiser, Conzemius and Simacek to study the home occupation question as raised by the Council. No further action was taken. Planning Director Harmening updated the Planning Ccmmission on the Metro East Development Partnership. UPDATES AND OTHER BUSINESS Planning Director Harmening updated the Planning Ccmmission on recent City Council actions. There being no further business a motion was made by Commissioner Conzemius, seconded by Conmissioner Voelker, to adjourn the meeting at 8:00 p.m. Upon vote taken, Ayes, 7; Nayes, O. ADJOURNMENT
