Approve Minutes of the City Council Meeting on September 4, 2020.
Minutes were approved as presented.

Mayor Fasbender stated comments received about items not on the agenda have
been distributed to all councilmembers and are acknowledged.

CONSENT AGENDA
The items on the Consent Agenda are items of routine nature or no perceived controversy to be
acted upon by the City Council in a single motion. There will be no discussion on these items
unless a Councilmember so requests, in which event the items will be removed from the Consent
Agenda to the appropriate Department for discussion.

AWARDING OF CONTRACTS AND PUBLIC HEARING
These are formal proceedings that give the public the opportunity to express their concern, ask
questions, provide additional information, or support on a particular matter. Once the public
hearing is closed, no further testimony is typically allowed and the Council will deliberate
amongst itself and with staff and/or applicant on potential action by the Council.
1. Public Hearing: Ordinance Amendment - Rezone Property to R-3 Medium-High
Density Residence-PRD - Villas at Pleasant (Northridge and Pleasant)
Hinzman detailed the ordinance amendment to rezone the property located at
Northridge and Pleasant from A-Agriculture and R-1 Single Family Residence
to R-3 Medium-High Density Residence-Planned Residential Development for a
32-lot subdivision consisting of villa homes. He indicated that the Planning
Commission unanimously voted for the rezoning. Mayor Fasbender noted all
comments received prior to the meeting were distributed to the Council and are
part of the record.
The public hearing opened at 8:00 p.m.
Kevin Green, 1782 Fallbrooke Drive, spoke in support of the development.
Paul Hiller, 2467 Rivershore Court, spoke in opposition of the development.
The public hearing closed at 8:07 p.m.
Council discussion on reducing size of cul de sacs and effect on emergency
vehicle access, proximity of cul de sacs to adjacent property owners,
accumulation of snow and removal efforts, light spill, privacy fence and
landscaping, number of units on site if zones R1, parking allowed in cul de sacs,
if cul de sacs are City requirement, potential public/private maintenance
agreement for snow removal, lengthening of privacy fence and additional
landscaping, curb cut restrictions on Pleasant Drive, roles of Council, and
appreciation for development, housing needs in Community.
Stuart Simek, developer, provided clarification on several items.
2. Public Hearing: Ordinance Amendment - Rezone Property to R-2 Medium Density
Residence - Sieben Ridge (General Sieben Drive)
Hinzman detailed the ordinance amendment to rezone the property located on
General Sieben Drive between Northridge and Fallbrooke Drive from A-
Agriculture to R-2 Medium Density Residence for a 116-lot subdivision
consisting of traditional single family and villa homes. He indicated that the
Planning Commission unanimously voted for the rezoning. Mayor Fasbender
noted all comments received prior to the meeting were distributed to the
Council and are part of the record.

Council discussion on ownership of adjacent property, adjustment to building
standards due to proximity to quarry, potential pollution concerns.
3. Public Hearing: Vacation of Easement - Lot 10, Block 3, Riverwood 8th Addition
(West 36th Street)
Hinzman explained the reasons to consider the vacation of portions of a
drainage and utility easement. Final adoption of the Resolution will be
considered at an upcoming Council meeting.

Wietecha discussed the various requested council actions relating to CARES
Act Funding approvals. He summarized previous approvals and pending
expenses.

Wietecha discussed the preliminary 2021 City property tax levy, budget,
setting the truth in taxation hearing date and the proposed 2021
HEDRA/HRA special tax levy.
Council discussion on HEDRA housing and site acquisition proposed budget
items, appreciation for fiscal conservativeness when preparing budget
proposal.

BRKFST Dance Co. will give a breakdancing, martial arts,
and contemporary dance performance.

Story in the Park on Wednesday, September 30 at 6:00 pm.
For kids 0 and under, enjoy big book stories, music, and
socially distanced activities all about animals. Kids must be
accompanied by a caregiver.
