Minutes of June 10, 1991
The regular meeting of the Hastings Planning Commission was called to
order by Commissioner Reinardy at 7:00 P.M.
Commissioners Present: Commissioners Dredge, Featherstone, Reinardy,
Patzke and Mesaros
Commissioners Absent: Commissioners Anderson and Zender
Staff Present: city Planner Czech
Commissioner Reinardy called for additions or
corrections to the minutes of the regular meeting
of May 28, 1991. There being no additions or
corrections to the minutes, the minutes were approved.
MINUTES
Commissioner Zender arrived at 7:03 P.M.
Czech reviewed staffs May 30, 1991, memorandum to the
Planning Commission concerning a request by
Industrial Builders, Inc. for approval of a
preliminary/final plat entitled Westview 3rd Addition
which replats Westview 2nd Addition and approval to
vacate a portion of the South Frontage Road.
Commissioner Patzke moved, Commissioner Featherstone
made a second, to move item number six on the
agenda which is a home occupation request by
Debra Falk to item number four on the agenda and
to switch items 4 and 5 to 5 and 6 respectively.

Upon vote taken, Ayes, 6; Nays, 0.
Czech reviewed staffs May 28, 1991, memorandum
to the Planning Commission concerning a home
occupation request for a balloon bouquet business
at 701 W. 2nd Street which is the residence of
Debra Falk.

The Planning Commission discussed various issues
relating to the home occupation including, but
not limited to, a letter from Millett O'Connell
and signage for home occupations.
Commissioner Zender moved, Commissioner Patzke
made a second, to approve the home occupation
request subject to the following conditions:
1. Compliance with all home occupation standards.
Compliance with all Uniform Building and Fire
Codes including a basic fire protection inspection
by the Fire Marshall.
Upon vote taken, Ayes, 6; Nays, 0.
Commissioner Reinardy opened the public hearing at
7:10 p.m. There being no comments from the audience
the public hearing was closed.
Commissioner Patzke moved, Commissioner Zender
made a second, to table the preliminary/final
plat and vacation of a portion of the South
Frontage Road for the reason that the applicant
was not present at the meeting.
Upon vote taken, Ayes, 2; Nays, 4 (Dredge,
Reinardy, Featherstone and Mesaros).
The Planning Commission and staff discussed the
appropriateness of requiring the applicant to be
present at Planning Commission meetings.
Commissioner Dredge moved, Commissioner Mesaros
made a second, to approve the preliminary/final
plat and vacation of a portion of the south
Frontage Road for Westview 3rd Addition subject
to the following conditions:
1. That the hardshells conform with the preliminary
plat.
That the applicant provide $500.00 cash in lieu
of park land dedication requirements at the time
of submitting the final hardshells.
3. Payment of interceptor sewer charges totalling
$750.00 at such time the final plat is submitted.
4. That the existing curb cuts be utilized for Lot
1, Block 1 and Lot 2, Block 2.
Upon vote taken, Ayes, 5; Nays, 1 (Zender).
Czech reviewed staffs May 30, 1991 memorandum to
the Planning Commission concerning a preliminary/
final plat entitled B & E Addition as requested
by Aldon Enstad.
Commissioner Reinardy opened the public hearing
at 7:20 p.m.
Gerald Burns, part owner of the subject property
was present at the meeting and explained why he
and the applicant Aldon Enstad desire to subdivide
the property. Czech went over the conditions
with Mr. Burns in order to give him an opportunity
to review the proposed conditions.

There being no further comments from the audience,
the public hearing was closed at 7:29 p.m.
The Planning Commission discussed with the applicant
and staff the proposed conditions for the
preliminary/final plat. The Planning Commission
requested that this item not be placed on the
City Council consent agenda in order to allow
the applicant an opportunity to address the
Council if he so desires.
Commissioner Patzke moved, Commissioner Zender
made a second, to approve the preliminary/final
plat entitled B & E Addition subject to the
following conditions:
1. That the hardshells conform with the preliminary plat.
That the applicant provide $200.00 cash in lieu of park land
dedication requirements at the time of submitting the final
hardshells.
Payment of Interceptor Sewer Charges totalling $300.00 at such time
the final plat is submitted.
That the southerly 50 +/- feet of the subject property be platted
as a public right of way so as to provide a continuation of the
North Frontage Road.
That the northerly 20 feet of the subject property be platted as a
drainage and utility easement.

That the proposed 10 foot wide drainage and utility easement
adjacent to the North Frontage Road also include dedication of a
sidewalk easement by separate agreement to the satisfaction of the
City Attorney within the same 10 foot wide area.
7. That the two (2) most southerly parking stalls be eliminated.
Upon vote taken, Ayes, 6; Nays, 0.
Czech briefly reviewed staffs June 10, 1991,
memorandum to the Planning Commission concerning
a request by Oak Grove Development for approval
of a Comprehensive Plan amendment and rezone for
approximately 21 acres of unplatted property
located contiguous to and south of Highway 55 and
approximately 250 feet west of Pleasant Drive.

Commissioner Dredge moved, Commissioner Mesaros
made a second, to order a public hearing for a
Comprehensive Plan amendment and rezone for
approximately 21 acres of land contiguous and
south of Highway 55 and approximately 250 feet
west of Pleasant Drive as requested by Oak
Grove Development.
Upon vote taken, Ayes, 6; Nays, O.
The Planning Commission discussed whether it
was appropriate to require applicants to be
at Planning Commission meetings for certain
types of applications. Czech indicated that he
would check with the City Attorney to see
whether or not the city could legally require
an applicant to be present at a public meeting.
There being no further business, Commissioner
Dredge moved, Commissioner Zender made a second,
to adjourn the June 10, 1991, Planning Commission
meeting at 7:45 p.m.
