Meeting of October 25, 1993
The regular meeting of the Hastings Planning Commission was called to order by Planning
Go~m~issioner Reinardy at 7:00 p.m.
Commissioners Present: Anderson, Bateman, Bolesworth, Featherstone, Onnen, Retnardy
and Schommer
Commissioners Absent: None
Staff Present: City Planner Czech
MINUTES
Commissioner Reinardy called for additions or corrections to the
meeting minutes of October 12, 1993. There being no additions or
corrections the minutes were approved.
AGENDA
AMENDMENT
Commissioner Featherstone requested that agenda items number 7 and
8 be reversed so that the meeting to discuss issues relating to
variances, ponding basins, and landscaping precede the adjournment.

Czech reviewed staffs October 6, 1993, memorandum to the Planning
Commission concerning a request by Thom Smith for approval of a home
occupation permit at 535 West 5th Street.
Commissioner Featherstone moved, Commissioner Bateman made a second,
to recommend approval of the home occupation permit subject to Mr.
Smith complying with all home occupation standards including, but
not limited to, a basic fire protection inspection by the Fire
Marshall.
Upon vote taken Ayes, 7; Nays, O.

VARIANCE-2300/
2310 CANNON
STREET
Czech reviewed staffs October 18, 1993, memorandum to the Planning
Commission concerning a request by T. J. Connell Construction for
approval of a minor subdivision and a setback variance for property
located at 2300/2310 Cannon Street (Lot 13, Block 1, Bohlken Estates
1st Addition). Czech presented a letter from James G. Lorentz of
2126 Cannon Street which indicates that he is opposed to the
variance.
Commissioner Reinardy opened the public hearing at 7:05 p.m.
Gene Thompson of Edina Realty indicated that she was working with
Tom Connell to develop the property and discussed issues relating to
a previous variance approved on Lot 12, Block 1, Bohlken Estates 1st
Addition and the difficulty of siting a twin home.
There being no further comments, the public hearing was closed at
7:08 p.m.
The Planning Commission discussed with staff and the applicant Tom
Connell issues relating to the proposed minor subdivision and
setback variance including, but not limited to, single family versus
two family dwellings, zoning ordinance requirements and the Bohlken
Estates Development Agreement which allows two family dwellings on
the subject property.

Commissioner Scho~er moved, Co~issioner Bateman made a second, to
recommend approval of the minor subdivision subject to the following
conditions:
That a resolution is recorded against the property restricting
development of Lot 13, Block 1, Bohlken Estates 1st Addition
to a common wall two family dwelling with a zero lot line.
That the applicant pay all recording costs associated with
filing the resolution with Dakota County.
Upon vote taken, Ayes, 5; Nays, 2 (Featherstone & Anderson).
Commissioner Schommer moved, Commissioner Bateman made a second, to
recommend approval of the variance which would allow a 24.74 foot
front and 6.03 side yard setback as illustrated on the 10-08-93
Surveyors Certificate prepared by Delmar H. Schwanz.
Upon vote taken, Ayes, 5; Nays, 2 (Anderson and Featherstone).
Czech reviewed staffs October 18, 1993, memorandum to the Planning
Commission concerning a request by T. J. Connell Construction for
approval of a minor subdivision and a setback variance for property
located at 2360/2370 Cannon Street (Lot 10, Block 1, Bohlken Estates
1st Addition).
Commissioner Reinardy opened the public hearing at 7:17 p.m. There
being no comments from the audience, the public hearing was closed.
The Planning Commission discussed issues relating to the minor
subdivision and setback variance including, but not limited to,
whether a five foot privacy fence should be required and driveway
access for the southern unit which is on the corner of Cannon Street
and Bohlken Drive.
Commissioner Onnen moved, Commissioner Schommer made a second, to
recommend approval of a minor subdivision subject to the following
conditions:
That a resolution is recorded against the property restricting
development of Lot 10, Block 1, Bohlken Estates 1st Addition
to a common wall two family dwelling with a zero lot line.
That the applicant pay all recording costs associated with
filing the resolution with Dakota County.
That the driveway for the southern unit shall exit onto Cannon
Street, not Bohlken Drive.
Upon vote taken, Ayes, 7; Nays, 0.
Commissioner Bateman moved, Commissioner Schommer made a second, to
recommend approval of the variance which would allow a 26.47 foot
rear yard setback as illustrated on the 10-08-93 Surveyors
Certificate prepared by Delmar H. Schwanz.

Planning Commission discussed issues relating to variances, ponding
basins and landscaping.
There being no further business, Commissioner Bateman moved,
Commissioner Schormmer made a second, to adjourn the meeting at 7:40
p.m.
