January 28, 1991
The regular meeting of the Hastings Planning Commission was called
to order by Commissioner Zender at 7:00 p.m.
Members Present: Commissioners Anderson, Patzke, Reinardy,
Zender, Featherstone and Mesaros
Members Absent: Commissioner Dredge
Staff Present: City Planner Czech
Commissioner Zender called for additions or
corrections to the minutes of the regular meeting
of January 14, 1991. There being no further
additions or corrections to the minutes, the
minutes were approved as presented.

Upon vote taken, Ayes, 6; Nayes, 0.
Czech briefly reviewed staffs January 23, 1991
memorandum to the Planning Commission concerning
a proposed amendment to Chapter 10, Section 10.18
of the city Code (Zoning Ordinance) to allow small
animal clinics as a special use in the C-4 zone
district.
Commissioner Zender opened the public hearing at
7:03 p.m.

DISTRICT
Dr. Mike Bahr of the Hastings Veterinary Clinic
was present at the meeting and explained why
they've asked the city to initiate a proposed
amendment to the zoning ordinance to allow small
animal clinics in the C-4 zone district. Members
of the Planning Commission interacted with
Dr. Bahr concerning the Hastings Veterinary Clinics
intentions if the proposed amendment is approved.
There being no further comments from the audience,
the public hearing was closed at 7:07 p.m.
Commissioner Featherstone moved, Commissioner Anderson
made a second, to approve an amendment to Chapter
10, Section 10.18 which would allow small animal
clinics as a special use in the C-4 zone district.
Upon vote taken, Ayes, 6; Nayes, 0.

memorandum to the Planning commission concerning
a proposed preliminary/final plat entitled
Hastings Heights.
Richard Welshons of 1608 Tierney Drive,
Sharon Houlihan of 1597 W. 14th Street, and
Duane Rohwedder of 1655 Tierney Drive all of which
are adjacent property owners were present at the
meeting and indicated that they were against the
proposed plat. Each of the property owners
expressed concern regarding drainage and potential
flooding adjacent to the 14th Street Ponding Basin.

There being no further comments from the audience,
the public hearing was closed at 7:27 p.m.
The Planning Commission interacted with the
adjacent property owners and staff concerning the
proposed plat and issues relating to it including,
but not limited to, whether it was appropriate
for the city to be platting said property and
drainage issues.
Commissioner Anderson moved, Commissioner Patzke
made a second, to deny the preliminary/final plat
entitled Hastings Heights for the reason that
the city should not be platting said property.
Upon vote taken, Ayes, 6; Nayes, 0.
Commissioner Reinardy moved, Commissioner Mesaros
made a second, that the city further study drainage issues
relating to the 14th Street Ponding Basin including,
but not limited to, liability and potential
flooding/water damage to surrounding property.
Upon vote taken, Ayes, 5; Nayes, 1 (Anderson).
Czech briefly reviewed staffs January 24, 1991,
memorandum to the Planning Commission which
requested that the Planning Commission call a
public hearing for February 11, 1991, at 7:00 p.m.
in order to review a proposed amendment to
Chapter 10, Section 10.185 of the city code
(zoning ordinance) to allow apartments on the
first floor level in the C-5 zone district.

Commissioner Featherstone moved, Commissioner
Anderson made a second, to order a public hearing
for February 11, 1991, at 7:00 p.m. to review
a proposed amendment to the zoning ordinance
which would allow apartments on the first floor
level in the C-5 zone district as a special use.
Upon vote taken, Ayes, 6; Nayes, 0.

memorandum to the Planning commission which
requests that the Planning Commission call for a
public hearing for February 11, 1991, at 7:00 p.m.
in order to review a proposed Comprehensive Plan
amendment and rezone for property legally described
as the East 1/2 of Lot 3, Sunset View
(3300 Vermillion Street).
The Planning Commission briefly interacted with
staff and asked whether this was the same
proposal which had previously been submitted.
Czech indicated that this was in fact the same
proposal which the Planning Commission recommended
approval for in February of 1990.
Commissioner Patzke moved, Commissioner Anderson
made a second, to order a public hearing for
February 11, 1991, at 7:00 p.m. to review a
proposed Comprehensive Plan amendment and rezone
for property at 3300 Vermillion Street.

Czech briefly reviewed staffs January 24, 1991
memorandum to the Planning Commission concerning
the Planning Commission vacancies. Czech noted
that the City Council on January 23, 1991,
reviewed the Planning Commissions previous
recommendation and elected not to fill the vacancies
but rather requested a different recommendation
from the Commission for two remaining vacancies.

VACANCIES
The Planning Commission discussed, at length, the
January 23, 1991, decision of the City Council
concerning the existing Planning Commission vacancies.
The Planning Commission discussion and comments
included, but were not limited to, that the decision
of the Council is perplexing, an injustice to the
Planning Commission and applicants, that they were
against the Councils recommendation and should go
with the Planning Commissions recommendation, that
the Council had no data base to make the decision
and was very high handed, and that the Planning
Commission was best prepared to pick new members
since they did the interviews.
C0 issi0ner Patmke moved, Commissioner Reinardy
made a second, to advertise for additional applicants
which the Planning commission would consider with
two existing applicants, that being Denise Kehn
and Robert Melson and to reject the other five
applicants which consist of Joan Voelker,
George Bateman, Turney Hazlet, LaVerne Weissinger,
and Janie Lindberg with the understanding that
those five cannot reapply for the Planning
Commission vacancy for one year (January 1, 1992}.
Upon vote taken, Ayes, 6; Nayes, 0.
Czech provided the Planning Commission with an
update of city Council actions concerning
planning matters.
There being no further business, Commissioner
Anderson moved, Commissioner Reinardy made a
second, to adjourn the meeting at 8:20 p.m.
