C(~nmissloner !(rook said that in the Otb and 9th paragraph of the last page of the minutes, Oommissioner Kaiser was cited as making a motion and seconding a motion. She said that she believed that this was incorrect. After further review staff has determined that Commissioner Featherstone actually made the motion and the second. A motion was made by Commissioner !(rook to approve the minutes as amended, it was seconded by Voelker. Upon vote t~<en, Ayes,5; Nayes, None. :I INUTES Planning Intern Plummet explained to the,.omm~ss~ ' -ion that last June, the City Oouncil approwad the sale of 1.2 acres of land In the Industrial Park to Friends of Animal Adoptions, Inc. He said that this property is located on Lot 4, ~lock 1, of the Nastings Industrial Park No. ?. PUBLIC 4EARIHG I NDNSTRI AL ~ AR,~. .-OJI ,I,.~ A I~ND 1_ ITS Intern Plummer r~ninded the Planning C~mmission that at their July 24, 195~ meeting, the Planning Commission recommended approval of the rezoning of Lot 4, Block 1, from I-2 to I-1. Intern Plummer said that on August 7, 198g, the City Council followed the Planning Commissions' recommendation and approved the first reading of the rezoning. The Council is scheduled to act on the second reading at the meeting of August 21, 1989. Intern Pl~nr~r r~minded the Planning Commission that they had directed staff to compose an ordinance pertaining to kennels/ animal shelters. ;lr. Pl umn~r said that a rough draft of the kennel/animal shelter ordinance was included in the packet and asked if the Planning Commission would like to comment on it. At this time, r.ladame Chair Kaiser reopened the public hearing at 7:34. There being no comn~nts from the public, the hearing ~vas closed at 7:3:3. Hadame Chair Kaiser expressed concern pertaining to 4B of the draft ordinance. She suggested replacing the l~ord unusual, with incessant. Commissioner Ditty asked about a possible veterinary tach that may live on the kennel/animal shelter premises. Frances Wood of 1430 Skyline Road, Eagan, !4N 55121, fr~a Friends of Animals Adoptions, Inc. said that a veterinary technician will hopefully be allowed to live on the premises and said that that persons main duties would be to care for animals and to make sure they are healthy. Comnissioner Voelker asked how carcasses will be disposed of. Frances ¥1ood said that dlsposal of carcasses will be based on advisement of the city. !~ayor Stoffel said that there may be a pet cemetery within the city in tile future. Intern Plumlaer said that 45 of the rough draft addresses this issue. Director Harmenlng said that one last item that will be included in the ordinance is a catch all r~luirement that allows the city to impose other conditions as deemed appropriate. A motion was made by Commissioner Krook, seconded by Voelker mo: 1)Recommend approval of the kennel/animal shelt'er ordinance in rough draft form subject to the suggestions made by the Planning Cammission. 2)Recommended approval to amend Section 10.19, Subd. 3, to add kennel/animal shelter by special use permit. Upon votes taken, Ayes, 5; Nayes, None. Director Harmening explained to the Planning Commission that St. Elizabeth Ann Seton Church is requesting the vacation of the unimproved 26th Street right of way. ~irector Harr~ning said that with the excep~lon of one lot, the Church owns all of the land along this right of way. He stated that the land owned by the church adjacent to the right of way is used as a cemetary and that the right of way width is approximately 40 feet. A motion was made Commissioner !(rook, seconded by Ditty to recommend vacating the unimproved 26th Street right of way. Upon vote taken, Ayes, 5; Nayes, O. Director Harmening explained that the next meeting of the Planning Commission would normally be scheduled for 8/2B/89. He explained that he would be on vacation during the weak of 8/21 to 8/25 and that it would be difficult to have an agenda ready by the 28th. As a result he suggested holding the next Planning Commission .meeting September 5th at 4:30 or 5:00 p.m. before the City Council meeting. Commissioners Ditty, Krook, Kaiser, Anderson and Voelker all said that they could all attend the meeting on the 5th. Director Harmening explained to the Planning Commission that H.A. Fearing & Associates are working on a senior housing project in the Siebens Addition area. He said that the development would include approximately 100 units. Director Harmening said that the developer is requesting a rezoning, preliminary plat and site plan review. Director Harmening suggested that the Planning Commission order a public hearing for the rezoning at the September 5th meeting and a public hearing for fha preliminary plat at the September 11th r~eting. FEAR I "IG & ASSOC. the rezoning for Twin Gable Senior Housing Project on September 5th and set a public hearing for the prelialinary plat on September 11th. The motion was seconded by Krook. Upon votes taken, Ayes, 5; Nayes, 0. Director Harmening gave updates on the previous Council meeting pertaining to County Crossroads and the Westview auto mall. UPDATE/ 0~,4 E R BUSI NESS !.~adame Chair Kaiser said that the Vermillion strip was starting to look like a used car lot because of the numerous busineases selling cars out of their parking lots. She said that she would appreciate if staff would look into the matter,and putting an effort in cleaning this area up. She also said that the signs along Vermillion were beginning to become rather unsightly and suggested cleaning the area up by enforcing the sign code more vigorously.
