The regular meeting of the Hastings Planning Commission was called to order
by Madam Chair Kaiser at 4:30 p.m.
Members Present: Madame Chair Kaiser, Commissioners Krook, Dredge, Featherstone,
Anderson, Voelker
Members Absent: Commissioners Zender and Folch
Staff Present: Plannlng Director Harmenlng and Planning Intern Plummer
Madame Chair Kaiser called for addltions or corrections to
the minutes of August 14, 1989. Hearing none, she declared
the minutes approved as presented.
MINUTES
Planning Dlrector Harmenlng artlculated to the Plannlng
Commission that M.A. Fearing & Associates has requested
approval of a rezonlng from Ag. to R-3 PRD for approximately
16 acres of land located In the Sleben addition area In
south Hastings. Dlrector Harmenlng explalned that the applicant
Is currently in the process of preparing a preliminary plat
for the proposed development which would contain approxlmately
24 four unit structures and five twin home structures. In
addition the project would include a 1.4 acre private park.
Director Harmenlng said that the adjacent zoning to the project
Is R-3 PRD to the north and east, Agriculture to the west and
to the south Is outside the city Ilmlts. Director Harmenlng
then gave some background on the adjacent development, Comprehenslve
Plan and the future required approvals for the project. He said
that staffs recommendation Is to approve the rezonlng of this
property from Ag to R-3 PRD.

Madame Chair Kaiser opened the public hearing at 4:38 p.m.
Rose Cooper, 3270 LeRoy Avenue - She said that she had In her possession
two petitions. She said that one of the petitions was from the whole
surrounding nelghborhood and that It pertained to opposltlon to the
rezonlng of the property known as south of 31st Street and west of
LeRoy Avenue. The second petition was from those residents who received
letters from the city. This petition was also in opposltlon to the
rezoning. Mrs. Cooper said that the reasons that the neighborhood
resldents are In opposition to this zonlng had to do with bringing
down property values, Increased traffic levels and the ruining of
the resldentlal Image of the neighborhood. Ms. Cooper read and
presented the petltlons to the Planning Commission.
Michael Klels, 550 West 31st Street - He sald he was lead to
believe that single family homes would be constructed In the
subject area. He said that addltlonal rental units would mean more
kids, more traffic and more noise. He also said that the existing
apartments owned by Al Sieben are in poor shape.
Carol Mueller, 540 W. 31st St, - Said that she was the first
person to buy a home in Slebens 2nd Addition. She said that she
asked Al Sleben If the subject area would be a single family
development or a multi family development. She said that Al Sieben
told her that the area would be all single family. She also said
that there is a lot of traffic generated from the existing apartment
buildings in the area and that teenagers often drink and throw
their beer cans In the area.
Mike Brown, 655 W. 31st St. - Said that he just moved in
two weeks ago and that if he would have known that there was
going to be multi family in the area he would not have moved
into the area. He said that the other multi family units In
the area look like Junk.
Drea Hampton, 3125 Lester - Said that 31st Street Is
turning Into a raceway and that she's worried about the
children In the area. She also said that with more multi
units In t~3e area the situation would only get worse.

Marlene Fearing, 134 So. 3rd St., Stillwater, MN -
Ms Fearing distributed two brochures Illustrating the project.
She said that It would be a goc~l looking project and would be
well kept. She said that she would have a controlling interest
and that she would also manage the project.
Mike Kleis, 550 W. 31st St. - Sald that he is worried about
the land belng rezoned and then the proposed project
not golng through. He sald that another project of less quality
could easily come In.
Joe Nlebur, 3225 Leroy Ave. - Said that he was told one
thing about how the land was zoned and now he is being told
another thing.
Mike Klels, 550 W. 31st St. - Said that other rental areas in
the city are tucked away and then asked why this project has to
be placed right in the middle of a single family area.
Marlene Fearing of 134 So. 3rd St., Stlllwater, MN said that
the project is not scmethlng to hide.
Ann Mann, 3150 Leroy Ave. - Said that wlth age the project will
look bad and that the increased traffic will make it harder for
kids to cross the street to the park.
Rose Cooper, 3270 Leroy Ave. asked why couldn't the senior
housing project go into Carl Park? Also asked if that area ls
zoned similar to the subject area.
Tom Harmening said that Carl Park and the proposed rezonlng Is
the same zone, R-3 PRD. He went on to further explain the meaning of the
zone and the entire project.
Allen Hampton, 3125 Lester - Said traffic is going to grow and
that there is limited access In the neighborhood.
Director Harmening showed the Siebens 4th Addltlon concept plan
and illustrated how access would be gained In the future.
Jim Olson, 3275 Leroy - Said that Al Sieben does not maintain
his apartments and also stated that Al Sieben said from the
beginning that the subject property would be single family.
Madame Chair Kaiser closed the public hearing at 5:12 p.m.
Commlssloner Anderson asked how many senior units there would be
in the project.
Marlene Fearlng said that approximately 80% of the units would
be senior and 20% would be other.
Commissioner Featherstone asked If the project would require
tax increment financing.
Harlene Fearing said that she must have tax Increment financing
for the project to go through.
Commissioner Ditty asked what other zoning options there were
for the area. Director Harmenlng said that the area could not
be solely single family and comply with the city's Comprehensive
Plan.
Commissioner Dredge sald that since 1982 the Comprehensive Plan
has designated this area for medium density houslng.
Cemmissloner Ditty said that the Plannlng Commlsslon gets caught
in similar situations where developers have told homeowners one
thing and the Cemprehenslve Plan says another. Commissioner Dredge
stated that many of the Issues that the citizens were brlnglng
up must be discussed at the time of preliminary plat approval.
Carol Mueller of 540 W. 31st St. said that Al Sleben said that
the area would be all single family and asked what a Comprehensive
Plan is.
Tom Harmenlng explained what a Cemprehenslve Plan Is.
Mike Kleis, 550 W. 31st St. stated that the south side of town Is
being overburdened wlth multl-famlly housing.
Ccmmissioner Voelker asked If the proposed four plexes would be
single level.
Marlene Fearing sald that they would be one level.
Ccmmlssioner Voelker said that we may be gettlng too much multi-family
then asked if the treatment plant had the capacity to accomodate all
this multi-family housing.
Tom Harmening said that the capacity of the sewer plant can
accomodate the current multi-family housing and more into the future.
Commissioner Featherstone made a motion to table the item. The
motion died for lack of a second.
Commissioner Dredge mede a motlon to approve the rezoning subject
to staffs recommendations. The motlon dled for a lack of a second.
Cemmlssloner Featherstone made a motion to reject the rezoning
due to the fact that the proposed development would lower property
values on adjacent lots. Also, the city has not done a good Job
of Insuring a sound phaslng plan In the area. The motion was seconded
by Ccmmlssloner Krook. Upon votes taken, Ayes, 5; Nayes, Kaiser & Dredge.
Planntng Intern Plummer explained to the Plannlng Commlsslon
that Ms. Mary Doff lng Is requesting a home occupation perm It
for the purpose of conducting piano lessons in the living
room of the twln home unit she plans to purchase. He said
the twin home is located at 121W. 23rd St, and lies In an
R-3 zone, Intern Pl~mer said that staff had two concerns
pertalnlng to the home occupation. One concern dealt with
parking, and the second concern dealt with noise.

Intern Plummer said that the planning staff Is recommending
approval of the home occupetlon permit subject to the
applicant adhering to all the standards to the conduct of
home occupatlons.
Commlssloner Dredge asked Ms. Doffing how late her lessons
would go Into the evening. Ms. Doff lng said that the latest
they would go would be 8:00. Commissioner Dredge made a
motlon to approve the home occupation permit cautioning
Ms. Dofflng to be careful with the parking and subject to
Ms. Doffing complylng with all home eccupatlon standards.
The motion was seconded by Ditty. Upon vote t~en Ayes, 7; Nayes, O.
Director Harmenlng explained to the Planning Ccmmisslon
that on 8/21/89; the Hastings City Council was scheduled
to approve the second reading of the office zoning
district ordinance. He said that due to questions regardlng
certain provlslons in the ordlnance,the Council tabled the
second reading and requested input from the Plannlng
Ccmmlsslon. He said that questions were raised regarding
the provlslon In the ordinance which only allows banks with
drive-thru facllltles by special-use perm It.

Commissioner Krook sald that the reason that banks with
drive-thru facilities would be controlled under the special-
use permlt would be to control traffic as related to
adjacent residential uses.
Commissioner Featherstone said that It was wise to control
banks with drive-thru facllltles by special-use permit.
Commissioner Voelker said that next to residential neighborhoods
you have to be concerned about emissions from cars lined up at
drive-thru facilities.
Commissioner Featherstone said that banks with drive-thru
facilities are not a good buffer. Director Harmenlng thanked
the Planning Commission for their input and he said that he
would articulate their sentiments to the City Council that
evening.
Director Harmening sald that the Knights of Columbus have
made application for the rezonlng of property located
between Trunk Highway 316 and Trunk Highway 61. He said
that the public hearing should be ordered for the September
25, 1989 meeting at 7:30 p.m.
A motion was made to order the public hearing for September
25, 1989 by Commissioner Krook. The motion was seconed by
Commissioner Dredge. Upon votes taken, Ayes, 7; Nayes, None.
Planning Director Harmenlng explained to the Planning
Commission that a special meeting is being requested by
the developer of County Crossroads Addition for September
18, 1989. The Planning Commission agreed to the meeting
and said that It would take place at 4:00 September 18, 1989.
Director Harmenlng read a letter of resignation from
Commissioner Zender. Commissioner Voelker made a motion to
accept Cemmlssloner Zenderst resignation. The motion was
seconded by Ditty. Upon votes taken, Ayes, 7; Nayes, O.
Commlssloner Dredge made a motion to adjourn the meeting
at 6:00 p.m. The motlon was seconded by Commissioner
Krook. Upon votes taken, Ayes, 7; Nayes, O.
