Hotion Passed. AP?ROVAL OF '!I~FJTES Follo'.ving Planning Director Tom Harn~ening detailing the proposed PU~]LIC HEARI']G- zoning for ti~e annexation area. Chairman Foich opened the Planning RES. ZDHI~G Ca'nmissions public hearing at 7:37 p.m. Com~nents and questions posed by A~"IEXATIO~I AREA the public: Leo Reinardy 3525 Redwing 31vd.-'Ir. Reinardy inquired as to how the chosen zoning designation (17-2) was arrived at and if such designation would effect his current tax status. Planning Director Harmening addressed the questions to ~r. 2einardy's satisfaction. John Trombley 175 37th St. ~est-~lr. Trombley expressed concern xith the lack of a park/play ground facility in the area. He as!:ed that the commission give all proposed developments a carefull examination and that park dedication requirements be met. He further stated that property adjacent to his loP, is currently used by the local residents as a play ground and that they would like to continua to use the area in the same manner. Planning Director Harmening detailed the possible triangle area developments, and park dedication require,~nts associated to tho developments. There being no further comments from the audience, Chairman Folch closed the public hearing at 7:50 p.m. Commission members began discussion on the proposed area zoning. It was felt that zoning designations outlined, being consistent with the Hastings Ca'nprehensive Plan, and as the area currently exists as residential properties which is in accordance with the established guides, that a recommendation be made to zone the areas as outlined. A motion i'~as made by Commissioner Ditty to recommend the zoning of the affected area as outlined by staff. Th.=. motion was seconded by Commissioner :(aiser. The Ii,lC. applicant now proposed to combine the two lots by constructing one'S ple;~ structure. In addition Planning Director Har~ening brought the Cc~amissionars attention to the applicants requosP for ~ha vacation o~ an easement ~hich runs along the common lot line of Lots 1 ~ 2. It ,,vas pointed out that the vacation is necessary as tiaa building is to be constructed over the easement. ',.-larmening further addressed issues pertaining to the application in the areas of zoning, area zoning, existing conditions, density, relationship to other properties, drainage, landscaping and screening, lighting, utilities, parking, setbacks, easements and driveway entrances. Harrnening indicated that during the concept review period the 0ity Engineer had expressed concerns regarding the bac!~yard drainage of fhe property. Present to address pertinent questions ~as Wayne Speedling of Gegen World, Inc. After saa~a discussion of the drainage area and lighting for the proposed building a motion ~,~as made by Cc~nmissioner i~redge and seconded by Oommissioner ',(aiser to approve the site plan and easement subject to the roi lowing conditions: A. That the necessary private easement be granted to take into consideration the crossing of a private sewer service over Lot $. That the applicant prepare a revised grading plan which illustrates that all drainage on the property will be directed to Whispering Lane. in the alternative, a left,er shall be provided to the Oity by the owner of Lot 8, ?lhispering ~.~eadows which indicates that the property owner recognizes the drainage plan as proposed for Lots 1 & 2 and that the o',~ner of Lot 8 will deal with the disposal of this drainage when it develops Lot 8 in the future. That pr,cast bumper curbs or poured in place concrete curbs be installed around the entire parking area on the site as per City Code. If applicable the applicant shall provide additional information regarding any special outside lighting provisions. All outside lighting should be designed to be nonobtrusive to adjacent properties. That all applicable conditions imposed as a part of the original site plan review for the t~o four ple~es are still in full force and effect. This incluJes the requirement that upon completion of the construction the entire site shall be sodded. That the structure and accessory items such as the parking lot, landscaping, etc. be completed pursuant to the approved site plan. Upon request for occupancy of the building ali uncompleted items contained within the site plan shall be addressed pursuant to the escrow requir~ment contained in tho site plan review provision of the City Zoning Ordinance (Section 10;24). Planning qire~ter Har:;lening stated tha~ the final plat is consistent with the approved (City Council action August 23, 193S) preliminary pla~. That the terms and conditions inposed as a part of t!~e preliminary plat approval are still in place. That a final grading plan be submitted and approved by the city prior to recording the final plat. That as a part of the final approved grading plan, the easemanbs on the plat be adjusted to take into consideration the necessary drainage ways as illustrated on the approw~d grading plan. That the lots in the cul-de-sacs maintain a minimum 75~ lot width at the setbac!~ line and a 9,000 sq. ft. lot area. Furthermore, the developer shall submit a schedule to the city which illustrates the lot areas for each of the lots in the plat. The Developer must receive approval fr~ the city for the plans and specifications for the municipal in~provements which the Developer proposes to construct in the plat. The ~eveloper shall construct the improvements pursuant to city specifications. That a development agree;'~nt be entered into to take into consideration the above requir~nents and those which may be determined later. That it be understood that the Council reserves full discre~ion to impose restrictions on the future extension of Brooke Lane as the Council deems appropriate t.a protect the public health, safety and welfare. Prasant to answer quasi-ions was Todd Siewer~ of Si.awert Construction. The O~nissionars inquired of Hr. Siewert why this application was necessary considering he was forwarned of the potential problem. ~lr. SiewerP, ~eit a error in estimating the position of the structure upon the lot, led to the nonconformity. Siewert Construction then attanpted to shift the house to meet the established criteria, unsuccessful ly. After some comments and further discussion by the C~missioners a motion was made by C~nmissioner Kaiser and seconded by Commissioner Voelker to deny the request, based on the grounds that it doesn't meet established variance criteria. Upon vote taken, Ayes, $; ~layes, Krook; ~Iotion passed. Planning Oirector Harmening indicated that !~arilyn Reinardy ~as requesting a home occupation permit to allow her to operate a floral arrangement business in her home at 16085 Lester Avenue. Harmening reviewed the Reinardy application with the Planning Conmission. The application indicated that 144 sq. ft. out of a total of 1400 s~. ft. in the home would be used for the home occupation activity. The home occupation activity would involve the purchasing of basic raw materials and the assembly of flower arrangements for special occasions, llarmening indicated that Reinardy ~as given a copy of the home occupation requirements. It appeared the applicant met all require~nts pertaining to home occupations. A motion was made by Commissioner Featherstone and seconded by Oonmissioner Kaiser to approve the permit subject to Reinardy complying with all standards pertaining to home occupations. The next agenda it~ was the review of a preliminary site and parking plans for the proposed Hastings Hotel project. Specific items of interest pertaining to ~he proposal included. HAST 1',13S 'JDTEL- REVI ?t F~TEL I M I ii,'NRY SITE ,7, PAR',(I!IG PLANS A. 77 room hotel, restaurant - 100 sea?s$ bar/lounge - 125 seats; banquet/meeting ro~n - 250-300 seals. 4 story building fr~m 2nd street perspective. 5 story building from riverfront perspectiw~. 1B7 parking spaces are proposed to be constructed along with 70 additional existing spaces located adjacent to the for:~r grocery store site on East 2nd Street. In this case, 5S spaces ara proposed to be constructed under the hotel, 77 spaces in front of the hotel and 52 spaces to the east of the project site (see attached site plan). Some of the parking spaces will be sold to the developer bur will be made available to the public with same limitations. John Grossman, HRA Director was in attendance at the meeting and did explain in greater detail the s~ecifics of the parking arrangements and other development issues. S~ne concern over traffic flows were voiced by the C~nmissioners, and concern about fire safety expressed.
