*he Com'aission, a motion was made by Com~nissioner 1(rook and seconded
by Ccrnnissioner Ditty to approve the preliminary/final plat and site
plan subject to the fei lowing conditions:
Payment of interceptor sewer charges·
That it be understood that any time any portion of 0utlot A
of Pleasant Valley 4th Addition or Pleasant Valley 1st
Addition are proposed be platted in any form, that issues
pertaining to park land dedication and stor~ water drainage
shall be resolved fully to the satisfaction of the City of
Hastings.
That prior to occupancy of any of the t~nhome units, the
developer shall replace the 8" sanitary sewer line in
Jefferson Street with a 15" sanitary sewer line, pursuant to
city specifications, i~ith all sewer and water services for
the t¢,vnhome units to be extended to the Jefferson Street
right-of-way line. In addition, the developer shall
reconstruct Jefferson Street and install a sidewalk along
the south side of Jefferson Street. The street
reconstruction and the sidewalk construction shall be
completed pursuant to city specifications. The developer
shall extend the new sanitary sewer and a>:isting watermain
to the ~est edge of the platted townhorae lots.
Due to the concept plan sub;nitted, Jefferson St. shall be
renamed as *~onroe St. in order to avoid future street name
and address problems.

That the construction of the t~vnhomes and related site plan
improvements shall be completed as per tha ,approved site
plan. Occupancy of the t~,.~nhome units shall not take place
until all site plan related improvements have been
completed. In the alternative, occupancy of the units may
be permitted if the developer provides to the city, as per
city code r~uirements, a cash escrow in an amount equal ?o
125!~i of the cost of the site improvements re~aining to be
completed.
That a develop~nent agreement be entered into to implement
the conditions and understandings ~ntioned above or thoss

?1. The proposal is the result of a desire by the
dudges to rearrange the lots in question from the existing
configuration, ¥~hich placed tbe Io~s running in a ease/west
direc'~ion, to a proposed configuration of the Io~s running in a
north/sou~h direction. The primary reason for the proposed change
is to subdivide ~he property in such a manner that Yhe resulting
configuration would allow for another lot to build on. Jorgenson
smated ~at within the R-2 zoning district the resulting IoYs
would meet the city's requirements in ter~s of lot ~idths and
minimum lot size. Aisc, the existing structure appears to ~et
applicable setback r~uirements in relation to the new lot. Fol lowing
the de,ailing of ~he proposed change by Jor~nson a motion was made
to approve the r~uest subject to the following conditions:
That if the future property owner and/or applicant intend to
provide the parcel with utility service through the
boulevard, that the grade of service be closely examined to
make certain no conflict with existin~ utility service cx;cur,
as per the city engineer's request.

The next agenda item addressed by ~he Ccrnmission was the
development of a zoning ordinance a~endment that would result in
an addition zoning district designation. The intent of the new
district is to establish a general office designation to provide
the city and it's residents with a zoning designation that permits
limited business applications in certain areas of the community as
determined by the Hastings Comprehensive Plan· This designation
can be used as a buffer zone to insulate residential areas from
high ~nove~ant areas.
As part of the process of considering such an amendment, a public
hearing is required· Chairman Kaiser opened the public hearing at
3:21 ?~I. There being no one present ~ishing to comment upon the
issue, Chairman Kaiser closed the public hearing aT 8:22
The Item was then opened to discussion among the O0~missioners
following which a mo~ion was made by C~amissioner !(rook and
seconded by Commissioner Ditty to recommend the amendment to the
City Council subject to legal council rewrite of the draft and
that the buffer zone setback ~e increased to 25~ and frontyard
setbacks be decreased to 25~.

Following the detailing of the site plan by Harmening a
motion was made by Coamissioner Folch and seconded by C~nmissioner
Featherstone to approve the site plan subject to the following
conditions:
That the 5 unit condominiums located on the outlots must
be replatted into lots prior to building construction
occurring for the applicable condo~s.
The applicant shall receive approval from the telephone
company regarding work '~hich may take place on the
telephone company's eas,an~ant.
The applicant is to make sure ~hat the building height
of the condo structures are not greater than 23 feet·
If tee building height of the structures are greater
than 23 feet, the setbac!~ between the two structures on
Lot 5 must be increased to at least equal to the actual
height of the structure. Also, it is rec~nr~nded that
the distance between the two structures on the north and
the one on the south of Lot 5 be increased.
if possible, the berm on the site should be increased in
height as much as is practically possible. In addition,
the applicant shall work with city staff to improve the
overall landscaping plan.
The applicant shall revise the site plan to illustrate
the installation of concrete curb around the parl~ing
lots as required by the city's PR~ standards.
The drainage north of the si;< ple~as should be directed
to cross over the commercial property to the north at
one or two locations to facilitate future culvert
crossings beneath the future berm to be built by the
ca~mercial development.
The provision of v~ater and sewer services and related
shutoffs and ~ter locations shall be comply;ted pursuant
to Wafer Department requir~nents. The applicant shall

The city shall r~,~eive copies of th~ association
covenants and byla~s. These documents should address
matters pertaining to garbage disposal and storage of
garbage cans. In addition, these documents shall handle
matters pertaining to the joint use of parking spaces
and ingress and egress issues. The documents ~hall also
contain a provision which states that the parking spaces
in front of each garage may only be used by ~he owner of
the garage unit.
That the structures and accessory items such as the
parking lots, landscaping, etc. be colapleted pursuant to
the approval site plan. Upon request for occupancy of
the buildings all uncompleted items contained within the
site plan shall be addressed pursuant to the escrow
requirement contained the the city's site plan review
provision as outlined in the Zoning Ordinance (Section
10.24).
The ne~ item addressed by the Oommission was an application
received from Ccm~rcial Asphalt Oompany requesting approval of a
special use permit to operate a hot mix as,halt plant in the City
of Hastings. As part of the process of considering whether or not
such a permit should be granted, a public hearing on the issue
must be held. Following the detailing of the application by
Planning !~irector Harmening, a motion was reade by Commissioner
Ditty and seconded by Ocmmissioner Krook to request the public
hearing related to the above stated issue be held by the !~astings
City Oouncil rather than the Planning Commission.
Upon vote taken, 7 Ayes~ Hayes, Hone; motion passed.
Planning Director Harmening detailed an application by Duane
Groth and Nell Siewert for a rezoning and comp. plan amendment
for property located at the southwest corner of the intersection
of Hwy 55 & Oine St. The area in question is currently zoned R-1
& R-2 med. density residential. The application requests a
rezoning to 0-2 Highway - Auto Specialized Commerce. A public
hearing is required to be held as a part of the proposed rezoning
and comprehensive plan amendment.
A motion ',~as made by O~nmissioner !(rook and seconded by
CQmmissioner Voelker to order a public hearing for the next
regularly scheduled Planning C~qmission meeting on qonday, June 12,
195:D to consider the above stated matter.

The next item addressed by the C~'nmission ,~'as th? result of a
request by the office of the Hayer to haw~ the Plannin,?, go~mission
s'rudy The issue of instal lation of a sidewalk along the !4orth
Frontage Road. A co~mitt,aa of Planning Commission members mat and
made th~ follo,,,~ing recomaendation:
That sidewalks be constructed along the n~,w portion of the
Horth Frontage Road which ~¥ill be constructed nexd- year as a
part of the Trunk Hwy 5~ Improvement Project. The
construction of this portion of the sidewalk be undertaken by
!ln)OT and it's contractor. ~'tith respect to the construction
of a sidewalk along the existing portion of the ','4orth Frontage
Road, the committee aisc re£omrnended that a sidewalk be
constructed along this road, per the city sidewalk plan.
In the review of the above matter the City Engine, er sugqesTed thaf
the walk along the existing portion of the North Frontage Road be
constructed in 1991 ra[her than 1990 for the following reasons:
~ordination between ¢~ntractors - The T.H. 55
construction in 1990 will involve a n~ber of
subcontractors, utility relocations, and grade work.
Access to the site will be difficult to coordinate with
this large amount of site disruption.
T.H. 55 Detour - !~y understanding of th,a T.H. 55
construction phasing is that the frontage roads will be
constructed first, allowing T.H. 55 traffic to be
detoured onto frontage roads while the mainline is being
reconstructed. Sidewalk construction would create more
traffic problems during an already difficult time.
Following discussion, a motion was made by C~nmissioner Voelker and
seconded by Cc~missioner Folch to rec~m~nd t~e above stated plan
subject to the comments of the City Engineer.
Upon vote taken, 7 Ayes; '~ayes, ;'!one; motion passed·
Planning Director Harmenin~ updated the C~nmission on r~ent
City Council actions.
There being no further business or updates, a motion was made
by C~nmissioner Krook and seconded by Ccmmissioner Voelker to
