HomeMy WebLinkAbout11/12/91Hastings Planning Commission Minutes of November 12. 1991 The Regular Meeting of the hastings Planning Commission was called to order by Commissioner Reinardy at 7:10 p.m. Commissioners Present: Reinardy and Zender Anderson, Bolesworth, Featherstone, Members Absent: Dredge, Mesaros, and Patzske Staff Present: Community Developer Director Wozniak Minutes Commissioner Reinardy call for additions or corrections to the minutes of the regular meeting of October 28, 1991. There being no additions or corrections to the minutes, the minutes were approved. Public Hearing - Hot Asphalt Plant - Commissioner Reinardy opened the public hearing at 7:13 p.m. Comment was heard from Erwin Burmeister of 2200 Ravenna Trail in opposition to allowing Commercial Asphalt to begin operation of the Asphalt Plant at 6:00 a.m. instead of 7:00 a.m. Mr. Burmeister also expressed his concerns regarding lack of adequate screening of the plant and excessive speed of truck traffic on C.S.A.H. 54. Gary Sauer of Commercial Asphalt commented on site screening and land reclamation plans. The public hearing was closed at 7:30 p.m. Commissioner Featherstone asked that the minutes reflect his sentiment that the Public Works Director should be given discretion over occasionally extending hours of operations for the operation of Hot Asphalt Plants. Commissioner Zender moved, Commissioner Bolesworth made a second, to recommend approval to City Council of a Special Use Permit for Commercial Asphalt to operate a Hot Asphalt Plant at its site situated on C.S.A.H. 54 subject to the following conditions: A. Expiration of the permit shall be December 31, 1992. Bo Ce Fe Ho Ail PCArequirements shall be met and all permits received prior to the operation of the plant. The site must be watered as necessary to control dust. Prior to commencing operation of the plant, the applicant shall provide the city with the necessary insurance certificates and a performance bond in the amount of $25,000. The site of the temporary asphalt plant shall be at an elevation of not less than 694. This requirement includes that the bottom of the spill basin shall also be at an elevation of not less than 694. The aggregate stockpile shall be maintained as shown on the site plan for screening purposes. Also, it is strongly encouraged that the stockpile be wrapped around the front of the site as much as possible in order to provide effective screening. That all requirements of city code pertaining to temporary asphalt plants be attached as conditions for permit approval and be adhered to by the applicant: The applicant shall file with the local fire authority a material safety data sheet for a flammable combustible liquid storage permit. That the conditions for approval be strictly enforced. Hours of operation shall be from 6:00 a.m. to 5:00 p.m., however no hauling may begin before 7:00 a.m. Upon vote taken, Ayes 4, Nays, 1. Public Hearing - Rezone "A" to "R-6" Three Rivers Manufactured Home Park - Grund Commissioner Zender moved, Commissioner ~ole=worth seconded, to request that the City Council direct staff to evaluate traffic speed and safety concerns on C.S.A.H. 54 in the vicinity of the Commercial Asphalt/Barton Sand & Gravel Property. Upon vote taken, Ayes 5, Nays 0. Commissioner Reinardy opened the public hearing at 7:40 p.m. Comments were received in opposition to the proposed rezoning from Kevin and Diane Kehn of 3200 Malcolm Avenue. Comments to explain the proposed Manufacture Home Park expansion were received from Brenda McNamara representing the Three Rivers Manufactured Home Partnership. The public hearing was closed at 8:30 p.m. Commissioner Zender moved, Commissioner Anderson seconded, to deny the rezoning request of the Three Rivers Manufactured Home Partnership to rezone from "A" to "R-6" an 11.3 acre parcel situated west of the existing Three Manufactured Home Park based upon the following findings: Conditions of the Original Development Agreement have not been met. 2e Traffic volume and safety concerns have not been adequately addressed. The existing Manufactured Home Park is not in compliance with Storm Shelter requirements. Upon vote taken, Ayes 5, Nayes 0. Variance Request - 3050 Highview Knoll - Sieben Commissioner Zender moved, Commissioner Featherstone seconded, to deny the variance deny the Variance request of A1 sieben to permit construction of a driveway access 38 feet wide at curb at 3050 Highview Knoll on the grounds that the request does not satisfy the following requirements as established in Section 2.04, Subd. 6, Paragraph A. of the Hastings City Code: That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; That literal interpretation of the City Code Would deprive the applicant of rights commonly enjoyed by other properties in the same district under the te~ms of the Zoning Ordinance; That the special conditions and circumstances do not result from the actions of this applicant; That granting the variance requested will not confer on the applicant any special privilege that is denied by the Zoning Ordinance to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or buildings in the same district, and no permitted or non-conforming use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. Upon vote taken, Ayes 5, Nayes 0. There being no further Commissioner Featherstone Commissioner Zender seconded, the meeting at 8:58 p.m. business, moved, to adjourn
