~ r~oular .~]aating of the Hastings Planning Commission was called to order at 7:30 p.m.
Members Present: Commissioners Ditty, Stevens, Dredge, Folch, Kaiser,
Conzemius, Anderson, Voelker
Members Absent: Commissioner Simacek

A motion was made by Commissioner Kaiser, seconded by Commissioner
Anderson to approve the July 13, 1987 Planning Cc~mission minutes.
Upon vote taken, Ayes 8; Nayes, O.
MINUTES
Acting Chairman Folch opened the public hearing at 7:35 p.m.
Planning Director Harmening indicated that Mr. Ken Grund was
requesting a rezoning from A§ to R-6 for the land lying west of
the existing Three Rivers Mobile Home Park. The proposed
development is to take place on 1t.26 acres and consist of 45
home sites. Harmening gave a brief over view of the development
that has taken place thus far. Harmening described the
development that is proposed to take place.

Comments which were received from the audience included:
Ken Hooper - Mr. Hooper indicated that the persons with single
family homes in the area thought that the proposed site was
going to be used as a buffer. He also stated that they were
lead to believe that no mobile homes would be located on the
proposed development. Mr. Hooper also stated that a real
estate appraiser commented to him that the mobile homes were
causing a problem selling his house.
Denise Kennan - ~4s. Kennan indicated that she was involved
in the initial development work with Mr. Grund. She stated that the
concerns of the residents in the area were made in writing.
She then indicated that several of the concerns were not
addressed or were changed. Mrs. Keenan also brought up the
point that Mr. Grund was phase jumping. Other concerns brought
up by Ms. Keenan include: The residents were lead to believe
that apartments or condominiums were to be built on the land
and concern was expressed over the capacity of the ponding
basin.
Kevin Keenan - Mr. Keenan expressed concern about the volume
and speed of the traffic in the area. Mr. Keenan felt that the
development would increase this problem. Mr. Keenan also
indicated that he was under the impression that no more
development would take place until an access was achieved
on Hwy 316.
Dick Young - l,lr. Young indicated that he would prefer a different
form of development. Mr. Young also expressed concern about the
traffic problem.
Stacy Robinson - Ms. Robinson, a resident of Three Rivers,
commented that Mr. Grund is not maintaining the current
development. She questioned Mr. Grunds ability to handle more units.
Pat Mathison - Ms. Mathison echoed !4s. Robinsons comments adding
that the storm shelter is not designated and stating that she has
difficulty in contacting Mr. Grund.
Klm Gelhar ~ ?As. Gelhar commented that there is a traffic problem
in the park. She stated that non-residents do not observe the
10 mph limit.
Ken Grund - Mr. Grund commented on the changes to the original
requests made by the Malcolm Avenue residents. The changes that
were made which were approved by the City Council included:
1) Allowing vinyl siding
2) Curb style changed
3) Office building moved
4) Fewer double wides than original concept plan.
There being no further comments from the audience Acting Chairman
Folch closed the public hearing at 8:40 p.m.
Members of the Planning Commission thin questioned Mr. Grund as to
why Phase III was not completed prior to the proposed develop~t.
Mr. Grund explained that it was because of economic reasons.
Commissioner Voelker also raised the question about storm shelters.
Planning Director Harmening explained the regulations pertaining to
shelters. Commissioner Conzemius questioned Mr. Grund about the
Hwy 316 access, htr. Grund explained that the land holders were not
willing to make a commitment at this time. Commissioner Kaiser
remarked on the three accesses onto 160th St. and the proposed fire exit onto
Malcolm Avenue. Kaiser questioned the safety of the area in the event of
an emergency.
After discussion was completed, a motion to deny the rezoning was
made by Cammissioner Kaiser and seconded by Commissioner Anderson.
The motion for denial was based on the following reasons:
1) The proposed rezoning violates the phasing plan
2) The proposed rezoning violates the buffering plan
3) The proposed rezoning would present a safety hazard
for regular and emergency vehicle traffic for
both Malcolm Ave.& the Three Rivers Development
Upon vote taken, Ayes 7, Nayes, Commissioner Stevens.
Acfing Chairman F01ch opened the public hearing at 8:50 p.m.
Planning Director Harmening indicated that Hastings Construction
is requesting the replatting of a portion of the Dakota View
First Addition. The proposed replat is located at the Pringle
Court Cul-de-Sac. Harmening indicated that the proposed
development calls for 22 homes at 4 units/acre. Harmening
stated that this development appears to comply with the Compret~ensive
Plan. There being no comments from the audience the public
hearing was closed at 8:55 p.m.
After discussion a motion was made by Commissioner Conze~ius
seconded by Kaiser, to approve the preliminary plat as it is
consistent with the goals and objectives of the Comprehensive
Plan and the R-1 PRD zoning requirements. Approval is subject
to the following:
Preparation of a final grading plan which is consistent
with the original grading plan particularly with respect
to the berm along 15th Street.
B. Rat the four lots at the end of the cul-de-sac have a
minimum lot width of 75 feet at the front setback line.
C. Payment of $900 for interceptor sewer charges.
D. That an amendment be made to the original development
agreement to take into consideration the changes proposed.
Planning Director Harmening indicated to the Planning Commission
that the City Council has not yet taken action on Mrs. Maurus'
Home Occupation. The Council requested that the Planning
Commission review the case. Mrs. Maurus was in attendance to
explain her situation. Maurus indicated the operation was
started approximately 15 years ago in her basement. Since that
time the operation has moved into the garage. Maurus indicated
that the garage is completely weatherized and heated. Commissioner
Dredge questioned if the area is still classified as a garage.
Harmening indicated that the area would still be considered
a garage. The Planning Commission than discussed the possibility
of implementing a Speclal Review Process. Commissioner Dredge
made a motion to table the home occupation permit. Dredge stated
that she would like the Home Occupation Committee to study the
feasibility of implementing a Special Review Process. A
recommendation would be presented at the August lOth ,meeting.
Commissioner Voelker seconded the motion. Upon vote taken,
Ayes, 8; Nayes, O.
Planning Director Harmening indicated that Ms. Kramer was
requesting a Home Occupation Permit to allow her to operate an
electrolysis and hair removal business at 1720 Louis Lane. The
applicant stated that she anticipates 10 to 15 people per week.
The average stay of each visit would be approximately 15 minutes.
Kramar explained that there will be no overlapping of customers.
According to Kramers application, the operation is to take place
in a room to the rear of the garage, it was determined that this
room is not part of the garage. Harmening indicated that the
business appears to meet all of the home occupation standards.

After discussion was completed, Comm|ssioner Conzemius made
a motion to approve the Home Occuptlon Permit. Commissioner
Kaiser seconded the motion. Upon vote taken, Ayes, 8; Nayes,O.
Planning Director Harmening indicated that Lyle Cater was
requesting that the Planning Commission order a public hearing
to consider a minor subdivision in Country Estates. The proposed
minor subdivision is located on property described as Lot 7,
Block 1, Country Estates. Commissioner Voelker expressed concern
about the location of the driveway and easements.

After discussion a motion was made by Commissioner Conzemius,
seconded by Kaiser, to order the required public hearing on
the proposed minor subdivision. The hearing is to be held at
7:30 p.m. on August loth. Upon vote taken, Ayes, 8; Nayes,O.
Planning Director Harmening indicated that Jerry Denn was
requesting that the Planning Ccmmission order a public
hearing to consider a minor subdivision in Addition No. 13.
The proposed minor subdivision is located on the property
described as Lots 1 & 2, 10 & 11, and parts of Lots 3 & 12,
Block 7, Addition No. 13.

After discussion a motion was made by Commissioner Kaiser,
seconded by Voelker to order the required public hearing
on the proposed minor subdivision. The hearing is to be
held at 7:30 p.m. on August lOth. Upon vote taken, Ayes,8~
Nayes, O.
Planning Director Harmening updated the Planning Commission
on several topics. Harmening indicated that the Murtaugh
variance and the Nilli~ms vacation were approved by the City Council.
Harmening also informed the Coamission about the ordinance
interpretation for Mr. McNamara. The Commission was
also informed of the pending a¢inistrative decision for
Mr. Siebenaler.
There being no further business a motion was made by
Ccmmissioner Conzemius, seconded by Ccmmissioner Kaiser to
adjourn the meeting at 9:30 p.m. Upon vote taken, Ayes,8;
Nayes, O.
