HomeMy WebLinkAbout05/28/91 HASTINGS PLANNING COMMISSION Minutes of May 28, 1991 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Commissioners Anderson, Patzke, Dredge, Reinardy and Mesaros Commissioners Absent: Commissioners Zender and Featherstone Staff Present: Community Development Director Wozniak and city Planner Czech Commissioner Reinardy called for additions or corrections to the minutes of the regular meeting of May 13, 1991. There being no additions or corrections to the minutes, the minutes were approved. Czech reviewed staff's May 21, 1991, memorandum to the Planning Commission concerning a request by John Moes of the Sixteen Hundred Building Corporation which requested approval of a preliminary/final plat called sixteen Hundred Corporation Addition located between Highway 61 & 316 south of St. Lukes Cemetery. Commissioner Reinardy opened the public hearing at 7:04 p.m. There being no comments from the audience, the public hearing was closed. MINUTES PUBLIC HEARING PRELIMINARY/ FINAL PLAT - SIXTEEN HUNDRED CORPORATION ADDITION-T.H.61 & 316-SIXTEEN HUNDRED BUILDING CORPORATION Commissioner Dredge moved, Commissioner Patzke made a second, to approve the preliminary/final plat subject to the following conditions: 1. That the hardshells conform with the preliminary/final plat. That the applicant provide $300.00 cash in lieu of park land dedication requirements at the time of submitting the final hardshells. Payment of interceptor sewer charges totalling $450.00 at such time the final plat is submitted. That all access and utility easements be shown on the final hardshells to the satisfaction of the Community Development and/or Public Works Directors. 5e That at such time any portion of the proposed Lot 2, Block 1, sixteen Hundred Corporation Addition is developed that the ingress and egress easement be redesigned so as to conform with the site plan which was approved for the Hastings Veterinary Clinic which illustrates a future 28 foot wide service road as prepared by Richard P. Fuchs and dated April 26, 1991, on file at city Hall (File No. 91-19). 6e That all necessary permits from MnDot including, but not limited to, a driveway permit and hydraulic/hydrology review. That an access easement at least 28 feet in width be submitted to the City Attorney for approval and recorded against the property. Upon vote taken, Ayes, 5; Nayes, 0. Czech reviewed staff's May 21, 1991, memorandum to the Planning Commission concerning a request by Aloyed Jensen for approval of a minor subdivision for property owned by Mr. Jensen at 450 E. 31st Street. PUBLIC HEARING MINOR SUBDIVISION 450EAST 31ST ST. JENSEN Commissioner Reinardy opened the public hearing at 7:07 p.m. Mr. Aloyed Jensen of 450 E. 31st Street was present at the meeting and asked why park land dedication was required as a part of a subdivision. City Planner Czech and Community Development Director Wozniak explained City Code requirements on park land dedication and that other communities commonly require park land dedication or cash in lieu of park land dedication. Commissioner Reinardy asked for additional comments from the audience. There being no further comments from the audience the public hearing was closed at 7:09 p.m. Commissioner Mesaros moved, Commissioner Patzke made a second, to approve the minor subdivision subject to the following condition: That the applicant provide $300.00 in cash in lieu of parkland dedication requirements prior to the city authorizing the County Recorder to allow the minor subdivision. Upon vote taken, Ayes, 5; Nayes, 0. Czech reviewed staff's May 22, 1991, memorandum to the Planning Commission concerning a request by St. Luke's Episcopal Church for approval of a site plan for a proposed addition to the existing church facility at the northeast corner of the Vermillion and 7th Street intersection. SITE PLAN - ST.LUKES CHURCH ADDITION-7TH & VERMILLION STS. John Hamilton of Cunningham Architects who represents St. Luke's Episcopal Church was present at the meeting and indicated that the applicant would prefer not to provide curb and gutter on the existing parking lot. Mr. Hamilton indicated that most communities are moving away from controlled drainage and St. Luke's does not want to redo the parking lot which would be necessary due to curb and gutter. Mr. Hamilton also indicated that St. Luke's does not want to pave the alley from end to end but rather that portion from the drive lane to Sibley Street as indicated on the submitted site plan. Commissioner Zender joined the meeting at 7:24 p.m. Frank Van De Steeg of 1620 Highland Drive was present at the meeting and indicated that he was a member of the St. Luke's Church building committee and noted that the parking situation at St. Luke's was a benefit to the community because St. Luke's allows others to use their parking lot including a Bed and Breakfast, Law Office and those who use commuter service to the Twin Cities during the week when the church is not using the parking lot. The Planning Commission interacted with staff and representatives of St. Luke's Episcopal Church on a number of issues including, but not limited to, curb and gutter requirements, paving the alley and whether it was appropriate that a portion of the alley be vacated. Commissioner Dredge moved, Commissioner Anderson made a second, to approve the sit~ plan subject to the following conditions: The proposed structure and accessory items including, but not limited to, the parking lot and landscaping shall be completed pursuant to the approved site plan dated May 21, 1991 (File #91- 23). Upon request for occupancy of the building, all uncompleted items contained within the site plan shall be addressed pursuant to the escrow requirements contained within the site plan review provisions of the city's zoning ordinance (Section 10.24). The parking lot lighting shall be designed so as not to be obtrusive to adjacent property nor to passing motorists on public right of ways. That the applicant/owner shall satisfy all Uniform Building and Fire Codes. That the applicant/owner provide curb and gutter pursuant to the submitted site plan dated May 21, 1991 (File #91-23) excluding curb and gutter from the proposed canopy to the alley along the east side of the one way drive. That the applicant pave the alley pursuant to the submitted site plan dated May 21, 1991 (File #91-23). Upon vote taken, Ayes, 6; Nayes, 0. Czech reviewed staff's May 21, 1991, memorandum to the Planning Commission concerning a request by Industrial Builders, Inc. for approval of a preliminary/final plat which would replat approximately four acres of property located south of State Highway 55, west of Bahls Drive, east of Westview Drive and bisected by the South Frontage Road. Czech also noted that this plat will require that a portion of the South Frontage Road be vacated due to its realignment. Commissioner Dredge moved, Commissioner Zender made a second, to order a public hearing for a preliminary/final plat for the proposed Westview 3rd Addition and street vacation for a portion of the South Frontage Road for the Planning Commissions next regular meeting scheduled for June 10, 1991, at 7:00 p.m. Upon vote taken, Ayes, 6; Nayes, O. Czech briefly reviewed staffs May 21, 1991, memorandum to the Planning Commission concerning a request by Aldon Enstad for approval of a preliminary/final plat for approximately two acres of unplatted property located adjacent to and north of the North Frontage Road and west of Westview Drive to be called the B & E Addition. Commissioner Zender moved, Commissioner Dredge made a second, to order a public hearing for a preliminary/final plat for the proposed B & E Addition property for the Planning Commissions next regular meeting scheduled for June 10, 1991, at 7:00 p.m. Upon vote taken, Ayes, 6; Nayes, 0. Wozniak reviewed staffs May 23, 1991, memorandum to the Planning Commission concerning proposed amendments to the Subdivision Ordinance concerning Park Dedication Requirements as recommended by the Natural Resources and Recreation Commission. Wozniak provided a comparison between the proposed and current public land dedication requirements including, but not limited to, the type of land to be dedicated and the fees to be adopted by Resolution of the City Council. ORDER PUBLIC HEARING- PRELIMINARY/ FINAL PLAT - B & E ADDITION ENSTAD UPDATES/OTHER BUSINESS The Planning Commission discussed adopting fees by resolution versus requiring three readings by ordinance and expressed concern that there could be abuse if fees were adopted by resolution. The Planning Commission also indicated that commercial and industrial fees are appropriate and have been lacking in the past. In addition, some concern was expressed regarding the amount of residential fees. Wozniak reviewed John Grossman's May 6, 1991, memorandum to the Planning Commission concerning a Riverfront Workshop and that John is requesting that two members of the Planning Commission participate in the workshop. Commissioner Reinardy appointed Commissioner Anderson and himself to be on the Riverfront Workshop committee. Wozniak reviewed staff's May 23, 1991, memorandum to the Planning Commission concerning the Planning Commission Selection Policy. The Planning Commission discussed, at length, the Planning Commission Selection Policy including, but not limited to, that the Commission was concerned and disappointed that the City Council was not at the Planning Commission meeting and did not allow the Planning Commission more input in the Planning Commission Selection Policy. Commissioner Dredge noted that she was against the proposed Selection Policy for a number of reasons including, but not limited to, that other city commissions were not affected by the proposed policy and that the Planning Commission was being forced to accept the new policy. Commissioner Zender noted that he agreed with Commissioner Dredge and said that he cannot support the proposed policy because it would take away the Planning Commissions ability to act as a check and balance to the City Council. Commissioner Patzke noted that he agreed with both Zender and Dredge and thinks that the City Council is trying to force the Planning Commission to give up its first amendments rights and is being punished. Commissioner Anderson noted that there was no negotiating but said that the City Council told the Commission to accept the proposed policy or be disbanded. Commissioner Reinardy discussed a number of items including, but not limited to, there being bad politics in the past, a communication gap between the Council and Planning Commission, and that the City Council is trying to control the Planning Commission. There being no further business, Commissioner Dredge moved, Commissioner Patzke made a second, to adjourn the meeting at 8:28 p.m. ADJOURNMENT
