HomeMy WebLinkAbout10/12/92Hastings Planning Commission Meeting of October 12, 1992 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Anderson, Bateman, Bolesworth, Mesaros and Reinardy Commissioners Absent: Featherstone Staff Present: City Planner Czech MINUTES Commissioner Reinardy called for additions or corrections to the regular meeting of September 28, 1992. There being no additions or corrections the minutes were approved. HOME OCCUPATION 1961 LOUIS LANE-RICHMOND Czech reviewed staffs September 22, 1992, memorandum to the Planning Commission concerning a request by Kenneth Richmond for approval of a home occupation to allow him to write living wills on a computer at 1961 Louis Lane. Commissioner Mesaros moved, Commissioner Bolesworth made a second, to approve the home occupation subject to the following conditions: Compliance with all home occupation standards. Compliance with all Uniform Building and Fire Codes including a basic fire protection inspection by the Fire Marshall. Upon vote taken, Ayes, 5; Nays, 0. SIGN VARIANCE- 1317 VERMILLION STREET - BURNET REALTY Czech reviewed staffs September 29, 1992, memorandum to the Planning Commission concerning a request by Burner Realty for approval of a six foot setback and two foot height variance for a proposed free standing sign to be located at 1317 Vermillion Street. Czech also noted the applicant will be requesting Council to allow the free standing sign to overhang approximately one foot into the public right of way. Gary Buchite, 7350 South 80th Street, Cottage Grove, who represents Burner Realty was at the meeting and explained his reasons for requesting the variance including, but not limited to, that Burner wanted a height variance in order to clear the top of the building and that a pylon sign was more visible than wall signs. The Planning Commission discussed several issues relating to the variance request including, but not limited to, the location of the proposed sign and whether the applicants findings satisfy the variance criteria. SIGN VARIANCE HIGHWAY 55 & VERMILLION ST.- TODD FIELD Commissioner Mesaros moved, Commissioner Anderson made a second, to deny the variance request by Burner Realty to permit construction of a free standing sign at 1317 Vermillion Street based on findings that the request does not satisfy the following requirements as established in Section 2.04, Subdivision 6, Paragraph A of the Hastings City Code: That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; That literal interpretation of the City Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the Zoning Ordinance; That the special conditions and circumstances do not result from the actions of this applicant; That granting the variance requested will not confer on the applicant any special privilege that is denied by the Zoning Ordinance to other lands, structures, or buildings in the same district. No non-conforming use of neighboring lands, structures, or buildings in the same district, and no permitted or non-conforming use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance. Upon vote taken, Ayes, 4; Nays, 1 (Bateman). Czech reviewed staffs October 7, 1992, memorandum to the Planning Commission concerning a request by Jim Peacha for approval of a 71 square foot size, four foot height, 10 foot setback, and one additional sign (two signs total) variance for proposed free standing signs at northeast corner of Highway 55 and Vermillion Street which is the location of Todd Field. The Planning Commission discussed several issues relating to the proposed signs including, but not limited to, ordinance requirements for community signs and the location of the proposed sign. Jim Peacha, 11620 Lockridge Avenue, was present at the meeting and explained to the Planning Commission the purpose of the sign and variance request. John Lightbourn, School District 200, was present at the meeting and provided information concerning this sign and the School District property at Highway 55 and Vermillion Street. UPDATES/OTHER BUSINESS ADJOURNMENT Commissioner Mesaros moved, Com~issioner Bolesworth made a second, to table the si~n variance request until the October 26, 1992, Planning Commission meeting in order to allow the applicants time to determine a specific location for the proposed signs. Upon vote taken, Ayes, 4; Nays, 1 (Anderson). Czech reviewed City Council actions pertaining to planning matters which occurred at the October 5, 1992, City Council meeting. There being no further business, Commissioner Mesaros moved, Commissioner Bolesworth made a second, to adjourn the meeting at 7:44 p.m.
