City Council Meeting Minutes
March 15,2021
The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, March 15, 2021
at 7:07 p.m. via Zoom video conference.
Mayor Fasbender explained why and referenced various city, state and federal declarations and guidelines that
an in-person meeting was not practical or prudent due to the COVID-19 Pandemic.
Members Present: Mayor Fasbender, Councilmembers Braucks, Folch, Fox, Leifeld, Lund and Vaughan

Presentation: Hastings Prescott Area Arts Council(HPAAC)
Kathy O'Keefe, Scott Northard and Brian Nosan, HPAAC, updated the Council of various HPAAC
projects and activities and asked the Council to amend the 2040 Comprehensive Plan to include arts.
Council discussed their support for HPAAC and thanked them for their efforts,the possibility of
adding arts to the 2040 Comprehensive Plan and to discuss further at a workshop.
Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council
Regular Meeting on March 1, 2021.
Minutes were approved as presented.
Comments From The Audience
Mayor Fasbender stated comments received about items not on the agenda have been distributed to all
councilmembers and are acknowledged.
Tom Day, slip owner at Hubs Marina, spoke in favor of the no wake zone.
Matthew Francis, 817 1" Street, supported the no wake zone.

Councilmember Folch motioned to approve as presented, seconded by Councilmember Leifeld. Roll

Public Hearing and Resolution No.03-11-21: 2021 Neighborhood Infrastructure Improvements Project
Scope& Features (15'h Street—Phase II) and Authorize Advertisement for Bids—2021 Neighborhood
Infrastructure Improvements
Stempski detailed the Phase II of the 2021 Neighborhood Infrastructure Improvements Project
including the timeline and public engagement.
Council discussed notification to those residents where the bump out will be constructed and the loss
of parking, criteria for streets to receive state aid, location of mailboxes, crosswalks and stop signs.
Mayor Fasbender opened the public hearing at 8:16 p.m.
Mark Kunster, 1348 15'' Street West, and Stempski discussed curb lines and the possibility of tree
removal.
Dave Foster, 944 15`1' Street West,thanked staff for addressing the crosswalk and inquired about
signage and snow removal. Stempski addressed his questions.
Hearing no further comments, Mayor Fasbender closed the public hearing at 8:24 p.m.
Councilmember Braucks motioned to approve as presented, seconded by Councilmember Lund. Roll
Call: Ayes 7;Nays 0.
Resolution No. 03-12-21: Approve MnDOT Municipal Cooperative Construction Agreement No.
1045012 for Highway 316 Improvements
Egger summarized the Highway 316 Improvements Project and the Cooperative Construction
Agreement with MnDot.
Councilmember Folch motioned to approve as presented, seconded by Councilmember Fox. Roll Call:
Ayes 7; Nays 0.
Resolution No. 03-13-21: Approve MnDOT Limited Use Permit No. 1926-0108 for Multi-Use Trail
Alongside Highway 316
Egger spoke of the Limited Use Permit for trail work conducted in MnDot's right of way on Highway
316.
Council discussed the trail segments located on the west side of Highway 316.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Folch. Roll

Resolution No. 03-14-21: Approve MnDOT Detour Agreement No. 1045339 for Highway 316
Improvements
Egger explained that the Detour Agreement with MnDOT designates East 10�' Street as a local area
detour.
Council discussed the difference between the primary and local detours.
Councilmember Fox motioned to approve as presented, seconded by Councilmember Lund. Roll Call:
Ayes 7; Nays 0.
Vermillion Acres -Headwaters Development
a. Resolution No. 03-15-21: Approve Final Plat
b. Recommend Action: Contribution towards County Road 46-47 Improvements
Hinzman discussed the Final Plat for the Headwaters Development and noted that the Planning
Commission unanimously voted to recommend approval. He also stated the contribution towards the road
improvements item was delayed to allow staff to research it further.
Councilmember Leifeld motioned to approve as presented, seconded by Councilmember Braucks. Roll
Call: Ayes 7;Nays 0.
Authorize Signature: Villas at Pleasant- Site Grading Agreement
Hinzman discussed the grading plan and agreement for Villas at Pleasant development. He noted
approval of the grading agreement does signify automatic approval of the Final Plat.
Councilmember Vaughan motioned to approve as presented,seconded by Councilmember Lund. Roll
Call: Ayes 7;Nays 0.
No Wake Zone
Wietecha summarized previous discussions of a no wake zone and that the Public Safety Committee of
the Council recommended the City pursue the possibility of a no wake zone ordinance.
Mike Slavik,Dakota County Commissioner, discussed the positions and comprise of allowing a no
wake zone only during high water by the Dakota and Washington County's Sheriff's. Furthermore, there was a
lack of documentation supporting a no wake zone, and if approved, the City would be enacting an ordinance
that would have to be enforced by a different governmental agency.
Council discussed the type of documentation needed and recognized there is a need for data, erosion
on both public and private property, other communities with no wake zones, enforcement of a no wake zone
and the definitions of high water and flooding.
Councilmember Fox motioned to send this item back to the Public Safety Committee for discussion
within the next month, seconded by Councilmember Folch.
Council discussed the appropriate length of time.
Councilmember Fox motioned to amend the first motion timeline to two months, seconded by
Councilmember Braucks.

Council discussed collection of data by staff and presenting to Public Safety Committee when
completed, possibly contacting the DNR, the Army Corp of Engineers,National Park Service and state
representatives, need for community input and posting no wake signage.
Schafer noted that Hastings Police Department jurisdiction does not include the river. Therefore, the
City does not have any first hand incident data and any data would be obtained from the appropriate
enforcement agencies.

Mayor Fasbender and Councilmembers made the following announcements:
• The City's Parks &Recreation Department, AmeriCorps,and Hastings Community Ed are providing an
Alternative Spring Break for 50'4`1' graders from Monday to Wednesday, March 29—31. Please register at
the City website.
• The Hastings Spring Clean-Up will run April 5 to 10 and will include drop-off and curbside pick-up
options. Please see the clean-up flyer for schedules and charges.
• Heritage Preservation Commission on Tuesday, March 16 at 7:00 pm
• Joint Meeting: Public Safety Committee and Public Safety Advisory Commission on Thursday, March 18
at 6:30 pm
• Planning Commission on Monday, March 22 at 7:00 pm
• City Council Workshop - American Rescue Plan on Monday, April 5 at 5:30 pm
