HomeMy WebLinkAbout01/11/88HASTINGS PLANNING COM~4ISSIO}~ January 11, 1988 The regular meeting of the Hastings Planning Commission was called to order at 7:30 p.m. Members Present: Commissioners Dredge, Folch, Kaiser, Anderson Voelker, and Chairman Simacek Members Absent: Commissioners Ditty and Conzemius A motion was made by Commissioner Kaiser, seconded by Commissioner Folch to approve the December 28, 1987 Planning Commission minutes. Upon vote taken, Ayes, 7; Nay,s, 0. M INUT ES Planning Director ttarmening indicated that in the Spring of 1985 the city granted Ken Grund a variance to allow ten model manufactured homes to be placed in the Three Rivers Mobilehome Park subject to only one of the units being allowed to be used as a sales office. Also, in the Development Agreement between Grund and the city a stipulation was made that there may be ten manufactured home sites within the proposed development. Pursuant to the aforementioned action taken by the city, one sales office has been operating out of the park along with model homes. Marathon Mobilehome Sales (Ken Grund) is n~ requesting approval of a Special Use Permit to allow it to undertake manufactured home sales in the Three Rivers Mobilehome Park. The sales office is ~ro~ ~ ~ located in the Three Rivers Office/Storm Shelter building located at 1 Shannon Drive. The applicant would also desire to place model manufactured homes in the park as well. PUBLIC HEARING- SPECIAL USE PE~4IT- MANUFACTURED HOME S ALE S -MARA THO N MOB ILEHO~E SALES Chairman Simacek opened the public hearing at 7:34 p.m. There being no comments from the audience, the public hearing was closed at 7:35 p.m. After discussion, a motion was made by Commissioner Anderson, seconded by Commissioner Kaiser to recc~nmend approval of a special use permit to allow the applicant to operate a sales office at 1 Shannon Drive and to place model manufactured homes on lots in the Three Rivers Mobile Home Park subject to the following conditions: The the applicant comply with the requirements of Section 10.07, Subdivision 2 of the City Code (Manufactured Home Park Regulations). Be That in combination with the other sales office/model which currently exists there shall not be more than 10 model home sites in the Three Rivers Mobile Home Park. That the applicant not install lighting, flags or other items on the models or office which would not normally be found in a residential area. Wall signs identifying the models and the company involved are allowed. Upon vote taken, Ayes, 5; Nayes, Commissioner Voelker. Planning Director Harmening indicated that applicant Deb Zeien is requesting a parking lot setback variance such that five parking stalls may be improved with bituminous surfacing for the purpose of serving a proposed conversion of the home at 1511 Vermillion Street into an insurance office. Also, the applicant proposes to have the parking stalls served directly off the alley versus a driveway as required by City Code. PARKING LOT SETBACK VARIANCE-DEB ZEIEN, 1511 VEP~ILLION ST. After discussion a motion was made by Commissioner Kaiser, seconded by Cc~missioner Anderson to recc~nmend approval of the variance as it is felt that due to the types of uses located directly adjacent to the parking lot, the setback variance would not detrimental to the adjacent property. Also, due to the relatively few number of parking spaces it is felt that direct access off of the alley will not be a problem. This recommendation is subject to the applicant moving the four parking spaces eight feet into the property (west) and blacktopping all five stalls this Spring. Upon vote taken, Ayes, 6; Nayes, 0. Planning Director Harmening indicated the City Council had requested that the Planning Commission provide a formal recommendation on a procedure whereby the City could waive certain home occupation requirements if a person could demonstrate that they were experiencing a disability which prevented them from complying with certain home occupation requirements. Harmening noted that the Planning Commission had already conducted the required public hearing on the proposed procedure. The Planning Commission reviewed the most recent draft of the proposed waiver procedure. HOME OCCUPATION- WAIVER PROCEDURE After discussion a motion was made by Commissioner Kaiser, seconded by Anderson, to recommend that the proposed waiver procedure not be implemented due to the following reasons: That such a procedure was discrimanatory as it would give special treatment to physically disabled persons but would not be available for persons who were not experiencing a disability. That such a procedure would put the city in a position, of which it should not place itself, of having to determine if a person has a physical disability which made them eligible for a waiver. Upon vote taken, Ayes, 4; Nayes, Folch; Simacek abstained. applicamts for the Commission. These applicants included Kathleen Krook, 1493 W. 4th St.; Jean Whipple, 1010 W. 14th St. and Anne Anderson, 309 W. 7th St. After the interviews the Planning Commission reviewed the previous three applicants also. Signed ballots were then used by the Commissioners to vote on the applicants. These were tabulated by Planning Director Harmening. Recommendations for appointment were given to Dennis Zender, Kathleen Krook, Harold Featherstone and Anne Anderson. A motion was made by Commissioner Kaiser and seconded by Commissioner Folch to recommend these appointments to the City Council.
