HomeMy WebLinkAbout03/29/93 HASTINGS PLA!N/glNG COMMISSION Minutes of Meeting of March 29, 1993 The regular meeting of the Hastings Planning Commission was called to order by Commissioner Reinardy at 7:00 p.m. Commissioners Present: Anderson, Bateman, Bolesworth, Onnen, Reinardy and Schommer Commissioners Absent: Featherstone Staff Present: Paul Czech, City Planner MINUTES Commissioner Reinardy called for additions or corrections to the regular meeting minutes of February 8, 1993. There being no additions or corrections the minutes were approved. Commissioner Featherstone Joined the meeting at 7:03 p.m. HOME OCCUPATION 1519 BAILEY ST. Czech reviewed staffs March 4, 1993, memorandum to the Planning Commission concerning a request by Mitchell Dayton for approval of a home occupation permit to allow him to construct and package bird feeders and poles at 1519 Bailey Street. Commissioner Bateman moved, Commissioner Schommer made a second, to recommend approval of the home occupation permit at 1519 Bailey Street subject to the following conditions: 1. Compliance with all home occupation standards. 2. Compliance with all Uniform Building and Fire Codes including a basic fire protection inspection by the Fire Marshall Upon vote, Ayes, 7; Nays, 0. HOME OCCUPATION 401 WEST 14TH ST. Czech reviewed staffs March 17, 1993, memorandum to the Planning Commission concerning a request by Deborah Marie Rischette for approval of a home occupation permit to allow her an artist studio/offset print shop at 401 W. 14th Street. Commissioner Schommer moved, Commissioner Bateman made a second, to recommend approval of the home occupation permit at 401 West 14th Street subject to the following conditions: 1. Compliance with all home occupation standards. 2. Compliance with all Uniform Building and Fire Codes including a basic fire protection inspection by the Fire Marshall INDUSTRIAL PARK DEVELOPMENT DISTRICT PLAN PUBLIC HEARING - MINOR SUBDIVISION 816 EDDY STREET Czech reviewed staffs March 19, 1993, memorandum to the Planning Co~nission as well as John Grossmans March 17, 1993, memorandum to the Planning Commission concerning proposed modifications to the development district in Industrial Park. The Planning Commission discussed, at length, the proposed modifications to the development district within the Industrial Park. Tom Nesbitt of 221 West 8th Street was present at the meeting and asked that the City place the tax increment surplus back on the tax rolls. The Planning Commission discussed several issues including, but not limited to, the purpose of the TIF District and how the tax increment was going to be used to finance paving of the former railroad grade (Commerce Drive). Commissioner Anderson moved, Commissioner Onnen made a second, to adopt a resolution finding the modification of the Development District Plan for Municipal Development District Number 2 conforms to the City plans for development of the city as a whole. Upon vote taken, Ayes, 5; Nays 2 (Schommer and Featherstone). Czech reviewed staffs March 1, 1993, memorandum to the Planning Commission concerning a request by Robert Schmitz for approval of a minor subdivision of property located at the northwest corner of Eddy and 9th Streets (816 Eddy Street). Commissioner Reinardy opened the public hearing at 7:22 p.m. Robert Schmitz of 803 Oak Street was present at the meeting and expressed concern regarding the proposed conditions relating to the existing garage. Mr. Schmitz indicated that the buyers are intending to fix up the lot and that the next door neighbor to the west is for approving the subdivision. Carol Wilder of 221 West 9th Street was present at the meeting and asked about setbacks and whether they satisfied City Code. Tom Nesbitt of 221 West 8th Street was present at the meeting and indicated that the proposed minor subdivision was not consistent with historic Hastings since the property was grandfathered and there could be sanitation issues. Mary Kay Topp of 201 West 9th Street was present at the meeting and expressed concerns regarding setbacks, splitting the lot, homes being too close together, lot size and the asking price of the property. Rita Ranke of 215 West 9th Street indicated that she was in favor of retaining the old flavor of neighborhoods and that the proposed subdivision would result in homes being too close and decreasing values of existing homes. PUBLIC HEARING AMEND CHAPTER 10 SECTION 10.11, SUBD. 2 TO ALLOW LIBRARIES IN THE R-1 ZONE Lucia Hrinyak of 224 West 6th Street expressed concern that the historic aspect will be destroyed if this type of subdivision is permitted. Beverly Geiken of 209 West 9th Street indicated that she was against the minor subdivision and talked about historic Hastings. Michael Hrinyak of 224 West 6th Street indicated that this was a fragile neighborhood and that if the subdivision were approved values may fall and negatively affect the aesthetics of the neighborhood. There being no further comments from the audience, the public hearing was closed at 7:49 p.m. The Planning Commission discussed, at length, the proposed minor subdivision including, but not limited to, the need to encourage historic presel-vation and whether the minor subdivision would meet all city codes. The Planning Commission requested that the concerns of the residents be noted in the minutes. Commissioner Featherstone moved, Commissioner Onnen made a second, to approve the minor subdivision subject to the following conditions: 1. That the existing garage shall remain with Parcel A as indicated on the boundary survey prepared by Dwyer and Associates, Inc. (Drawing Number 93-014). 2. Prior to construction of a garage on Parcel B, a home shall be constructed on Parcel A. In the alternative, the existing garage on Parcel A shall be removed from the property prior to any building permits being issued for a garage on Parcel B. Upon vote taken, Ayes, 5; Nays, 1 (Bateman). (Anderson abstained). Czech reviewed staffs March 17, 1993, memorandum to the Planning Commission concerning a proposed amendment to the Zoning Ordinance (Section 10.11) which would allow libraries as a permitted use in the R-1 Zone District. Commissioner Reinardy opened the public hearing at 8:05 p.m. There being no comments from the audience, the public hearing was closed. Commissioner Featherstone moved, Commissioner Schommer made a second, to recommend approval of an amendment to Chapter 10, Section 10.11, Subdivision 2b of the Hastings City Code to allow libraries as a permitted use in the R-1 District. PUBLIC HEARING - PRELIMINARY/FINAL PLAT-HASTINGS LIBRARY ADDITION PUBLIC HEARING COMPREHENSIVE PLAN AMENDMENT Upon vote taken, Ayes, 7; Nays, O. Czech reviewed staffs March 17, 1993, memorandum to the Planning Commission concerning a proposed preliminary/final plat for approximately 5.7 acres of unplatted property southwest of State Trunk Highway 55 & Pleasant Drive which is the proposed location for a new Dakota County Library. Czech noted that there maybe some changes to the plat and requested that the Planning Commission hold the public hearing and then table action on this matter until a future meeting. Commissioner Retnardy opened the public hearing at 8:08 p.m. There being no comments from the audience, the public hearing was closed. Commissioner Featherstone moved, Commissioner Bolesworthmade a second, to table action on the preliminary/final plat for the Hastings Library Addition until a future meeting. Upon vote taken, Ayes, 7; Nays, O. Czech reviewed staffs March 17, 1993, memorandum to the Planning Commission regarding a proposed Comprehensive Plan Amendment which would amend and replace in its entirety the existing Comprehensive Land Use Plan. Commissioner Reinardy opened the public hearing at 8:26 p.m. There being no comments from the audience, the public hearing was closed. Czech reviewed with the Planning Commission proposed changes to the draft Comprehensive Land Use Plan. Mr. Bob Weiss of Vermillion was present at the meeting and indicated his desire to have property at the southwest corner of Highway 55 & Oak Street be guided Office. The Planning Commission indicated to Mr. Weiss that it was the Commissions intent to recommend that this property be guided as Office. The Planning Commission took a 10 minute recess at 8:36 p.m. until 8:46 p.m. Commissioner Bateman left the meeting at 8:36 p.m. The Planning Commission discussed, at length, the Comprehensive Plan and additional modifications to the draft plan. Commissioner Bolesworth moved, Commissioner Schommer made a second, to recommend approval of a Comprehensive Plan amendment along with the proposed changes discussed by staff and the Planning Commission which would amend and replace in its entirety the existing Comprehensive Land Use Plan. Upon vote taken, Ayes, 6; Nays, 0. UPDATKS/0THKR BUSINESS ADJOURNMENT Czech reviewed aetion~ pertaining to Planning ralated mattar~ taken by the City Council at its March 22, 1993, meeting. There being no further business, Commissioner Schom~er moved, Commissioner Onnen made a second, to adjourn the meeting at 9:32 p.m.
