APPROVAL OF MINUTES Approve Minutes of the City Council workshop and regular meetings on July 6, 2021. Minutes were approved as presented. VI. COMMENTS FROM THE AUDIENCE Comments from the audience may include remarks about items listed on the Consent Agenda. Mayor Fasbender stated comments received have been distributed to all councilmembers and are acknowledged. VII. COUNCIL ITEMS TO BE CONSIDERED Mayor Fasbender added consideration of a resolution declaring a limitation on water sprinkling and other exterior water usage. VIII. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions,provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. 1. Public Hearing: City Code Amendment- Chickens Hinzman summarized the history of amending City Code to allow chickens in residential areas and discussed the proposed ordinance amendment. Public hearing opened at 7:11 p.m. Seventeen residents spoke in person or via Zoom on the proposed amendment. Three residents provided perspectives that were not in favor of allowing chickens in residential areas; fourteen residents provided perspectives in favor of the proposed amendment. Public hearing closed at 8:03 p.m. Council posed clarifying questions about renters,zoning, neighbor engagement and notification, and permit length. Council discussed the history of the topic addressed at prior Council meetings, the experiences of neighboring cities that allow chickens in residential areas, and referendum. Council posed questions about ordinance language, enforcement, and impact on staff time. 2. Public Hearing: Rescind Emergency Ordinance No. 2020-07 Wietecha explained the reason to rescind Emergency Ordinance No. 2020-07. Council discussion: none. Public hearing opened at 8:44 p.m. Public hearing closed at 8:45 p.m. X. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action.It is up to the discretion of the Mayor as to what, if any,public comment will be heard on these agenda items. Council discussion on approach of resolution versus education efforts; discussion on penalty and associated court fees. Community Development 1. 2nd Reading\Adopt Ordinance No. 2021-08: City Code Amendment- Chickens Leifeld, Braucks to approve as presented. Lund moved to amend the effective date of the ordinance be extended to August 31,2021.No Second. Original motion put to vote. 5 Ayes,2 Nays—Vaughan, Lund 2. 2020 Community Development Annual Report Hinzman presented the 2020 Community Development Annual Report. Councilmembers provided positive feedback on the report and offered gratitude and support of staff for their work. D. Public Safety E. Administration 1. 2nd Reading\Adopt Ordinance No. 2021-09: Rescind Emergency Ordinance No. 2020-07 Vaughan, Folch to approve as presented. 6 Ayes,0 Nays (Councilmember Leifeld left meeting prior to vote.) 2. Resolution No. 07-10-21: Authorize Submittal of Grant- Dakota CDA RIG- Siewert Apartment Council discussion to clarify the City's role in the application and obligations thereafter. Councilmembers requested follow-up if CDA application provides justification detail not provided earlier to Council.
