Meeting of February 11, 1991
The regular meeting of the Hastings Planning Commission was called to
order by Commission Zender at 7:00 p.m.
Members Present: Commissioners Dredge, Reinardy, Zender, Featherstone,
Mesaros and Anderson
Members Absent: Commissioner Patzke
Staff Present: city Planner Czech
Commissioner Zender called for additions or
corrections to the minutes of the regular meeting of
January 28, 1991. There being no further additions
or corrections to the minutes, the minutes were
approved as presented.
Upon vote taken, Ayes, 6; Nayes, 0.
Czech briefly reviewed staffs February 6, 1991,
memorandum to the Planning Commission concerning a
request by Dick & Donna Mathiowetz for approval of
a Comprehensive Plan Amendment from "Medium Density
Residential" to ,,Commercial" and a rezone from
R-2 Medium Density Residence to C-5 General Commerce
for property located at 3300 Vermillion Street and
legally described as the East one half of Lot 3,
Sunset View.
Commissioner Patzke joined the meeting at 7:03 p.m.
Commissioner Zender opened the public hearing at
7:04 p.m.
Lorraine Johnson of 3440 Cannon Street was present
at the meeting and indicated that she was opposed
to the proposed Comprehensive Plan Amendment and
rezoRe.
Dick Mathiowetz of 3300 Vermillion Street and applicant
for the proposed Comprehensive Plan Amendment and
rezone was present at the meeting and indicated why
he would like his property to be reguided from
Residential to Commercial and rezoned from R-2
to C-5.
There being no further comments from the audience,
the public hearing was closed at 7:14 p.m.

MATHIOWETZ
The Planning Commission interacted with Ms. Johnson
and Mr. Mathiowetz as well as staff concerning
the proposed Comp Plan Amendment and rezone and
other issues including, but not limited to, the
history behind the original Comp Plan designation
and zoning as well as underground storage tanks.
Commissioner Patzke moved, Commissioner Anderson
made a second, to approve the Comprehensive Plan
Amendment from "Medium Density Residential" to
"Commercial" and a rezone from R-2 to C-5 for
property at 3300 Vermillion Street for the reason
that the subject property is or will be adjacent
to a commercial development to the east as well
as the remaining Mathiowetz property to the West
and South. The Commercial rezoning and reguiding
will "square off" the commercial area and the
intrusion or encroachment of a residential area
into a commercial area. The proposed rezoning/
Comp Plan amendment would also appear to have
a minimal impact on the transportation system in
the area.
Upon vote taken, Ayes, 3; Nayes, 4 (Dredge,
Reinardy, Featherstone and Mesaros). The motion
failed.
Commissioner Dredge moved, Commissioner Reinardy made a
second, to deny the Comprehensive Plan Amendment
from "Medium Density Residential" to "Commercial"
and a rezone from R-2 to C-5 at 3300 Vermillion Street.
Upon vote taken, Ayes, 4; Nayes, 3 (Zender,
Anderson and Patzke).
Czech briefly reviewed staffs February 6, 1991,
memorandum to the Planning Commission concerning
a proposed amendment to Chapter 10, Section 10.185
which would allow apartments on the first floor
level as a special use in the C-5 Zone District.
Commissioner Zender opened the public hearing at
7:28 p.m. There being no comments from the audience
the public hearing was closed.
The Planning Commission interacted with staff
concerning the proposed amendment and issues
relating to it including, but not limited to,
whether the city could place restrictions on a
special use permit which would require either the
owner or an employer to reside in a residence
where there is a commercial use.

APARTMENTS ON
1ST FLOOR LEVEL
C-5 DISTRICT
Commissioner Dredge moved, Commissioner Patzke
made a second, to table the proposed amendment to
Chapter 10, Section 10.185 which would allow
apartments on the first floor level as a special
use in the C-5 Zone District until such time
that staff can review whether restrictions can
be placed on a special use permit such that an
employer/owner would be required to reside in
the residence where there is a commercial use.
Upon vote taken, Ayes, 7; Nayes, 0.
Commissioner Reinardy moved, Commissioner Patzke
made a second, to appoint Dennis Zender as the
Chairperson for the Planning Commission.
Upon vote taken, Ayes, 7; Nayes, 0.
Commissioner Patzke moved, Commissioner
Featherstone made a second, to appoint Eugene
Reinardy as Vice Chairperson of the Planning
Commission.
Upon vote taken, Ayes, 7; Nayes, 0.
Commissioner Featherstone made a motion,
Commissioner Dredge made a second, to adopt by
reference as a part of the Planning Commission
minutes Mike Werners January 31, 1991, memorandum
to the Planning Commission concerning Planning
Commission vacancies.
Upon vote taken, Ayes, 7; Nayes, 0.
The Planning Commission briefly discussed other
Planning related matters.
Czech provided the Planning Commission with an
update of City Council actions concerning
Planning matters.
There being no further business, Commissioner
Patzke moved, Commissioner Reinardy made a
second, to adjourn the meeting at 8:00 p.m.
