Minutes of May 10, 1993
The regular meeting of the Hastings Planning Commission was called to order by
Commissioner Reinardy at 7:00 p.m.
Commissioners Present: Anderson, Bolesworth, Featherstone, Onnen, Reinardy
and Schommer

Commissioner Reinardy called for additions or corrections to the
regular meeting minutes of April 26, 1993. There being no additions
or corrections the minutes were approved.

Czech reviewed staffs May 6, 1993, memorandum to the Planning
Commission concerning a request by Robert Schmitz for approval of
239 square foot lot size variance for a portion of Lot 7 & 8, Block
67, Town of Hastings (816 Eddy Street).
The Planning Commission discussed issues relating to the variance
including, but not limited to, other variance requests, the existing
lot, and whether this request satisfies the variance criteria.
Commissioner Featherstone moved, Commissioner Bolesworth made a
second, to recommend denial of the 239 square foot lot size variance
request of Robert Schmitz at 816 Eddy Street based on findings that
the request does not satisfy the following requirements as
established in Section 2.04, Subdivision 6, Paragraph A of the
Hastings City Code:

That special conditions and circumstances exist which are
peculiar to the land, structure, or building involved and
which are not applicable to other lands, structures, or
buildings in the same district;

That literal interpretation of the City Code would deprive the
applicant of rights commonly enjoyed by other properties in
the same district under the terms of the Zoning Ordinance;
Co
That the special conditions and circumstances do not result
from the actions of this applicant;
Do
That granting the variance requested will not confer on the
applicant any special privilege that is denied by the Zoning
Ordinance to other lands, structures, or buildings in the same
district. No non-conforming use of neighboring lands,
structures, or buildings in the same district, and no
permitted or non-conforming use of lands, structures, or
buildings in other districts shall be considered grounds for
the issuance of a variance.

Czech reviewed actions pertaining to planning matters taken by the
City Council at its May 3, 1993, meeting.
There being no further business, Commissioner Featherstone moved,
Commissioner Bolesworth made a second, to adjourn the meeting at
7:10 p.m.
