City Council Meeting Minutes
October 05,2020
The City Council of the City of Hastings,Minnesota met in a regular meeting on Monday, October 5,2020
at 7:00 p.m. via Zoom video conference.
Mayor Fasbender explained why and referenced various city, state and federal declarations and guidelines that
an in-person meeting was not practical or prudent due to the COVID-19 Pandemic.
Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks,Folch, Leifeld, Lund and Vaughan

Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council
Meeting on September 21,2020.
Minutes were approved as presented.

Mayor Fasbender stated comments received about items not on the agenda have been distributed to all

Hinzman discussed the preliminary plat and site grading for Sieben Ridge subdivision.He also
indicated that the Planning Commission and Planning Committee of the Council discussed and supported the
development.
Council discussed the duplication of street names and disclosure provided to potential home buyers
regarding mining operations.
Mark Guenther, developer, provided clarification on the point of disclosure.
Councilmember Balsanek motioned to approve the preliminary plat as presented, seconded by
Councilmember Vaughan. Roll Call: Ayes 7;Nays 0.
Councilmember Balsanek motioned to approve the preliminary grading agreement as presented,
seconded by Councilmember Braucks. Roll Call: Ayes 7;Nays 0.
Resolution No. 10-04-20: Site Plan-Expansion of Existing Building -Schlomka (1904 Vermillion St)
Hinman detailed the site plan application to reconstruct a portion of the building located at 1904
Vermillion Street to be utilized as a Coldwell Banker Burnet real-estate office and storage building. The
Planning Commission unanimously voted to approve the site plan.
Councilmember Folch motioned to approve as presented, seconded by Councilmember Leifeld,
Council discussed how the development is consistent with the Vermillion Street Corridor plan, types
of vehicles parked on site,traffic from the site,neighborhood notification, real estate company offices and
appreciation for improvement to the site.
Another motion to approve the item as presented was inadvertently called for and made by
Councilmember Leifeld and was seconded by Councilmember Braucks. The original motion made by
Councilmember Folch and seconded by Councilmember Leifeld was the effective motion. Roll Call for the
original motion:Ayes 7;Nays 0.
CARES Act)Funding
Wietecha discussed the CARES Act federal requirements for expenses and recommended City Council
affirmatively presume that Hastings public safety payroll was substantially dedicated to mitigating the
COVID-19 health emergency from March 1, 2020 through November 15, 2020 and use unallocated CARES
funding for that purpose.
Council discussed payroll expenses related to COVID pandemic,possible license fee relief and
support to all businesses, how to support residents by adding funds to the City's fund reserves, money for the
local school district, business grants, use of funds for public safety,City contributed 42°o of CARES Act funds
received to businesses/non-profits.
Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Braucks.

Mayor Fasbender and Councilmembers made the following announcements:
• HEDRA will meet on Thursday, October 8'at 6:00 p.m.
• Planning Commission will meet on Monday, October 12`h at 7:00 p.m.
• Parks &Recreation Commission meeting for Tuesday, October 13' is cancelled.

Heritage Preservation Comnussion will meet on Tuesday, October 13' at 7:00 p.m.
• City Council workshop on Diversity, Equity, and Inclusion on Monday, October 19"' at 5:30 p.m.
• Fire Prevention Week is October 4-10.The Hastings Fire Department is promoting"Serve Up Safety
in the Kitchen"to educate everyone about simple but important actions they can take to keep safe.
■ Never leave cooking food unattended.
■ Be alert when cooking.
■ Have a"kids' free zone" of at least 3 feet around the stove.
• The City has created a grant program to provide $5,000 grants to non-profit organizations that can
demonstrate financial hardship due to COVID-19. Priority will go to non-profit organizations that
provide human services or public health services to Hastings residents (such as food delivery, mental
health counseling, community outreach, housing assistance, and economic security). Details will be
posted on our website after the HEDRA meeting this Thursday.
• The Hastings Police Department is participating in the Pink Patch Project from October 1-31. Patches,
pins, and pint glasses are available for sale at the Police Department and City Hall with proceeds
benefitting the American Cancer Society.
Councilmember Braucks motioned to adjourn the meeting at 8:33 p.m., seconded by Councilmember

RESOLUTION ORDERING PUBLIC HEARING FOR WELLHEAD PROTECTION PLAN
WHEREAS,the State requires a City to revise its Wellhead Protection Plan every ten years to
protect its ground water aquifer and municipal water supply;
WHEREAS,the City presented Part I of the Wellhead Protection PIan at the September 81
Council Meeting;
WHEREAS, a Pubic Hearing is required after completion of Part II of the Wellhead Protection
Plan;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HASTINGS AS FOLLOWS; that
1. A Public Hearing for the Wellhead Protection Plan be held at the 7pm council meeting on
Monday,November lb,2020,and;
2. An advertisement of the Public Hearing be published in the St Paul Pioneer Press on November
5th and be pasted on the City's website on November 5"'

RESOLUTION SUPPORTING DAKOTA COUNTY'S
2021-2025 CAPITAL IMPROVEMENT PROGRAM
WHEREAS, Dakota County is finalizing approval of their 2021-2025 Capital lmprovemen Program, and
WHEREAS,the City continues to benefit from the construction and maintenance of area and county-wide
transportation,facilities, and grounds improvements, an
WHEREAS,the County's Capital Improvements Plan proposes a$1.1 Million contribution of County
Transportation Sales & Use Tax funds towards the construction of the Trunk Highway 316 Improvements
project, and
WHEREA said contribution will close the funding gap on the project and enable the full scope o
improvements to move forward for construction and completion in 2021,and
WHEREAS,the City of Hastings also supports continued development of the Vermillion River Greenway as a
regional facility,and the City will continue work with the county to identify improvements needed t
regional standards, and
WHEREAS,the City of Hastings continues to welcome further discussion with Dakota County to explore
possibilities for enhancements to other existing facilities as well as the construction of new facilities that
will help to better serve the Hastings area.
NOW,THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS;that
1. The City of Hastings hereby supports the projects included in Dakota County's 2021-2025 Capital
Improvement Program
2. The City of Hastings supports the County's contribution Transportation Sales and Use Tax
towards the Highway 316 Improvements Project.

FIRST AMENDMENTTO JOINT POWERS AGREEMENT
BETWEEN THE COUNTY OF DAKOTA
AND
THE CITY OF HASTINGS
FOR COST SHARING OF REGIONAL.TRAIL IMPROVEMENTS RECONSTRUCTION PROJECT
WHEREAS, effective February 18, 2020,the County of Dakota and the City of Hastings entered
into a joint powers agreement (Agreement)for the cost sharing of regional trail improvements and
reconstruction of a mile of Hamburg Avenue to improve drainage issues in the road ditches by replacing
culverts, reducing sediment build-up and improve water infiltration; and
WHEREAS the parties desire to amend certain terms of the Agreement as more fully set forth
below; and
WHEREAS,the Agreement provides that any amendments shall be valid only when expressed in
writing and duly signed by the parties.
NOW,THEREFORE, in consideration of the mutual covenants contained herein,the parties agree
as follows:
1. To amend Section 5 Payment as follows:
a. 5.1 Contribution Amount.The County shall reimburse the City a total amount not to
exceed Two-hundred seventy-four thousand five-hundred Dollars and 00/100
($274,500.00), including a 10 percent contingency, for actual construction costs incurred
for the paving, crack repair work, reconstruction, and widening of 3,300 feet of the
Mississippi Regional Trail to Hastings.The areas of construction, crack repair work,
widening,and reconstruction are depicted and highlighted in magenta in Exhibit 1. In
addition, crack repair work may occur within any area where the County will assume
jurisdiction and operation as identified in Exhibit 1.
2. All other terms of the Agreement between the County of Dakota and the City of Hastings trail
improvements and reconstruction shall remain in full force and effect unless otherwise
amended or terminated in accordance with law or the terms of the Agreement.
3. In any case where this Amendment conflicts with the Agreement,the Amendment shall govern.

FIRST AMENDMENT TO JOINT POWERS AGREEMENT
BETWEEN THE COUNTY OF DAKOTA
AND THE CITY OF HASTINGS
FOR COST SHARE PEDESTRIAN AND BICYCLE PLAN
WHEREAS, effective January 7, 2020, the County of Dakota ("County") and the City of Hastings ("City") entered
into a Joint Powers Agreement for the cost share of Pedestrian and Bicycle Plan with Minnesota Department of
Health Grant monies through the County's Statewide Health Improvement Program ("SHIP"); and
WHEREAS, the parties desire to amend the terms of the Agreement as set out below; and
WHEREAS, the Agreement provides that any amendments shall be valid only when expressed in writing and duly
signed by the parties.
NOW,THEREFORE, in consideration of the mutual covenants contained herein the parties agree as follows:
1. To amend the recitals as follows:
1. To extend the term of the Agreement until June 30, 2021.
2. All other terms of the Agreement and any amendments between the County and City shall remain in full
force and effect unless otherwise amended or terminated in accordance with law or the terms of the
Agreement.
3. In any case where this Amendment conflicts with the earlier Agreement or any amendments thereto, this
Amendment shall govern.
