HomeMy WebLinkAbout03/10/86MINUTES OF HASTINGS PLANNING COMMISSION The regular meeting of the Hastings Planning Cc~nission was called to order at 7:30 p.m. Members Present: Cor~nissioners Ditty, Stevens, Dredge, Kaiser, Conzemius Voelker and Simacek Members Absent: Commissioners Folch and Anderson. Staff Present: Planning Director Harmening Conmissioner Kaiser moved, seconded by Commissioner Dredge, to approve the February 24, 1986 minutes. Voice vote carried unanimously. APPROVAL OF MINUTES The Chairman opened the public hearing at 7:32 p.m. The Planning Director briefly reviewed the proposed platting action. In this case, Hastings Construction is requesting approval of the preliminary/final plat for Sunny Acres 3. Approval of the plat is intended to accomodate the construction of Phase II of the five phase development. Phase II includes a sixteen unit multi-family building and four quad homes. The size of the proposed plat is approximately 3.34 acres. The development proposal which is being made for Phase II is identical to that which was approved by the City in 1985. Planning Director Karmening questioned Cory Gustafson, representative of Hastings Construction, on the street access plans for the quad hcmes. There being no further comments from the audience the Chairman closed the public hearing at 7:40 p.m. PUBLIC HEARING- PRELIMINARY/FINAL PLAT-SUNNY ACRES III HASTINGS CONSTRUCT. After discussion Conmissioner Ditty moved, seconded by Con~issioner Kaiser, to recor~nend approval of the preliminary/final plat as the plat and development proposal as submitted are consistent with the previously approved plans and subdivision regulations. It was noted that the developer should be informed that final site plan approval will be required for the building construction in Phase II. Upon vote taken, Ayes, 7; Nayes, 0. Mrs. Von Feldt is requesting a home occupation permit so that she may conduct a balloon bouquet operation out of her home. Mrs. Von Feldt indicated in her application that she would expect very few customers would visit her home as she will be doing most of the deliveries herself. Mrs. Von Feldt informed the Planning Commission that her operation will take over a current balloon bouquet operation, which has a home occupation permit, now conducted by Arlene Benjamin at 322 E. 7th St. HOME OCCUPATION PERMIT-JANE VONFET ,FF~ 1389 BRITTANY ROAD- BALLOON BOUQUETS After discussion a motion was made by Co~n~issioner Kaiser, seconded by Con%missioner Voelker, to reconmend approval of the home occupation permit as the proposal appears to meet the requir~ents of the zoning ordinance subject to the condition that the helium containers (pressure vessels) be chained in an upright position. Upon vote taken, Ayes, 7; Nayes, 0. Mr. Grund is requesting that the City approve the plans for Phase II of the Three Rivers Mobile Home Park develo~n~nt. A major consideration in this application for approval is the request that the city waive the originally agreed upon require- ment that arrangements be made by the applicant for a second access to Trunk Highway 316 prior to the initiation of the second or third phases of the development. The applicant is also requesting that the originally approved concept plan be modified slightly to permit several additional units to be located in the Phase II area. Phase II is proposed to accomodate 113 units. The applicant stated that he is negotiating a land purchasse with land c~ners for the property located between the southwest end of the perk and Trunk Highway 316 but has not yet been able to close on a sale. Mr. Grund indicated that if approval were given by the city at this time for Phase II it was estimated that homes could be moved into Phase II by July 1st, 1986. THREE RIVERS MOBILE- HOME PARK-PHASE II EXPANSION-KEN GRUND, THREE RIVERS PARTNEF SHIP Three property owners frc~ the Malcolm Ave. area were in attendance and expressed concern with the requested waiver of the T.H. 316 secondary access requirement and its i~act on public safety and traffic congestion on 160th St. The property owners also expressed conments regarding the need for double wide homes on lots adjacent to the Malcolm Ave. properties. Concerns were also expressed in reference to items remaining to be completed in Phase I. Assistant Fire Chief Rosendahl was in attendance and presented information to the Planning Con~ission pertaining to the purpose of having two or more access points available to the mobile hc~e park or for that matter, any residential development. The Planning Co~nission discussed with Mr. Grund general matters pertaining to the proposal. After further discussion Commissioner Dredge moved, seconded by Conmissioner Kaiser, to reconmend denial of Phase II as arrangements have not beenmade by the applicant for a secondary access to Trunk Highway 316 prior to the initiation of Phase II as stated in the developers agreement. It was further stated that secondary access provisions are necessary to protect the public health, safety, and welfare of the residents in the park and to decrease traffic impects on 160th Street. It was also noted that at the time the secondary access is provided it should be approved for use by the fire depertment and engineering depertment. Upon vote taken, Ayes, 7; Nayes, 0. The city has received a petition from eleven of twelve property owners requesting the vacation of the unimproved alley right of way in block 92 and 93, Original plat. As per city cede the City Council has scheduled a public hearing on this matter to be held March 17, 1986. C0rrently, the city has no utilities located within the right of way and the various other utility companies have been notified of the alley vacation request. NSP does have power poles located in or adjacent to the alley. It does not appear any city utilities are planned to be located in the subject right of way in the future. REVIE~W REQUEST FOR ALLEY VACATION- BLOCK 92 & 93, ORIGINAL PLAT After discussion Commissioner Conzemius moved, seconded by Concessioner Kaiser, to inform the Council that because the alley does not serve any real purpose it would appear that an alley vacation would not be unreasonable on the condition that easements be retained for existing utilities. Plmming C0m tt e of the City C0mcil has r est that the Planning Con~uission consider a zoning ordinance amendment which would clarify the intent of the current ordinance which regulates the setbacks of attached garages and adjoining living space. Currently, Section 10.23 footnote G of the zoning ordinance states that interior interior sideyards in the R-1 district may be seven feet on the side where there is an attached garage. The Planning Con~mittee felt this standard could be interpreted two ways. One way is to interpret that only attached garages can be seven feet frc~ an interior property line and that family living space must meet the standard 10 foot requirement. This interpretation was used in the past by previous planners and was used for a recent variance request. The second interpretation which could be used is that setbacks along interior sideyards may be 7 feet for attached garages and family living space as long as the living space is on the same side and adjoining the attached garage. The Planning Conmittee has requested that the Planning Con,mission consider an ordinance which would amend footnote G such that the second interpretation example could be used in the future. Councilmember Trautmann, Chairman of the Planning Committee, was in attendance to discuss this matter. POSSIBLE ZONING ORDINANCE AMENDMENT REGARDING S IDEYARD SETBACKS FOR ATTACHED GARAGES AND ADJOINING LIVING SPACE IN R-1 ZONES Members of the Planning Conn~ssion expressed concern with the proposal as they thought it was initiated solely because of a recent variance request. After further discussion Coranissioner Dittymoved, seconded by Conm~issioner Stevens, to recommend to the Planning c°n%mmttee and City Council that a zoning ordinance amendment be considered to permit living space, if it adjoins an attached garage, to be within 7 feet of an interior property line in an R-1 zone. Upon vote taken Commissioners Ditty, Stevens, Simacek and Conzeraius voted in favor of said motion; Co~rissioners Dredge, Kaiser and Veelker voted against said motion whereupon the motion was declared passed. Cor~aissioner Kaiser moved, seconded by Con~nissioner Stevens, to call a Public Hearing for 7:30 p.m. on March 24, 1986 to consider an amendment to the Hastings Comprehensive Plan to take into consideration upoc~ing annexations from Marshan Township. Upon vote taken, Ayes, 7; Nayes, 0. ORDER PUBLIC HEARING ON COMPREHt~S IVE PLAN AMENDMENT TO CONSIDER UPCOMING ANNEXATIONS The Planning Con~nission briefly discussed the following items: OTHER BUSINESS A. Revisions to Home Occupation Ordinance criteria. B. Discussed other possible uses for large historic structures. Planning Director Harmening updated the Planning Conmission on recent City Council actions. Conm~ssioner Kaiser moved, seconded by Conwaissioner Ditty, to call a public hearing for March 24, 1986 at 7:30 p.m. regarding a request for rezoning/preliminary plat approval for Bauer View 2nd Addition. Upon vote taken, Ayes, 7; Nayes, 0. ORDER PUBLIC HEARING REZONING/PRELIMINARY PLAT-BAUER VIEW 2nd ADDITION-WILLIAM BAUER Commissioner Kaiser moved, seconded by Conn~issioner Dredge, to adjourn the meeting at 9:30 p.m. Ayes, 7; Nayes, 0.
