HomeMy WebLinkAbout20210706 - CC Minutes Hastings, Minnesota City Council Meeting Minutes July 6, 2021 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, July 6, 2021 at 7:07 p.m. in the Council Chambers at the Hastings City Hall, 101 East 40' Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Braucks, Folch, Fox, Leifeld, Lund and Vaughan Staff Present: City Administrator Dan Wietecha Assistant City Administrator Kelly Murtaugh City Attorney Korine Land Community Development Director John Hinzman Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the City Council workshop and regular meetings on June 21, 2021 and workshop on June 29, 2021 Minutes were approved as presented. Comments from the Audience Mayor Fasbender stated comments received via email have been distributed to all councilmembers and are acknowledged. Kori Colvin, Hastings resident,via Zoom, spoke in favor of amending City Code to allow the keeping of chickens within city limits and thanked Council for considering the change. Council Items To Be Considered Councilmember Folch requested Consent Agenda Item #7 be pulled. The item was placed as Administration Item#3. Consent Agenda 1. Pay Bills as Audited 2. Resolution No. 07-01-21: Approve Final Payment for 2021 Sealcoat Program 3. Resolution No. 07-02-21: Approve Parking Restrictions on Portion of Spiral View Loop 4. Resolution No. 07-03-21: Acceptance and Appreciation of a Donation from the Crisp Family to the Parks &Recreation Department 5. Resolution No. 07-04-21: Approve a Tobacco License for Supervalu Inc d/b/a Cub Discount Liquors 6. Resolution No. 07-05-21: Rescind Miller Electric Land Sale and Transfer 7. Designate Hastings Prescott Area Arts Council and Sod House Theater Community Event as a Special Event 8. Declare Surplus Property and Authorize Sale: Building Department 9. 1"Reading\Order Public Hearing: City Code Amendment—Chickens 10. Mural: Second Amendment to City of Hastings —Mural Contract 11. Mural: Second Amendment to License Agreement 12. Accept resignation of Public Works Director Nick Egger. 13. Ayes 7;Nays 0. Authorize Signature: Confluence Development—4th Amendment to Purchase and Development Agreement Hinzman summarized the history of the Confluence Development and the various agreements, and detailed the proposed amendment to the Development Agreement. Council discussed possibly including a caveat to all future contracts regarding catastrophic world events like the COVID-19 Pandemic. Mike Mattingly, Confluence Development LLC, and Rob Barse, Mint Development, detailed the construction activity since the COVID-19 Pandemic shutdown. Council discussed the availability of the observation deck to be used and/or rented by the public, staffing and workforce of the business once it opens, touring the building and thanked the developers for their dedication to the project. Councilmember Fox motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7; Nays 0. Waiver of Late Fees and Penalties on City Utilities a. Resolution No. 07-07-21: Extending Waiver of Late Fees and Penalties b. 1St Reading/Order Public Hearing to Rescind Emergency Ordinance No. 2020-07 Wietecha discussed the various declarations of public health emergencies and related ordinances, the status of the COVID-19 Pandemic and explained the timing of reinstatement of utility fees and penalties. He also noted that the public hearing to rescind Emergency Ordinance No. 2020-07 was scheduled for the July 19, 2021 City Council meeting. Councilmember Braucks motioned to approve Resolution No. 07-07-21: Extending Waiver of Late Fees and Penalties as presented, seconded by Councilmember Lund. Ayes 7;Nays 0. Councilmember Lund motioned to approve the 1St Reading/Order Public Hearing to Rescind Emergency Ordinance No. 2020-07 as presented, seconded by Councilmember Braucks. Ayes 7;Nays 0. Bond Sale: 2021 Street Improvement & Utility Project a. Resolution No.07-08-21: Providing for the Competitive Negotiated Sale of General Obligation Bonds, Series 2021A. b. Municipal Service Agreement with Northland Securities,Inc. Tammy Omdal,Northland Securities, explained the sale of the bonds, how the money will be used and the City's current bond rating. Council discussed strategies to increase the City's bond rating. Councilmember Vaughan motioned to approve Resolution No. 07-08-21: Providing for the Competitive Negotiated Sale of General Obligation Bonds, Series 2021A as presented, seconded by Councilmember Folch. Ayes 7;Nays 0. Ayes 7;Nays 0. Designate Hastings Prescott Area Arts Council and Sod House Theater Community Event as a Special Event Council discussed how the City promotes special events and other events in the community, event tiers and associated promoting parameters established in the Special Event Policy and recommended that this be reviewed by the Administrative Committee. Councilmember Braucks motioned to approve as presented and that this item be reviewed by the Administrative Committee, seconded by Councilmember Leifeld. Council discussed whether special events should be added to the City calendar since they were approved by Council. Ayes 7;Nays 0. Mayor Fasbender and Councilmembers made the following announcements: Announcements • The Twin Cities-Milwaukee-Chicago Intercity Passenger Rail project received $1 OM toward track and signal improvements in southeastern MN. • Cottage Grove Beyond the Yellow Ribbon (soon changing name to Mississippi Valley Beyond the Yellow Ribbon) is seeking board members. Interested parties should contact Councilmember Braucks. • Happy Birthday last week to Councilmember Folch and Happy Birthday today to Councilmember Vaughan. • Summer Programs at Levee Park o Thursday, July 8, Music in the Park with The Under Groove.
