HomeMy WebLinkAboutIV.A.1 - HEDRA Resolution No. 2021-13 - Approving Sale of UBC Property and DA with NJS Development (Stencil Group)1 HASTINGS ECONOMIC DEVELOPMENT AND REDEVELOPMENT AUTHORITY DAKOTA COUNTY, MINNESOTA HEDRA RESOLUTION NO. 2021-13 A RESOLUTION APPROVING THE SALE OF PROPERTY TO NJS DEVELOPMENT, LLC FOR DEVELOPMENT PURPOSES AND APPROVING THE RELATED DEVELOPMENT AGREEMENT WHEREAS, the Hastings Economic Development and Redevelopment Authority (“HEDRA”) desires to sell property legally described as follows: PID: 19-32150-17-020 (Abstract Property) All of Lot One (1), Block Seventeen (17) in the Town of Hastings, excepting therefrom, however, all that portion lying northeasterly of a line 25 feet southwesterly of, measured at right angles and parallel with, the centerline of Chicago, Milwaukee, St. Paul, and Pacific Railroad Company’s spur track as now there laid across Bailey Street in said Town of Hastings, Dakota County, Minnesota; and ALSO All of Lot Two (2), Block Seventeen (17), Town of Hastings, excepting therefrom the West two-thirds (W 2/3) of the North half (N 1/2) of said Lot Two (2) and further excepting therefrom the West one-third (W 1/3) of the South half (S 1/2) of said Lot Two (2), Town of Hastings, Dakota County, Minnesota, together with those parts vacated and accruing thereto by virtue of the vacations thereof. PID: 19-32150-17-021 (Abstract Property) The North 1/2 of the West 1/2 of the East 2/3 of Lot 2 and the West 1/3 of Lot 2, Block 17, Town of Hastings, Dakota County, Minnesota, together with those parts vacated and accruing thereto by virtue of the vacations thereof. PID: 19-32150-17-080 (Abstract Property) Lots 7 and 8, Block 17, Town of Hastings, Dakota County, Minnesota, together with those parts vacated and accruing thereto by virtue of the vacations thereof. (the “Property”) for redevelopment purposes; and WHEREAS, NJS Development LLC, a limited liability company (“Developer”) registered with the State of Minnesota Secretary of State desires to develop the Property, pursuant to a Development Agreement by and between HEDRA and Developer (“Development Agreement”) for the purpose of constructing an approximately 85 unit apartment building; and 2 WHEREAS, the Development Agreement describes and articulates the sale of the Property and the Developer agrees to accept these terms of the sale; and WHEREAS, on September 9, 2021, HEDRA held a public hearing on the sale of the Property and HEDRA considered all of the information presented at the public hearing. NOW THEREFORE BE IT RESOLVED by the Board of the Hastings Economic Development and Redevelopment Authority as follows: 1. The sale of the Property to Developer is in the public interest of the City and its people, furthers its general plan of economic development and furthers the aims and purposes of Minn. Stat. Sections 469.090 to 469.108; and the appropriate officials are authorized to take such action so as to effectuate such sale. 2. HEDRA approves the Development Agreement, subject to minor modification as approved by the City Attorney and the appropriate officials are authorized to take such action as to effectuate its execution and implementation. Adopted by the Hastings Economic Development and Redevelopment Authority this 9th day of September, 2021.
