The regular meeting of tile !'tastings Planning Commission was cai led to order at
7:30 p.m.
Hembers Present: Ohairman Kaiser, Oommissioners !(roD'.<, Featherstone, .~nderson
and Voel ker.
~embers Absent: Oommissioners Ditty, Oredfle, Folch and Zender.
Staff Present: mlanning ~irector Har'-~ning
Planning Director Harmening brought the O~nmissions attention
to an apparent o~ission in the minutes of the regular
=lanning C~nmission minutes of April 10, lg39. The minutes
did not reflect the findings for non-consideration of a
proposed ordinance that would allow t~qporary asphalt plants
within an agriculkural zoning district. The findings foll~:

The Ag zoning district already allows gravel pits, heavy
equipment o~erators, tree service contractors. As a result,
ti~e Agricultural zoning district, and the people living in
the Ag district, should not be subject to further intrusions
which asphalt plants would bring.
Due to the use of oil in mal(ing asphalt, there is concern for
ground water contamination and related consequences as ~ell as
uncertainties regarding who would be responsible for cleaning
ue possible contamination.
3. The city and its residents have been able to function without
asphalt plants in the past.
The city has responsibilities for loci(lng cum for its residents
including maintaining their health, safety and welfare. It was
felt tile proposed ordinance would not meet this responsibility.
The Planning Oommission reviewed the proposed change and following
~hich a motion wasmade by Oommisaioner Voelker and seconded by Commissioner
i(rook to approve the minutes subjeck to the change.
Upon vote taken, Ayes, 5~ Nayes, None; :~inutes approved.
Planning Director Har~ening and H.R.A. Oirector
John Grossman detailed an application made by R.J.Jacob
and Associates for a special use permit, site plan
evaluation and a parking lot setbac~ variance. The
applicant proposes to construct a hotel adjacent to
the ?!ississippi River, within the rivers flo~d fringe.
The hot~.)l would consist of 77 roches, a restaurant?bar
seating up to 17'~ peopta (also up -Po 100 seasonal seats
upon an e>~erior deck) end a banquet/meeting room with
up to 203 seats. Harmening and Gross~nan addressed issues
related to parking, building setbacks, leading areas,

Planning Oirector Har~aning and H.R.A. Director grossman
addressed the concerns aired during the public hearing.
There being no further comment from the audience Chairman !(aiser
closed the public hearing at 7:57 p.m. Following discussion, a
motion '~as made by Commissioner Krook and seconded by
C~missioner Anderson to approve the site plan,
special usa permit, and grant the required parking lot setbacl~
variances subject to the following conditions:
A. No portion of the hotel or peri<lng ramp shall be constructed
closer than 75 feet from elevation 675.
!~. Ho filling shall occur at or below elevation 535.
To control dust, necessary on-site watering shall be ~one
during construction of ?ha project.
~). ~rosion control features shall be impleaansed as necessary
during construction.
Landscaping plans for the area dir,actly around the ho~el and
par',~ing lots shall be provided for city staff approval.

Planning Director Har~.~ning detailed the application of
Oolu;nbus Friermuth for approval of a site plan, for a
proposed three plax mo be constructed on Lot ?, ]lock 3,
Riverv¢ood Addition. The site in question was original ly
proposed to acco~odate a four unit structure as part
of a planned unit development. The applicant now
desires to reduce the number of dwal lings units to three
due to limitations imposed by the size of the lot. Harnening
oriefad the commission on issues relating to area zoning,
flood plain elevations, easements, landscaping, and par<lng.
?oi lowing the detailing of the proposal a ,':~tion was made

approve the site plan subject to the fei lowing conditions:

A. The applicant submit a landscaping plan to the City of Hastings
prior to the occupancy of the units.
The applicant comply with flood plain requlr~ents for the
area in question.
That the applicant be required to place concrete curb or
precast concrete bumper blocks in the structures drive/turn
around located in The front yard area.
That the applicant conform to alt require~nts of a R-3 PRg.
That the drive~ay to the home be reduced in width from
to 24~ in accordance with City Code Sec. 1O.0S subdivision 3-A.

The ne~ agenda item addressed by tile Canmission was an
application by r~ort Huber, Acorn investments for final plat
approval of an area cc~nmonty referred to as ¢~ri Park.
Planning git.actor Haraening detailed the application to the
Commission and stated that in contrasting the preliminary
plat to the final plat it appears the two are consistent. He
further stated that pipeline easement issues have h~sen adequately

The Final plat shall be adjusted to illustrate utility and
drainage easements as being 5 feet along side an~ rear lot

upon the revie?~ of the final site plan the six plax development
has to tenet city code require;,~nts and that if it does not, the
site plan may be subject to denial. Also, replattlng may be

That it be understood that all structures, including dec!~s,
outbuildings, etc. must be located not less than 50 feet from
the nearest ~(och pipeline located aleng the southern portion of the
plat. Future builders or ~oa~owners who wish to construct structures
on the Io~s adjacent to the Koch pipeline shal I locate the nearest
pipeline for the Oily of Hastings such that the city can determine
if the 5(] foot setback requiremen~ will be me~.
E. Tiaa developer shall provide lot area calculations.
Tha~ the Hayer and Oily Clerk are authorized to enter into a
develop-~nt agreement ~.t~een the developer and the city to
take into consideration the conditions and understandings
outlined above or those that may be determined at a later date.

The Plannin~ Cc~mission was briefed on the na'~t apenda i~em
by the Planning Director. In this case
1600 Building Corporation (I(.0. Hal I) had requested
city action towards a proposed access road to service the
'.(niqhts of Colurnbus property. Har..mening brought to the
Commissions attention a memo drafted on April 18, lg~9,
from the City Engineer ¥~hich stated:

I have reviewed the April 12 TH315 access plan submitted by the
Sixteen Hundred ~uilding Corporation. I recommend denial of this
request for the follo¥,'ing reasons:
It is impossible to construct a standard right turn lane betYzeen
31st Street and 33rd Street ;~ithout overlapping into one or
both of the street intersections. The distance between 31st
and 33rd Street is approximately 700 feet. As shown on the
attached :~nr)ot drawing, a standard right hand turn lane requires
a mininum 450 ft. distance to construct· The com.~ercial dew~.lop~nt
along 33rd Street will require the construction of a right hand
turn lane at the intersection of 33rd Street and TH315. Subtracting
the 4;~0 ft. length for a righ~ turn from the 700 feet between
31st and 33rd Streets leaves only 220 feet of the requir.ed 4~0 ft.
necessary for constructing a right turn lane into the Sixteen
Hundred Building Corporation property. Extension of a right turn
lane through the 31st Street intersection by the ramaininq ~.~.3 ft.
required to consffruct a standard turn lane would create a traffic
hazard in uhich the right turn lane would be mistaken for a Pypass
lane. There just isn't enough room to construct a right turn lane
into this property.
The traffic framework plan for this area developed by the City's
traffic consultant, Benshoof & Associates, recommends that this
property's access come from 33rd Street and not TH 31,5.
Aisc present to address the Commissioners questions in relation
to the ingress was Dave Parkhill, potential purchaser. Following
discussion by the Ccmmission, a motion was made by Oo'nmissioner
Krook and seconded by Commissioner Anderson to deny the application
based upon the abow? findings of the City Engineer and the City's traffic
consultant.
Upon vote taken, Ayes, 5; Noyes, ~one; motion passeJ.
Planning Director Harraening detailed to the O~nmissioners
a request Py the residents of Slock 11, Sarkers Addition
to have an unimproved alley right of way located adjacent
to their property vacated. Harmening further stated that
no action was required of the O~mission on this issue.

Planning Director Harmening then briefed the Oommission
on the adoption of an ordinance to address the usage of
part, lng lots for seasonal sales and possible construction
of a pedestrian walkway along the North Frontage Road.
Chairaan Kaiser cai led for volunteers from the Commission
to form committees to view the various issues related to
these proposals. Commissioners Kaiser, Voelker, and Anderson
volunteered for the parking lot canmittee and Commissioners
Zender, '.(aiser and Featherstone will comprise the walkway
co'nm ittee.
