HomeMy WebLinkAbout12/14/92HASTINGS PLANNING COMMISSION Meeting of December 14, 1992 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:03 p.m. Commissioners Present: Bateman, Bolesworth, Featherstone and Reinardy Commissioners Absent: Anderson and Mesaros Staff Present: City Planner Czech MINUTES Commissioner Reinardy called for additions or corrections to the regular meeting of October 26, 1992. There being no additions or corrections the minutes were approved. PUBLIC HEARING- SPECIAL USE - USED CAR DEALER- SHIP-3175 HWY 61 Czech reviewed staffs December 7, 1992, memorandum to the Planning Commission concerning a special use permit request by Rick Steinke for approval of a used car dealership at 3175 Highway 61. Commissioner Reinardy opened the public hearing at 7:06 p.m. Rick Steinke, 1820 Louis Lane, was present at the meeting and indicated that he would like to establish a used car dealership that is a clean operation and believes that a used car dealership is needed because prices are so high for new cars. The Planning Commission interacted with the applicant and staff on several issues including, but not limited to, Rick Steinke's experience with used car dealerships and whether there would be any accessory uses. Mr. Steinke did indicate that he may move Riverside Collision to the subject property as an accessory use. There being no further comments from the audience, Commissioner Reinardy closed the public hearing at 7:16 p.m. Commissioner Featherstone moved, Commissioner Bateman made a second, to approve the special use permit for a used car dealership at 3175 Highway 61 subject to the following conditions: The business shall be conducted in compliance with all city code requirements including, but not limited to, the following: Class I - Open sales lots which do not sell or trade exclusively in used merchandise and have at least one-third (1/3) of its stock (based upon square footage used) in new, unused merchandise, except that for motor vehicles a franchised selling agreement for the sale of new cars on the Hastings site for which the permit is requested shall be presented in lieu of the one third (1/3) requirement. Class II - Open sales lots not covered by Class I, such as used automobile dealerships, used appliance dealerships, etc. All conditions cited below shall apply to both Class I and Class II lots unless otherwise specified. All Class I open sales or rental lots shall be operated in conjunction with a building or buildings containing the same or similar materials as displayed on the open sales or rental lots. All Class I sales or rental lot and building shall be on one contiguous site except that a portion or portions of said site may be separated by an alley or public street of a width not to exceed sixty-six (66) feet. A solid fence or wall six (6) feet in height shall be erected and maintained along all property lines of the site to be used for an open sales lot which abuts an "R" Use District. Application of this provision shall not require a fence within the required front yard nor within fifteen (15) feet of any street right-of-way line. Minimum site frontage shall be one hundred twenty-five (125) feet. The entire site other than the portion used for building or landscaped yard area shall be hard surfaced according to a plan approved by the City Engineer. A landscaped yard or hard-surfaced strip, not less than ten (10) feet wide shall be maintained along street curb lines except at driveway entrances. A concrete curb not less than six (6) inches above grade shall separate the public right-of-way from the area, except at approved entrances and exits. All lot outdoor illumination shall be accomplished in such a way as to permit no direct rays of light to penetrate beyond the property line. String lighting shall not be permitted. The Class I lot area of open sales or rental lot used for storage and display of merchandise: (1) Shall not exceed two (2) square feet for every one (1) square foot of building on the site devoted to the same or any similar or accessory use. UPDATES/OTHER BUSINESS ADJOURNMENT (2) Open sales lots must store used merchandise smaller than an automoblle inside a buildlng. Class II lots must apply for an annual operating "Used Sales Lot Permit" which will be issued or renewed upon certification by the City Engineer that the lot is complying with this Chapter and other provisions of the City Code. Duration of the "Used Sale Lot Permit" shall be for one (1) year from January 1, to December 31. All landscaped planting to be approved by the City Engineer. The applicant/owner shall satisfy all city code requirements including, but not limited to, parking and signage. The proposed use shall meet all applicable building and fire codes. That the applicant/owner provide the City of Hastings with a bond or cash escrow to cover the cost for hooking up to city utilities. The amount of the bond or cash escrow and time period for hooking up to city utilities shall be determined by the Public Works Director. Upon votes taken, Ayes, 4; Nays, 0. Czech reviewed City Council actions pertaining to planning matters which occurred at the December 7, 1992, City Council meeting. Commissioner Featherstone indicated his personal views on the Planning Commission Selection Process. The Planning Commission inquired about the Comprehensive Plan Update. There being no further business, Commissioner Featherstone moved, Commissioner Bolesworth made a second, to adjourn the meeting at 7:26 p.m.
