HomeMy WebLinkAbout08/10/92Hastings Planning Commission Meeting of August 10, 1992 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Bateman, Bolesworth, Mesaros, Featherstone and Reinardy Commissioners Absent: Anderson and Zender Staff Present: City Planner Czech MINUTES Commissioner Reinardy called for additions or corrections to the minutes of the regular meeting of July 27, 1992. Commissioner Mesaros requested that the July 27, 1992, minutes reflect that the rezone, preliminary/final plat and site plan for Riverwood Townhomes No. 3 be modified such that Condition No. 6 include a provision that the developer be notified that the interior sideyard setback is half the building height. Commissioner Anderson joined the meeting at 7:04 p.m. The minutes were approved as corrected. SITE PLAN- THREE RIVERS MANUFACTURED HOME PARK Czech reviewed staffs August 6, 1992, memorandum to the Planning Commission relating to a request by Three Rivers Manufactured Home Park for approval of a revised site plan which was tabled at the Planning Commissions July 27, 1992, meeting. The Planning Commission discussed the revised site plan including, but not limited to, the storm water pond, shelter and need for a 30 foot setback from the west property line of the development for any playground equipment that may be located within the 90 foot setback area in the future. Commissioner Featherstone moved, Commissioner Bateman made a second, to approve the revised site plan for Three Rivers Manufactured Home Park subject to the following conditions: The proposed structures and accessory items including, but not limited to, the storm shelter shall be completed pursuant to the approved site plan. Upon request for occupancy in the building, all uncompleted items contained within the site plan shall be addressed pursuant to the escrow requirements contained within the site plan review provisions of the City Zoning Ordinance (Section 10.24). Until such time that the T.H. 316 access issue is resolved, all future phases shall be restricted to the West 320 feet of the North 1,533 feet of the East half of the Northeast quarter of Section 3, Township 114, Range 17, Dakota County, Minnesota which is that area that was rezoned from Agricultural (A) to Manufactured Home Park (R-6) on April 20, 1992. That the applicant/developer understand and agree that all future phases shall provide a minimum 90 foot buffer from those properties within the Sunny Acres Addition. That the applicant/developer provide a name for all new streets subject to the approval of the Fire Marshall. That the applicant/developer provide at least one shade tree per manufactured home park lot. That the applicant/developer satisfy all recreational land requirements as recommended by Parks Director McNamara and/or the Natural Resources & Recreation Commission. That all lots which abut the 90 foot buffer/pedestrian/utility easement area be restricted to double wide manufactured homes i.e. no single wide manufactured homes. That the applicant/developer shall satisfy all uniform building and fire codes. That the applicant/developer receive all necessary approvals from state agencies for manufactured home parks. That the applicant/developer provide the City with as-builts of Phase III utilities and streets. No manufactured homes shall be located in Phase III until such time the storm shelter is constructed. The developer shall provide a certified survey that the storm shelter and ponding basin have been completed pursuant to the approved site plan. That any playground/recreational equipment located within the 90 foot buffer area be placed at least 30 feet from the west property line adjacent to Sunny Acres. Upon vote taken, Ayes, 6; Nays, 0. VARIANCE - SIDEYARD PARKING LOT SETBACK-1222 NO.FRONTAGE ROAD VARIANCE - DRIVEWAY CURB CUT - 902 WEST 2ND STREET Czech reviewed staffs August 5, 1992, memorandum to the Planning Commission relating to a request by E.D. Deutschmann and M.R. Milliren, DDS for approval of a 9 inch to 1 foot sideyard variance for a parking lot to be improved at 1222 North Frontage Road. The Planning Commission discussed the variance request including, but not limited to, the reasons for the dental office building being located too far west and engineering specifications for the proposed retaining wall. Commissioner Featherstone moved, Commissioner Anderson made a second, to approve the nine inch to one foot sideyard parking lot setback at 1222 No. Frontage Road based on the following findings: The applicant inadvertently located the dental office building further to the west which necessitates the need to have the parking lot encroach nine inches to one foot within the five foot sideyard setback. The variance will allow for proper maneuvering area within the parking lot which is a safety issue. Approving the variance will not have a detrimental effect on adjacent properties. Upon vote taken, Ayes, 6; Nays, 0. Czech reviewed staffs July 29, 1992, memorandum to the Planning Commission relating to a request by Marvin Raway for approval of a variance to the maximum 24 foot driveway curb cut width require- ments to allow construction of a driveway which would have a 34 foot 8 inch curb cut at 902 West 2nd Street. The Planning Commission discussed with the applicant and staff issues relating to this variance request including, but not limited to, the applicants reasons for requesting a variance and whether there was a hardship. Commissioner Mesaros moved, Commissioner Anderson made a second, to deny the variance request of Marvin Raway to permit construction of a driveway access 34 feet 8 inches wide at curb and right of way at 902 West 2nd Street based on findings including, but not limited to, that the request does not satisfy the following requirements as established in Section 2.04, Subdivision 6, Paragraph A of the Hastings City Code: UPDATES/OTHER BUSINESS ADJOURNMENT That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; That literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the Zoning Ordinance; That the special conditions and circumstances do not result from the actions of this applicant; That granting the variance requested will not confer on the applicant any special privilege that is denied by the Zoning Ordinance to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or buildings in the same district, and no permitted or non-conforming use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. The applicant made no proposal during construction for a wider driveway. That the applicant be advised that the driveway curb cut can be no greater than 24 feet within the public right of way but can be wider outside the public right of way at the discretion of the applicant. Upon vote taken, Ayes, 5; Nays, I (Bateman). Czech reviewed City Council actions pertaining to Planning matters which occurred at the August 3, 1992, City Council meeting. The Planning Commission briefly discussed an application submitted by Jim Judge of Judge Electric which had been tabled by City Council and the Taco Bell site plan which had been tabled at a previous Planning Commission meeting. In addition, concern was expressed that "walking lines" be painted on West 4th Street in addition to a sign to slow traffic. There being no further business, Commissioner Featherstone moved, Commissioner Mesaros made a second, to adjourn the meeting at 7:55 p.m.
