City Council Meeting Minutes
May 3,2021
The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, May 3, 2021 at
7:00 p.m. via Zoom video conference.
Mayor Fasbender explained why and referenced various city, state and federal declarations and guidelines that
an in-person meeting was not practical or prudent due to the COVID-19 Pandemic.
Members Present: Mayor Fasbender, Councilmembers Braucks, Folch, Fox, Leifeld,Lund and Vaughan

Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City
Council meeting on April 19, 2021.
Minutes were approved as presented.

Councilmember Braucks motioned to approve as amended, seconded by Councilmember Folch. Roll

Resolution No. 05-04-21: Award of Contract for 2021 Neighborhood Infrastructure Improvements (W
15th Street- Phase II)—McNamara Construction($2,595,590.00)
Stempski discussed the 2021 Neighborhood Infrastructure Improvements, received bids and why the
contract should be awarded to McNamara Contracting.
Councilmember Lund motioned to approve as amended, seconded by Councilmember Folch. Roll
Call: Ayes 7;Nays 0.

Public Hearing and Authorize Issuance of Sidewalk Cafe License for Geek Grind LLC d/b/a Geek
Haven Coffee, 120 2"d Street East
Hinzman detailed the sidewalk cafd request from the Geek Grind. He also noted that staff reviewed the
application and recommends approval.
Mayor Fasbender opened the public hearing opened at 7:12 p.m. and hearing no comments closed the
public hearing .
Council discussed the proposed start time.
Councilmember Leifeld motioned to approve as amended, seconded by Councilmember Braucks. Roll
Call: Ayes 7;Nays 0.
Public Hearing and 2"d Reading\Adopt Ordinance No. 2021-07: City Code Amendment-Climate
Controlled Storage
Hinzman detailed the amendment to the City Code to allow climate controlled storage as a use in the
C-4 Zoning District. He noted that the Planning Commission unanimously voted to recommend approval.
Mayor Fasbender opened the public hearing at 7:16 p.m. and hearing no comments, closed the public
hearing at 7:17 p.m.
Councilmember Fox motioned to approve as amended, seconded by Councilmember Leifeld. Roll
Call: Ayes 7;Nays 0.
Resolution No. 05-05-21: South Oaks of Hastings 4"'Addition - Preliminary and Final Plat Approval-
Greg J Homes
Hinzman discussed the preliminary and final plats for South Oaks of Hastings 4"'Addition,specified
why staff recommended approval and why the Planning Commission unanimously voted to deny the
application and received public comments. He also noted the grading and drainage information was still
missing.
Council discussed the original approval of the preliminary and final plats in 2017 and since they were
never filed with the County had expired, why this item was brought before Council regardless of the missing
information, what happens if the application was denied, sidewalk requirements, the previous legal dispute
with developer, the validity of the 2017 stormwater agreement, whether the additional drainage pond requires
an HOA for maintenance, drainage pond maintenance requirements specified in the ordinance, other
developments with HOA's to maintain drainage ponds, staff's requests and requirements for information were
not unusual, the resolution, flooding of houses if the regional pond overflows and regional pond maintenance.
Mark Thieroff,attorney for the developer, indicated that if requested from the City, an extension
would be granted, acknowledged the late submission of required documents, not opposed to additional
drainage pond but opposed the HOA requirement and requested that Resolution Condition 1B regarding the
drainage pond be removed.
Councilmember Vaughan motioned to approve as amended, seconded by Councilmember Braucks.

Council discussed that the City must adhere to stormwater rules determined by the State,the one-year
time limit listed in the resolution for the submittal of a stormwater plan,the approved resolution can be
amended if a submitted plan using the regional pond was approved by staff.

Mayor Fasbender and Councilmembers made the following announcements:
• May is National Building Safety Month. This is Municipal Clerk Appreciation Week. And next week is
National Police Week. Please join me in a great and heartfelt thank you to our employees in these
departments. They provide essential services and help ensure the safety of our community.
• Congratulations to Sadie Reiners who was recently awarded the Janet Louer United States Tennis
Association Junior Team Tennis National Organizer of the Year Award for her work developing tennis
opportunities for youth. Sadie Reiners founded the Hastings National Junior Tennis & Learning Chapter
which now has 80 participants annually and fields 7-10 teams each year.
• The inaugural Eagle Watch Bike Tour is a family-friendly bike event on the Point Douglas Trail between
Hastings and Prescott. Enjoy biking this 3 '/z mile trail, spotting bald eagles, and exploring two historic
downtowns on Saturday, May 8.
• On Wednesday, May 12,the Hastings Police and Fire Departments will hold a Public Safety Night
downtown from 5:00 to 7:30. The event will have public safety displays, including fire equipment and
police K-9.
• Volunteer with the Hastings Parks &Recreation Department to plant a tree in celebration of Arbor Day on
Friday, May 14, at CP Adams Park.
• Planning Commission Meeting on Monday, May 10, 2021 at 7:00 pm
• Parks &Recreation Commission Meeting on Tuesday, May 11, 2021 at 7:00 pm
• HEDRA Meeting on Thursday,May 13, 2021 at 6:00 pm
• City Council Strategic Planning Workshop on Monday, May 17,2021 at 5:00 pm and Regular Meeting at
7:00 pm
Councilmember Folch motioned to adjourn the meeting at 8:32 p.m., seconded by Councilmember
Braucks. Roll Call: Ayes 7;Nays 0.
